As used in this chapter, the following terms shall have the meanings indicated:
BICYCLE
A vehicle with two wheels propelled by pedals.
SCOOTER
A vehicle consisting of an upright steering handle attached to a board or wheel and propelled by human power.
SKATEBOARD
A vehicle consisting of a narrow board mounted on wheels and propelled by human power.
A. 
It shall be unlawful for any person to ride or drive a bicycle, scooter or skateboard upon any public thoroughfare, street, sidewalk or parking lot in the Borough:
(1) 
Between sunset and sunrise on any day.
(2) 
At any other time when, due to insufficient light or unfavorable atmospheric conditions, persons are not clearly discernible from a distance of 100 feet.
B. 
The above prohibitions shall not apply to the operator of any bicycle equipped with a light, reflectors or other device which permits the operator to be discernible from a distance of 100 feet.
It shall be unlawful for any person to ride or drive a bicycle, scooter or skateboard upon any private property without permission of the property owner.
A. 
Any person riding or driving a bicycle, scooter or skateboard shall:
(1) 
Obey the instructions of a police officer or other appropriately attired or authorized person to direct, control or regulate traffic.
(2) 
Obey traffic and pedestrian control signals as provided under any Pennsylvania Motor Vehicle Section, including, but not limited to, 75 P.S. § 3112 (relating to traffic control signals) and 75 P.S. § 3111 (relating to pedestrian control signals), or any Borough ordinance or resolution.
(3) 
Yield the right-of-way to any pedestrian and may not overtake or pass a pedestrian.
B. 
No person shall suddenly leave a curb, sidewalk, berm or street or any other place to ride or drive into or toward the path of a vehicle which is so close as to constitute a hazard.
C. 
No person shall place a ramp, half-pipe or other structure in or about any thoroughfare, street, sidewalk or parking lot.
This chapter shall not apply to any motorized item utilized by a person with any disability.
A. 
First offense. Any item used in violation of this chapter shall be impounded by the Police Department for a period not exceeding 30 days. If the person violating this chapter is a minor, in addition to the confiscation of the item, the Borough Police shall notify the parents, guardian or other person having legal custody of said minor of the violation of this chapter and the impounding and provide such individual with a copy of this chapter.
B. 
Second and/or subsequent offense. Any item used in a second or subsequent offense in violation of this chapter shall be impounded for a period not exceeding 60 days. Said person shall, upon conviction, be sentenced to pay a fine of $10 and costs. In the event said person is a minor, the parent, guardian or other person having legal custody of said minor shall, upon conviction, be responsible for said fine and costs.
