No person shall detain or fail to return any book or article borrowed from the Free Public Library of the Borough of Fanwood (also known as "Fanwood Memorial Library"), nor fail to pay any accrued library fines resulting from books or articles borrowed from the Free Public Library of the Borough of Fanwood or from libraries recognizing the Fanwood Library borrower's card, after 30 days have elapsed from the date of posting by certified mail, return receipt requested, of a notice demanding the return thereof addressed to said person at the last known address furnished by said person to the Fanwood Memorial Library.
When the Free Public Library of the Borough of Fanwood becomes legally liable to pay neighboring libraries for the cost of materials borrowed by a Fanwood resident who has failed to return the materials to the loaning library, the Fanwood resident shall reimburse the Free Public Library of the Borough of Fanwood the sum expended in his or her behalf.

Any person or entity borrowing any book or article from the Fanwood Memorial Library and failing to return such book(s) and/or article(s) by the specified due date shall be responsible to pay a fine for each day that said book(s) or article(s) are not returned subsequent to the specified due date in accordance with a schedule of daily fines to be established by the Board of Trustees of the Fanwood Memorial Library. In addition to such fines, a violator of this Section shall also be responsible to pay the Fanwood Memorial Library replacement cost of each book and/or article if it is not returned pursuant to § 187-1 or the cost to restore such book or article if the Fanwood Memorial Library determines it can be repaired. In addition, such person shall be subject to the fine or fines imposed by § 187-7. The fines and charges provided for herein and imposed pursuant to this section shall be paid forthwith upon demand and in no event later than as provided in § 187-7 herein.

No minor under the age of 13 years shall be hereafter issued a library card by the Free Public Library of the Borough of Fanwood unless the application is signed by one of the parents or guardian of said minor, the signature representing acknowledgment by the parent or guardian of responsibility for the return of any books or other articles borrowed by the minor pursuant to this chapter and responsibility for the payment of any fines provided for by this chapter.
No person shall cut, tear, deface, disfigure, damage or destroy any book or any other library article or any part thereof which is owned by or is in the custody of the Free Public Library of the Borough of Fanwood, including any materials borrowed from libraries recognizing the Fanwood Library borrower's card.
No person shall register or furnish a false name or address or use any card other than the one issued to said person for the purpose of borrowing any book or any article or material from the Free Public Library of the Borough of Fanwood or any neighboring library which recognizes the use of Fanwood Library cards.

Any person violating any provision of this chapter shall, in addition to all other fines and charges provided for herein, be subject to a penalty or fine not exceeding $50 for the first offense and not exceeding $100 for the second and each succeeding offense. Any such fine, in addition to the replacement cost or repair cost and/or all accrued library fines thereon, shall be paid to a representative of the Free Public Library of the Borough of Fanwood no later than the time said matter is disposed of by the Municipal Court of the Borough of Fanwood. Any person violating this chapter more than once may have his or her library card and privileges revoked at the discretion of the Board of Trustees of the Free Public Library of the Borough of Fanwood. Consideration of any such violations, including problems with libraries recognizing Fanwood library borrower's card, shall be within the jurisdiction of the Fanwood Municipal Court.

Any interest earned on moneys in the Library Trust Fund established pursuant to New Jersey law and regulations promulgated by the New Jersey Division of Local Government Services shall not be treated as current revenue but shall become part of the principal within the Library Trust Fund and may be used for the same purpose or purposes by the Library Board as such principal funds are used.
