This chapter shall be known as the "Trespass Law."
It shall be unlawful for any person, firm or corporation (collectively identified within this chapter as "person") to trespass upon private property within the Village of Head-of-the Harbor or upon public property of the Village of Head-of-the Harbor except public property of the Village which shall be specifically designated for use by the public.
A person is trespassing within the Village of Head-of-the Harbor when that person enters or remains unlawfully. A person "enters or remains unlawfully" in or upon the premises when that person is not licensed or privileged to do so. A person who, regardless of intent, enters or remains in or upon premises which are at the time opened to the public does so with license and privilege unless that person defies the lawful order not to enter or remain, personally communicated to that person by the owner of such premises or other authorized person. A license or privilege to enter or remain in a building which is only partly open to the public is not a license or privilege to enter or remain in that part of the building which is not opened to the public.
Any person, firm or corporation who violates a provision of this chapter shall be subject to a fine or imprisonment up to the maximum that may be imposed in a Village Court, or both, but the fine shall be no less than $100 for the first violation, and a fine of no less than $200 for each and every subsequent violation.
