A. 
The charges and rates for the use and service of the public sanitary sewer system of the City charged to the owners of every building, dwelling house or other property connected with or using such system within the corporate limits of the City of Hagerstown shall be based on the amount of water delivered to the property from a public or private water supply as determined by meter readings or established minimums in accordance with the schedule of sewer rents, rates and charges which the Mayor and Council of the City of Hagerstown shall from time to time fix, establish and adjust.
B. 
The rate per 1,000 gallons of metered water consumption for those customers located within Hagerstown's corporate boundaries shall be:

A. 
The charges and rates for the use and service of the public sanitary sewer system of the City charged to the owners of every building, dwelling house or other property connected with or using such system outside of the corporate limits of the City of Hagerstown shall be based on the amount of water delivered to the property from a public or private water supply as determined by meter readings or established minimums, plus an additional surcharge for the utilization of the City-owned and -financed system, in accordance with the schedule of sewer rents, rates and charges which the Mayor and Council of the City of Hagerstown shall from time to time fix, establish and adjust.
B. 
The rate per 1,000 gallons of metered water consumption for those customers that are not located within Hagerstown's corporate boundaries and not located within an established area of joint sewer service with the Washington County Department of Water Quality shall be:

The approving authority shall maintain and make available to the public the schedule of sewer rents and charges which the Mayor and Council of the City of Hagerstown shall from time to time fix, establish and adjust. Each customer shall be annually advised, in writing, of the rates for sanitary sewer service with an indication of the portion of the charge attributable to the treatment of wastewater.
Whenever the water supply is unmetered, the property owner shall be required to install water meters of a type and in the manner specified by the Board of Water Commissioners of the City of Hagerstown, and the cost of such meter installation will be borne by the property owner. This shall be applicable to customers who utilize a water supply from a private source.
The rates and charges established by this chapter are to be based on an average weight and quality of sewage concentration, representing a maximum expected concentration of 200 milligrams per liter of biochemical oxygen demand (BOD) and 200 milligrams per liter of suspended solids.
If, as a consequence of any tests the approving authority is hereby authorized to make, it is determined that the actual concentration delivered to the WPC system from any property exceeds the maximum as described in this article, a specific rate may be established to compensate for such excess concentration equal to the percentage whereby the actual strength of sewage may exceed the maximum contemplated by the rates set forth in this article, and the specific rate shall be chargeable to the property owner in lieu of the general rates provided by this chapter until further tests which the approving authority shall conduct annually as outlined in this chapter.
Whenever it may be established that the entire amount of water delivered to any property through a metered line from either a public or private water supply does not and cannot enter the WPC system but is legally discharged or consumed in such a manner as not to impose on the WPC system, an exemption of the sanitary sewer service charge may be made on application of the customer, within the absolute discretion of the Mayor and Council as to such measurable water consumption which may be undelivered to the WPC system, provided that it shall first be determined by the approving authority that this is in fact existing.

The charges provided for by this chapter shall be billed in accordance with existing City accounting procedures and may be billed in conjunction with water charges or separately but shall be chargeable against the owner of the property to which the sanitary sewer service has been afforded and shall constitute a lien upon the property and be collectible, at the expiration of 30 days from the date of rendition of the bill therefor, in accordance with applicable existing legal remedies. Further information regarding billing for charges provided for in this chapter is found at Chapter 238, Water, § 238-15, Rendering and payment of bills.
All agreements or contracts affecting sanitary sewer service charges thereof between the City of Hagerstown and customers or tentative customers shall be consistent with the requirements of the Federal Clean Water Act, P.L. 95-217, Section 204(b)(1)(A).
