The Office of Borough Manager is created by the Borough Council of the Borough, subject to the right of Council, by ordinance and at any time, to abolish that office.
The Manager shall be appointed for an indefinite term by a majority of all the members of Council. The Manager shall serve at the pleasure of Council and may be removed at any time by a majority vote of all the members of Council.

The Manager shall be chosen on the basis of executive and administrative abilities, with special reference to actual experience in, or knowledge of, accepted practices in respect to the duties of the office as set forth in § 41-6 below. The Manager need not be a resident of the Borough or the Commonwealth of Pennsylvania at the time of appointment, but rather after the completion of the twelve-month probationary period, and during employment, shall live within 15 minutes of the Borough Hall.
The Borough Council shall provide a bond as surety in the sum of $1,000,000 to cover the Borough Manager and all officers. The premium shall be paid by the Borough.
The salary of the Manager shall be fixed from time to time in the same manner as compensation for all other salaried Borough employees. At such time as Council appoints an individual to the office of Manager, Council shall also fix the initial salary of said Manager.
A. 
The Manager shall be the Chief Administrative Officer of the Borough and shall be responsible to Council as a whole for the proper and efficient administration of the affairs of the Borough. For normal day-to-day operations of the Borough, the Borough Manager will report directly to the President of the Milton Borough Council.
B. 
The Manager's powers and duties shall relate to the general management of all Borough business, which are not expressly imposed or conferred upon other Borough officers by statute. The Manager's powers and duties will be governed by the Pennsylvania Borough Code and the job description for the Borough Manager as amended by Borough Council at its sole discretion.
The Mayor is hereby authorized to delegate to the Manager, subject to recall by written notification at any time, any of his nonlegislative and nonjudicial powers and duties.

No individual Council member or any of its committees or members thereof shall dictate or attempt to dictate the hiring, suspending or transferring of any employee by the Borough Manager, except as required to do so by the Civil Service provisions of the Code.
B. 
Recommendations for the discharge of an employee shall be made to Council with reasons thereto. In-house grievances shall proceed as contractually designated for all union members.
C. 
Non-union supervisory personnel shall report first to the director of his/her unit and then to the Borough Manager, with the exception of the Police Department which reports directly to the Mayor. If a nonunion employee feels that they have been unjustly disciplined or recommended for termination, they may request a meeting with the Council. The discipline or termination recommendation shall be ratified or reversed after a meeting of the entire Council. Neither Council nor any of its committees or members shall give orders, publicly or privately, to any subordinates of the Manager.
If the manager becomes ill or needs to be absent from the Borough, the Manager shall designate, with the approval of Council, one qualified member of his staff who shall perform the duties of the Manager during the Manager's absence or disability.
All ordinances or resolutions, or parts of ordinances or resolutions, insofar as they are inconsistent herewith, be and the same are hereby repealed, including Ordinance No. 355, enacted February 5, 1954; Ordinance No. 980, enacted November 16, 1999; Ordinance No. 985, enacted March 15, 1989, and Ordinance No. 1044, enacted December 22, 1993.
Wherever in this chapter a masculine pronoun is used, it includes the feminine.
There shall be a twelve-month probationary period followed by a performance review prior to full appointment. Such evaluation shall be conducted by the Executive Committee of Council.
