The Board of Trustees of the Village of Rye Brook finds that the public interest is best served by establishing a term of office for the Chief of Police of the Village of Rye Brook. Establishing a term for the office of Chief of Police will provide an ongoing incentive for continuing high performance and provide for a mechanism for periodic review, while simultaneously providing civil service rights for the appointee during such term. It is the intent of this article to invoke the authority of § 10, Subdivision 1(ii)a(1), of the Municipal Home Rule Law, to the extent necessary, for the establishing of a term of office in accordance with the provisions of this article, notwithstanding the applicable provisions of § 5711-q of the Unconsolidated Laws. It is the further intent of this article to invoke the authority of § 10, Subdivision 1(ii)e(3), of the Municipal Home Rule Law to supersede or amend, to the extent necessary, the provisions of the Village Law, including §§ 3-302, Subdivision 4, 8-802 and 8-806 thereof, to the extent applicable, so as to establish a term for the office of Chief of Police in accordance with the provisions of this article.
Notwithstanding any other law to the contrary, the term of office of Chief of Police of the Village of Rye Brook shall be five years from the date of appointment for all appointments made after the effective date of this article, including appointments commencing with a probationary term.
The Chief of Police appointed for a term under this article shall not be removed or suspended during such term except in accordance with applicable laws, rules and regulations, including the applicable civil service provisions of § 5711-q of the Unconsolidated Laws.
