The following words and terms, when used in this article, shall have the following meanings, unless the context clearly indicates otherwise. All words and terms shall conform to the Vehicle Code.[1]
DEPARTMENT
The Department of Transportation of the Commonwealth of Pennsylvania.
HIGHWAY
The entire width between the boundary lines of every way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular travel. The term includes a roadway open to the use of the public for vehicular travel on grounds of a college or university or public or private school or public or historical park. (The term "highway" includes the term "street.")
SHALL
Indicates that an action is required or prohibited.
STREET
A "highway" as herein defined.
VEHICLE
Every device in, upon or by which any person or property is or may be transported or drawn upon a highway (street), except devices used exclusively upon tracks or rails.
VEHICLE CODE
Act 81 which amended Title 75 of the Pennsylvania Consolidated Statutes and as subsequently amended.[2]

A maximum speed limit of 40 miles per hour is established for certain streets. It shall be unlawful for any person to drive a vehicle at a higher speed than the maximum of 40 miles per hour on any of the following streets:

It is the intent of this article to authorize the posting of speed limits on the above-named streets in accordance with Section 3362(b) of the Vehicle Code,[1] which states "No maximum speed limit under subsection (a)(1) or (3) shall be effective unless posted on fixed or variable official traffic-control devices erected in accordance with regulations adopted by the department, which regulations shall require posting at the beginning and end of each speed zone and at intervals not greater than 1/2 mile."

Any person violating this section is guilty of a summary offense and shall, upon conviction, be sentenced to pay a fine in conformance with § 3362(c) of the Vehicle Code[1] and its amended supplements.
