[HISTORY: Adopted by the Borough Council of the Borough of Pen Argyl 2-1-2005 by Ord. No. 603, approved 2-1-2005. Amendments noted where applicable.]
The Borough of Pen Argyl hereby agrees to intergovernmentally cooperate with the association of municipal subdivisions consisting of the Townships of Washington, Upper Mount Bethel, Lower Mount Bethel and Plainfield, and the Boroughs of Bangor, East Bangor, Pen Argyl and Wind Gap and the Bangor Area School District known as the "Slate Belt Council of Governments." No function, power or responsibility of the Borough of Pen Argyl will be exercised through intergovernmental cooperation with other member municipalities unless ratified by resolution of the governing body.
The Borough of Pen Argyl hereby agrees to participate in the Slate Belt Council of Governments for a term commencing with the adoption of this chapter.
A. 
The Borough of Pen Argyl shall enter into an agreement entitled "Articles of Agreement," a copy of which is attached hereto and incorporated herein by reference, with the intent and effect that the Borough of Pen Argyl shall be bound by the Agreement.[1]

Said Articles were amended to allow the State Belt Council of Governments to quality for tax deductible status under § 501(c)(3) of the Internal Revenue Code and to allow members of the State Belt Council of Governments to request associate member status, which amended Articles the Borough adopted 12-9-2008 by Ord. No. 646, approved 12-9-2008.
B. 
The President of Borough Council and Secretary are hereby authorized and directed on behalf of the governing body to execute and deliver the Agreement.
The governing body is hereby authorized to take such other action as may be necessary or appropriate to carry out the purposes of this chapter and said Articles of Agreement.
The purpose of the Slate Belt Council of Governments is to meet at regular intervals to foster a cooperative effort to resolve regional problems, to determine policies and to formulate plans and programs to meet regional needs. Additional purposes shall include: communication and coordination, polices and priorities, community facilities and services, forum, regional spokesman, staff support and regional review. The Borough of Pen Argyl hereby pledges its support of such purposes and further agrees to jointly cooperate in the exercise or in the performance of its respective governmental functions, powers and responsibilities. This pledge of intergovernmental cooperation without further amendment to this chapter shall not be construed as to delegate or transfer any functions, powers or responsibilities to another local government or to the Slate Belt Council of Governments.
The Borough of Pen Argyl pledges such expenditures as shall be required under the Articles of Agreement.
The Slate Belt Council of Governments shall in all respects conform with the requirements of the Intergovernmental Cooperation Act (53 Pa. C.S.A. § 2301-2315) and the School Code (24 P.S. § 5-522).
The Slate Belt Council of Governments' powers and authorities shall be limited by the Articles of Agreement incorporated herein and made a part hereof.
