As used in this chapter, the following terms shall have the meanings
indicated:
- AVAILABLE
- Abutting, adjacent to or 200 feet or less from the property line of said lot, parcel or property.
- PRIVATE WELL
- Any well dug for the purpose of providing the property referred to with water from the subsurface.
- WATER FACILITIES AND LINES
- Underground lines originating from a central water supply operated within the Town of Zolfo Springs and carrying said water to the various parts of the Town.
It is hereby prohibited to install or continue to use any private well
to provide water for human consumption on any improved or unimproved property
located within the Town of Zolfo Springs when water lines and facilities are
available to said property; provided, however, that a private well may be
installed and used for purposes other than human consumption, such as landscaping,
lawn sprinkling, irrigation and other exterior use.
In the event of extension of water facilities and lines to property
using wells for water for human consumption, the owner of said property shall
be given notice by the Town Clerk of the Town of Zolfo Springs of the extension
of said line, and the owner shall have 30 days from the date of said notice
in which to comply with the terms of this chapter.
No plat or replat of any subdivision of any lands located within the
Town of Zolfo Springs shall be approved by the Town Council unless said plat
contains water facilities for the proposed improved sites.
Upon conviction of a violation of this chapter, the person convicted
of such offense shall be punished by a fine not exceeding the sum of $100
or by imprisonment of not more than 60 days or by both such fine and imprisonment,
in the discretion of the Municipal Court. Each day the violation continues
shall be considered a separate offense.
