A. 
This Article establishes a wastewater sewer user charge system in the City to provide funds needed to pay for all expenses associated with the Mineral Belt area wastewater treatment works.
B. 
Park Hills has constructed a wastewater treatment works with Federal funds to serve the Mineral Belt Area; and
C. 
Park Hills must pay all expenses associated with said treatment works and charge any users of said treatment works accordingly.

It is determined and declared to be necessary and conducive to the protection of the public health, safety, welfare and convenience of the City to collect charges from all users who contribute wastewater to the sewer system and the Mineral Belt area's treatment works. The proceeds of such charges will be collected by the City and a portion paid to Park Hills in accordance with the Amended Wastewater Billing Agreement.

A. 
Each user shall pay for the services provided by Park Hills Wastewater Department based on his/her use of the treatment works as determined by water meter(s) acceptable to the City.
B. 
If a residential, commercial or industrial wastewater sewer user uses water which is not supplied by the City, the user charge for that user may be based on a wastewater meter(s) or separate meter(s) installed and maintained at the user's expense and in a manner approved by the City. If a residential user installs no wastewater meter(s) or separate meter(s), the monthly user charge for that user may be based on an estimate determined by U.S. census of average household size and a sixty (60) gallons per day, per person usage plus ten percent (10%) of the estimated average charge.
C. 
The user charge rates established by Park Hills shall apply to all users in the City and shall be collected by Desloge pursuant to the amended wastewater billing agreement.
D. 
Leaks. Whenever a residential user has a water leak and the circumstances indicate that the loss of water was not discharged into the sanitary sewer system, the current monthly charge for sewer service shall be based on the average water consumption of that user's account.

A. 
All users shall be billed monthly by the City. Billings for any particular month shall be made within thirty (30) days after the end of that month. Payments are due when the billings are made. Any payment not received within thirty (30) days after the billing is made shall be delinquent.
B. 
When any bill is thirty (30) days in default, rendition of water and/or wastewater sewer service to such premises shall be discontinued until such bill is paid following due notice and an opportunity for hearing.
C. 
Discontinued water services shall be restored upon arrangement for the payment of the delinquent bill in full and payment of any water service reconnect fees to the City. In the event of discontinued sewer service, service shall be restored upon arrangement for the payment of the delinquent bill in full, and there shall be a reconnect charge of one hundred fifty dollars ($150.00) paid to Park Hills Wastewater Department.

Park Hills will review the user charge system annually and revise user charge rates as necessary to insure that the system generates adequate revenues to pay the costs of operation and maintenance including replacement and debt service and that the system continues to provide for the proportional distribution of operation and maintenance including replacement costs among users.
