Sewer rentals and charges are hereby established, which shall be payable by and collected from the owner of each sewer rental unit from and after the earlier of the date upon which sanitary sewage or industrial waste is first discharged into the sewer system from such sewer rental unit or 12 months after capacity in the sewer system is reserved and the applicable tapping fee paid under the provisions of § 155-29.13.1 of the Code.

A. 
With respect to the service area of the publicly owned treatment works owned and operated by the Authority, the annual sewer rental for each residential unit shall be $482, payable in two equal semiannual installments of $241 each.
B. 
With respect to the service area of the publicly owned treatment works owned and operated by the Township, the annual sewer rental for each residential unit shall be $482, payable in two equal semiannual installments of $241 each.

A. 
With respect to the service area within Upper Gwynedd Township of the publicly owned treatment works owned and operated by the Authority, all owners of nonresidential units shall pay an annual sewer rental as follows:

(1) 
All such owners shall pay an annual sewer rental which shall be the greater of a sewer rental of $482 ($241 semiannually) or a sewer rental based upon actual water consumption or measured volume of wastewater discharged into the sewer system computed at the rate of $4.42 per thousand gallons of water consumed or wastewater discharged into the sewer system during the semiannual period for which the billing is rendered.
(2) 
All owners of swimming pools, except those on single-family residential lots, including all swimming clubs and pools maintained by hotels, motels, or multifamily residential developments, shall pay an annual sewer rental of $599.24 per year, payable annually.
B. 
With respect to the service area within Upper Gwynedd Township of the publicly owned treatment works owned and operated by the Township, all owners of nonresidential units shall pay an annual sewer rental as follows:

(1) 
All owners of commercial units shall pay an annual sewer rental which shall be the greater of a sewer rental of $482 ($241 semiannually) or a sewer rental based upon actual water consumption or measured volume of wastewater discharged into the sewer system computed at the rate of $4.42 per thousand gallons of water consumed or wastewater discharged into the sewer system, payable quarterly.
(2) 
All owners of industrial units contributing domestic sewage only shall pay an annual sewer rental, which shall be the greater of $482 ($241 semiannually) or $15.14 per employee, payable quarterly.
(3) 
All owners of industrial units which contribute nondomestic sewage or domestic sewage combined with nondomestic sewage shall pay an annual sewer rental based upon actual water consumption or measured volume of wastewater discharged into the sewer system at the rate of $4.42 per thousand gallons of water consumed or wastewater discharged into the sewer system, payable quarterly.
(4) 
All schools shall pay an annual sewer rental equal to $30.35 per student, payable annually.
(5) 
All owners of swimming pools, except those on single-family residential lots, including all swimming clubs and pools maintained by hotels, motels or multifamily residential developments, shall pay an annual sewer rental of $599.24 per year, payable annually.
(6) 
If any payment described hereinabove is made within 30 days of the date of billing therefor, the payor shall be entitled to a 2% discount; and if any such payment is made later than 60 days following such billing date, the payor shall be subject to a 10% penalty thereon, and further such payment shall be subject to interest at 10% per annum from 60 days following the billing date to the date of payment.
C. 
Volume measurement. The volume of water to be used for billing sewer rentals to nonresidential units shall include any and all water purchased from the North Penn Water Authority, North Wales Water Authority, Pennsylvania American Water Company or any other private or public water company; and, in addition, all water obtained from any other source or sources (wells, springs, streams, etc.), as determined by meters installed and maintained by either of said water authorities or any other private or public water company; by meters maintained and installed by the property owner as may be required, approved and inspected by the Township; or from estimates or measurements made by the Township where metering is considered impractical by the Township or when meters have not been installed.
D. 
Excluded water.
(1) 
Exclusion from the sewer system and treatment plant of noncontaminated wastewaters may be required by the Township, or such exclusion may be optional with the property owner if not required by the Township. When such wastewaters are not discharged to the sewer system, sewer rentals shall be based upon total water consumption, less wastewaters not discharged to the sewer system.
(2) 
Wastewaters not discharged to the sewer system may be determined from meters installed and maintained by the owner or from estimates or measurements made by the Township, or the owner may elect to measure the volume of waste actually discharged to the sewer system as provided for below.
E. 
Sewer meters. The Township may require an industrial establishment or the industrial establishment may elect to install, pay for and maintain a meter approved by the Township for measuring wastewaters discharged to the sewer system; in which case sewer rentals shall be based upon the actual volume of wastes discharged to the sewer system. Any premises used wholly or in part for the manufacturing, processing, cleaning, laundering or assembly of any product, commodity or article or any other premises from which process wastes as distinct from domestic sewage are discharged therefrom shall be classified as an industrial establishment for sewer rental purposes.
F. 
Surcharge. In addition to the sewer rental established hereby, a nonresidential user may be subject to surcharges based upon the strength of the wastewater discharged as established under the provisions of Chapter 155, Sewers, Part 5, Pretreatment, § 155-30 et seq. Any nonresidential users subject to a strength surcharge under the pretreatment provisions shall pay, in addition to such surcharge, an additional amount to be added to each billing to cover all costs associated with the monitoring, sampling, testing or analysis of wastewater discharged by such nonresidential user.
G. 
Inspection facilities. When directed by the Township, industrial or commercial establishments shall install, pay for and maintain a manhole or other device as may be approved by the Township to facilitate observation, measurement and sampling of wastes discharged to the sewer system and treatment plant. The Township, or its duly authorized representatives, shall at all reasonable times be permitted to enter upon any and all properties for the purpose of inspecting all metering devices and of observing, measuring and sampling wastes discharged to the sewer system and treatment plant. Any industrial or commercial establishment that desires to connect with the sewer system or which is connected to the sewer system and plans to change its operations so as to materially alter the characteristics and volumes of wastes discharged therefrom shall notify the Township, in writing, at least 10 days before making such connection or changing its operations.
H. 
Installation and maintenance of meters. If the owner of any industrial or commercial establishment shall be required pursuant to the foregoing provisions to install a water meter or meters or a meter or meters for measuring wastewaters, it shall be the duty of such owner to furnish and install such meter at his own expense; and in such case and also if such owner shall have voluntarily installed such meter or meters, such owner shall be required to maintain the same in good operating condition and make all necessary repairs and replacements. If the owner, being obligated so to do, shall fail to furnish or install such meter or meters or shall fail to maintain the same as above provided, then in any such case, after 10 days' written notice by the Township to perform such obligation, the Township may enter onto such property at all reasonable times and install such meter or meters or repair and maintain the same, as the case may be, and charge the cost of such installation or repair to such owner. Bills for such installation or repairs, if made by the Township, shall be due and payable immediately upon completion of the work and then shall be collected in the same manner as semiannual bills for sewer rental and charges.
I. 
Amendments and modifications. Additional classifications and sewer rentals or modifications of the above schedule of rentals may be established or made by the Township from time to time as deemed necessary.

With respect to the service area of the publicly owned treatment works owned and operated by the Township, the tapping fees imposed on either new contributors located in such service area and on existing contributors located in such service area who increase their contribution to the sewer system shall be those as established from time to time by resolution of the Township. The tapping fee shall be paid prior to connection to the sewer system in the case of a new contributor and prior to the increase in contribution by an existing contributor. With respect to the service area of the publicly owned treatment works owned and operated by the Authority, the tapping fees imposed on either new contributors or existing contributors who increase their contribution shall be those as established from time to time by resolution of the Authority.
A. 
Sewer rentals from residential units shall be billed semiannually on the first day of each June and December, commencing on the June 1 or December 1 next succeeding the date upon which waste is first discharged into the sewer system, and shall be due and payable immediately. Sewer rentals for nonresidential units shall be billed semiannually on such dates or as soon thereafter as necessary data to prepare such bills for the semiannual period next preceding such dates shall become available and shall be due and payable immediately upon receipt by the owner of such nonresidential unit.
B. 
If the full amount of such bill shall not be paid within 30 days from the date of billing, 10% of the face amount of the bill shall be added thereto, which, together with the face amount of the bill, shall become the gross amount thereof. Any bill which remains unpaid after 30 days from the date thereof shall also bear interest thereafter at the rate of 10% per year or fraction thereof on the gross amount thereof until paid.
C. 
Failure of any owner to receive semiannual bills for sewer rentals and charges due to the failure of such owner to notify the Township of his correct address or failure of any owner to receive a correct bill for sewer rentals and charges by reason of the failure of such owner to notify the Township of the use or uses of which an improved property or any portion thereof is made, pursuant to the notice requirements of § 155-29.25, shall not excuse nonpayment or failure to pay the amount which would be properly applicable to the use or uses of which said improved property is made and shall not result in an extension of the period of time during which the net bill shall be payable.
Whenever sewer service to any sewer rental unit begins after the first day or terminates before the last day of any semiannual period, the sewer rentals for such sewer rental unit for such semiannual period shall be for that portion of the semiannual period during which the sewer rental unit is served. However, in making such apportionment, a fraction of a month amounting to 1/2 or more of a month shall be counted a full month, and a fraction of a month amounting to less than 1/2 of a month shall be disregarded.

A. 
Delinquent bills for sewer rentals, together with all charges, expenses and fees added thereof, shall in the manner provided by law become a lien upon the property served and shall be collectible by the Township by an action in assumpsit against the owner of such property or be enforced against such property by the filing of a municipal lien.
B. 
In addition to the above requirements, if a sewer rental payment is delinquent by more than 30 days after prior notification by the Township of Upper Gwynedd to the customer by certified mail, giving the customer 10 days to pay the delinquency in full without further notice from the Township of Upper Gwynedd, the North Wales Water Authority or North Penn Water Authority is authorized to terminate water service to the customer's premises.
