Solid waste collection franchisees shall be selected by the Town Commission based on a competitive bidding process. The Town Commission and the selected bidder shall execute an agreement to commence the solid waste collection services.

The Town may memorialize the selection and franchise by a written resolution of the Town Commission with the contract as an exhibit; however, the franchise rights and obligations of the Town and the franchisee shall commence immediately upon the duly authorized execution of the solid waste contract, regardless of the date of the resolution. All residents and nongovernmental commercial or industrial refuse generators of any kind within the limits of the Town shall utilize the services of the solid waste franchisee in accordance with the contract between the Town and the franchisee.

The use of any other contractor or self-removal of solid waste from within the Town by any entity, even from temporary job sites, shall be a violation of this article and shall be a misdemeanor, and shall be punishable by civil penalties as provided under F.S. Chapter 162, and criminal penalties including up to one month in jail, and fines not to exceed $500. In addition, the Town may pursue any other legal recourse available under the law.
