It shall be unlawful to maintain or install any wires, cables, or other equipment for the transmission of electric current impulses, sounds, voices or communications, in, on, under, over, or along any street, road, sidewalk, parkway, or other public place in the Township, or in, on, under, over, or along any street or road proposed to be dedicated to the Township as a public street or road, or to any newly constructed building or structure on, above, or under the ground; or to maintain or install any pole or mass to support or hold such wires or equipment in such a place, without having fully complied with the provisions of this article.
No wires, cables or equipment for the purposes mentioned in § 193-52 of this article shall be installed overhead, above, along, or over any such street, alley, parkway, sidewalk, park or other public place in the Township, or over or above any newly constructed building or structure, after this Ordinance goes into effect; provided however, that replacement of overhead equipment lawfully existing and maintained may be made, and equipment for servicing premises presently served from existing overhead wires and cables may be installed, upon certification by the public utilities concerned that underground installation is not feasible, stating the reasons therefor, and upon approval of said work by the Township.
All other such wires and cables hereinafter installed shall be placed underground in conduits properly constructed laid and maintained in accordance with the plan therefor approved by the public utilities concerned and the Township.
Applications for permits for the installation or maintenance of electric wires, telephone cables or other electric transmission cables shall be made in writing to the Township, and shall state the name of the applicant, the location, nature, size and purpose of the proposed installation. Each such application shall be accompanied by plans and specifications showing the location involved, the method of installation contemplated, and the nature of the proposed equipment.
Where the installation and maintenance of the electric wires or cables relates to the subdivision of land or land development pursuant to Chapter 198, Subdivision and Land Development, the applicant shall provide the aforesaid specifications and plans to the Planning Commission with the plans for said subdivision or land development, and the Planning Commission and the Township Council shall review and act upon said plans and specifications for the installation of electric wires and cables in the same manner as it now acts upon subdivision plans.
There shall be a fee paid to Horsham Township for each permit issued pursuant to the provisions hereof in an amount established by resolution of Township Council.
The provisions of this chapter shall not be applicable to the following installations:
A. 
Any individual radio or television antenna installed by or for the owner of a single residential, commercial, or industrial business and designed to serve the owners or tenants thereof;
B. 
Any installation on a municipal building or fire company building designed to serve a public purpose; and
C. 
Installation for electric, telephone, or other services requiring installation of electric wires to newly constructed or proposed to be constructed, commercial and industrial buildings upon a certification by the public utilities concerned that underground installation is not feasible, stating the reasons therefor, and upon approval of the Township Manager.
