Editor's Note: This ordinance repealed former Art. I, Uniform Fire Safety Act, adopted 8-1-1985 (Ch. 78, Art. I, of the 1981 Code), as amended.
Pursuant to N.J.S.A. 52:27D-202 of the New Jersey Uniform Fire Safety Act, the New Jersey Uniform Fire Code, N.J.A.C. 5:70-1.1 et seq., shall be locally enforced within the Township of Allamuchy.
The local enforcing agency shall be the Township of Mount Olive through its Bureau of Fire Prevention which is hereby created therein. The Bureau of Fire Prevention shall hereinafter be known as the local enforcing agency.
A. 
The Bureau of Fire Prevention designated in § 160-2 shall be under the direct supervision and control of a duly appointed Fire Official who shall report to the Mayor and Council of the Township of Mount Olive.
B. 
The Bureau of Fire Prevention shall have at least one paid Fire Official and such paid inspectors and other employees as may be necessary to properly enforce the Uniform Fire Code.
A. 
Appointment and qualification of Fire Official. The Chief Administrative Officer of the Bureau of Fire Prevention shall be a state-certified Fire Official appointed by the Mayor of the Township of Mount Olive with the advice and consent of the Council of the Township of Mount Olive.
B. 
Term of office. The Fire Official shall serve a term of office, the duration of which shall be determined by the Mayor and Council of the Township of Mount Olive.
C. 
Appointment and qualification of inspectors and other employees. Inspectors and other employees of the local enforcing agency shall be appointed or contracted for by the Mayor of the Township of Mount Olive with the advice and consent of the Township of Mount Olive Fire Chief. All life hazard use inspectors shall be certified by the State of New Jersey.
D. 
Removal from office. Inspectors and other employees of the enforcing agency shall be subject to removal by the Mayor of the Township of Mount Olive with the advice and consent of the Fire Official for inefficiency or misconduct. Each inspector or employee to be so removed shall be afforded an opportunity to be heard by the appointing authority or a designated hearing officer.
The local enforcing agency shall enforce the Uniform Fire Safety Act, N.J.S.A. 52:27D-192 et seq., and the codes and regulations adopted pursuant thereto in all buildings, structures and premises within the established boundaries of the Township of Allamuchy, other than owner-occupied one- and two-family dwellings, and shall faithfully comply with the requirements of the Uniform Fire Safety Act, N.J.S.A. 52:27D-192 et seq., and the Uniform Fire Code, N.J.A.C. 5:70-1.1 et seq.
The Bureau of Fire Prevention designated in § 160-2 shall carry out the periodic inspections of life hazard uses required by the Uniform Fire Code on behalf of the Commissioner of the State of New Jersey, Department of Community Affairs.
A. 
In addition to the registrations and permits required by the Uniform Fire Code, all other uses subject to Uniform Fire Code inspections shall register with the Bureau of Fire Prevention. These uses shall be inspected once per year and shall be subject to an annual fee based on the fee schedule set forth below:
(1) 
All buildings and structures, other than those classified as Use Group R-3, which are not required to be registered as life hazard uses must be registered with the Bureau of Fire Prevention and shall be subject to an annual registration fee of $100.
(2) 
All building uses or businesses, other than those classified as Use Group R-3, which are not required to be registered as life hazard uses must be registered with the Bureau of Fire Prevention and shall be subject to an annual registration fee of $100.
(3) 
Exception. Buildings or structures that are occupied by a single building use or business that is owned and operated by the building's or structure's owner shall not be required to register the building use nor business in addition to the registration of the building or structure.
(4) 
The application fee for a certificate of smoke detector compliance inspection as required by N.J.A.C. 5:70-2.3 is as follows:
(a) 
Initial inspection and issuance of a certificate of compliance: $40.
(b) 
Reinspection required due to a failed inspection: $15.
B. 
Uses requiring registration with the State of New Jersey as life hazard uses shall not be required to register or pay fees pursuant to this section.
C. 
Vacant buildings that create a fire hazard shall be charged and inspected according to the fee schedule described above.
The permit fees established by the Uniform Fire Code are as follows:

Pursuant to N.J.S.A. 52:27D-206 and 52:27D-208 of the Uniform Fire Safety Act, any person aggrieved by any order of the local enforcement agency shall have the right to appeal to the Construction Board of Appeals of the County of Warren.
Enforcement, violations and penalties shall be managed in conformity with the Uniform Fire Safety Act, the Uniform Fire Code and all other laws of the State of New Jersey.
