[HISTORY: Adopted by the Common Council of the City of Shawano 4-7-1982 by Ord. No. 872 as Ch. 1 of the 1982 Municipal Code. Amendments noted where applicable.]
The City of Shawano is organized and operates under the Mayor-Council form of government under the provisions W.S.A. Ch. 62.
The elected officials of the City shall consist of:
(1) 
Mayor. Elected in even-numbered years for a two-year term.
(2) 
Aldermen. One from each even-numbered aldermanic district elected in even-numbered years and one from each odd-numbered aldermanic district elected in odd-numbered years, for two-year terms.
(3)

(4) 
City Attorney. Elected in even-numbered years for a two-year term.
The appointed officials of the City shall consist of:
(1) 
Chief of Police. Appointed by the Police and Fire Commission pursuant to W.S.A. s. 62.13(3).
(2) 
Fire Chief. Appointed by the Police and Fire Commission pursuant to W.S.A. s. 62.13(3).
(3) 
Assessor. Appointed by the Council for an indefinite term.
(4) 
Direct of Public Works.
(a) 
Appointment. The Director of Public Works shall be appointed by the Council and serve at the pleasure of the Council. The Director may be removed upon a majority vote of the Council and 30 days' written notice thereof.
(b) 
Member of the Public Works Field Committee. The Director of Public Works shall be a member of the Public Works Field Committee.
(c) 
Powers and duties. The Director of Public Works shall have the following powers and duties:
1. 
Subject to the direction of the Council and the Public Works Field Committee, he or she shall be responsible for the administration of all public works and he or she shall have general charge and supervision of all maintenance, repair and construction of streets, sidewalks, bridges, street signs and house numbering, traffic control devices, storm sewers, culverts and drainage facilities, and all machinery, buildings and equipment used in any activity under his or her control.
2. 
He or she shall be available to assist any City board or commission when deemed necessary by the chairman of such board or commission.
3. 
He or she shall have charge of such public services as garbage and refuse collection and disposal, snow and ice removal, street cleaning and flushing and such other activities as may be assigned to him or her from time to time by the Council.
4. 
He or she shall perform the duties of the City Engineer.
5. 
He or she shall be responsible for the keeping of all records and documents required by law or ordinance, for activities under his or her supervision, and all such items shall remain the property of the City.
6. 
He or she shall have the authority to hire and employ personnel for the operation of all departments under his or her jurisdiction. Likewise he or she shall have the authority to discharge and remove any employee under his or her jurisdiction, except that such removal or discharge shall be based upon misconduct, incompetency, inefficiency, insubordination or failure on his or her direction to perform all the duties assigned to such employee and to observe all the rules and regulations pertaining to his or her work or employment. Any employee discharged shall have the right to appeal such discharge and to be heard before the Finance Committee.
7. 
He or she shall, from time to time, and at least once a month, submit to the Public Works Field Committee such suggestions and recommendations as he or she shall deem advisable for the more efficient operation of the various departments under his or her supervision. He or she shall make an annual report each year to the Public Works Field Committee relating to his or her employment as the Director of Public Works and of all departments and activities under his or her supervision for the preceding calendar year.
8. 
He or she shall abide by and conform to all rules and regulations adopted by the Council and the Public Works Field Committee. It is his or her duty to submit a written budget report to the Public Works Field Committee not later than October 1 of each year.
(5) 
Building Inspector. Appointed by the Council for an indefinite term.
(6) 
Plumbing Inspector. Appointed by the Council upon recommendation of the Building Inspector for an indefinite term.
(7) 
Electrical Inspector. Appointed by the Council upon recommendation of the Building Inspector for an indefinite term.
(8) 
Director of Parks and Recreation. Appointed by the Council, upon recommendation of the Park and Recreation Commission. The Director shall serve at the pleasure of the Council. The Director may be removed by the Council upon a vote of 3/4 of the members of the Council and 30 days' written notice thereof. Such Director shall have the duties and authority provided by the administrative procedure of the Commission.

(9) 
Health Officer. Appointed by the Mayor for a two-year term.
(10) 
Weed Commissioner. Appointed by the Mayor for a two-year term.
(11) 
Nuisance Control Officer. Appointed by the Council for a one-year term to be reviewed in December of each year.

City Administrator.

(a) 
Office of the City Administrator. In order to provide the City of Shawano with a more efficient, effective and responsible government under a system of a part-time Mayor and part-time Common Council (hereinafter referred to as "Council") at a time when City government is becoming increasingly complex, there is hereby created the Office of City Administrator for the City of Shawano (hereinafter referred to as "Administrator").
(b) 
Appointment, term of office and removal. The Administrator shall be appointed on the basis of merit with due regard to training, experience, administrative ability and general fitness for the office, by a majority vote of the Council. For the purposes of appointing or terminating the Administrator, the Mayor and each Alderman shall cast one vote. The Administrator shall hold office for an indefinite term subject to removal at any time by a three-fourths vote of the Council. This section, however, shall not preclude the Council from establishing other employment terms and conditions not inconsistent with the provisions of this subsection or the Municipal Code of the City of Shawano.
(c) 
Residency. The Administrator shall become a resident of the City of Shawano within one year following the date of appointment, unless this requirement is specifically waived or varied by Council ordinance or by contract authorized by the Council, and entered into with the Administrator, covering the terms and conditions of residency.
(d) 
Functions and duties of the Administrator. The Administrator, subject to the limitations defined in resolutions and ordinances of the City of Shawano and Wisconsin State Statutes, shall be the chief administrative officer of the City, responsible only to the Mayor and the Council for the proper administration of the business affairs of the City, pursuant to the statutes of the State of Wisconsin, the ordinances of the City of Shawano and the resolutions and directives of the Council. The powers and duties of the Administrator shall be determined by the Personnel Committee, which Personnel Committee shall also perform evaluations and consider information compiled by the City Administrator Ad Hoc Committee.
(e) 
Effective date. After considerable research and consultation with consultants in this field, the City of Shawano will create the position of City Administrator to take effect beginning January 1, 1999.
(13) 
Heating, Ventilating, Air Conditioning (HVAC) Inspector. Appointed by the Council upon recommendation of the Building Inspector for an indefinite term.

(15) 
City Treasurer functions transferred to the Finance Department.

(a) 
The functions and duties of the City Treasurer, as provided in § 62.09(9), Wis. Stats., are hereby transferred to the Finance Department. The Finance Director shall manage and supervise the City Treasurer functions.
(b) 
Whenever in state law or these ordinances reference is made to a duty of responsibility of the City Treasurer, it shall be read to mean the person(s) performing the City Treasurer functions in the Finance Department.
(16) 
Finance Director. Appointed by the Council for an indefinite term.

City Attorney. Appointed by the Mayor, subject to confirmation of the Council and will serve for an indefinite term.

In the event the Mayor fails to make any appointment, as provided in § 1.03 above, within 15 days of the expiration of any term of office, the Council may, upon motion, make such appointment.

(1) 
The City shall have the following boards and commissions, and citizen members appointed thereto shall serve for the terms indicated:
Administrative Review Board: three years.
Airport Commission: six years.
Board of Health (see § 11.01 of this Code): no citizen members.
Board of Public Works (see Public Works Field Committee, § 2.04 of this Code).
Board of Review: five years.
Board of Zoning Appeals: three years.
Business Improvement District Board: three years.
City-County Transportation Commission: City representatives, two years.
Housing Authority: five years.
Industrial and Commercial Development Committee: three years.
Park and Recreation Commission: three years.
Plan Commission: three years.
Police and Fire Commission: five years.
Senior Citizens' Commission: three years.
Shawano Municipal Utilities Commission: seven years.
Tree Advisory Committee: three years.
(2) 
Terms for all citizen members of boards and commissions shall be from May 1 to April 30. At the time of publication, any current appointment terms shall be extended to the following April 30.
(3) 
Attendance.

(a) 
Any person appointed to a board or commission who misses three regular meetings within a twelve-month period of said board or commission shall be cause for removal of said person; provided, however, that no person who is serving on a board or commission at the time of the adoption of this subsection shall be removed until the completion of said person's term on said board or commission. It is the intent of this subsection that persons appointed to boards or commissions will be available and regularly attend meetings of such body.
(b) 
All such persons shall be expected to personally attend said meetings. An appearance by telephone or other electronic means shall not be considered attending said meeting, unless the Mayor has been given proper notice at least 24 hours in advance of the meeting and has given his or her approval of such telephonic or electronic attendance. Telephonic or other electronic appearances may not occur more than three times within a twelve-month period.
(c) 
Participation via telephonic or electronic means are not allowed in a closed session.
(d) 
During any meeting, cell phones and other electronic devices other than those used for the meeting shall be turned off and put away during the duration of the meeting.

(1) 
Speakers must be City of Shawano residents or City of Shawano taxpayers. Speakers should be prepared to show proof of eligibility to speak if requested.
(2) 
Speakers will be limited to no more than three minutes.
(3) 
There will be no discussion by or with the Committee, Commission or Board members during public comment.
(4) 
Public comments are to be addressed to the Chair and relate only to Committee, Commission or Board business.
(5) 
The following are considered inappropriate and are out of order: profanity, obscenity, shouting, demonstrating support or opposition to comments through clapping, shouting, booing or any other form of distraction and disrespect. Violators shall be removed from the meeting.
(6) 
All participants shall be treated with respect and given a fair and equal opportunity to the process.
(1) 
Members. The Board of Review shall consist of five residents of the City, none of whom shall occupy any public office or be publicly employed, who shall be appointed by the Mayor, subject to confirmation by the Council, for staggered five-year terms.
(2) 
Powers and duties. The Board of Review shall have such powers and duties as provided in W.S.A. s. 70.47.
(1) 
Members. The Commission shall consist of the Mayor, who shall be its presiding officer, an Alderperson, who shall be appointed by the Council, the Building Inspector and six citizens. Citizen members shall be persons of recognized experience and qualifications. Citizen members shall be appointed for three-year terms by the Mayor, subject to confirmation of the Council.

(2) 
Powers and duties. The Commission shall have such powers and duties as provided in W.S.A. s. 62.23.
The functions of the Board of Public Works shall be performed by the Public Works Field Committee and the Shawano Municipal Utilities Commission. [See §§ 2.04 and 6.02(6)(b), respectively, of this Code.]

(1) 
Membership. The City-County Transportation Committee shall consist of 10 members; three City-appointed representatives, including one Alderperson, three county-appointed representatives, one Department of Human Services representative, one Department of Community Programs representative, one Tribal Council appointed representative, and one nonvoting City cab representative. The two at-large City appointments shall be made by the Mayor, and the Alderperson appointment shall be made by the Council President, all subject to confirmation by the Council.

(1) 
Purpose. The Park and Recreation Commission shall administer the park and recreational facilities of the City. The principal object and duty of the Commission shall be to foster and promote the development of City park and recreational facilities, as well as programs related thereto.
(2) 
Members. The Commission shall consist of five members, four of whom shall be appointed by the Mayor subject to confirmation by the Council and an Alderperson who shall be appointed by the Council for a one-year term. In addition, the Mayor shall be an ex officio, nonvoting member of the Commission. The term of the Mayor shall be for the term of his or her office. The terms of the four citizen members shall be three years.

(3) 
Powers and duties. The Commission shall have the powers and duties granted by the Wisconsin statutes pertaining to City park boards and, in addition, subject to final approval of the Council, shall:
(a) 
Adopt administrative procedures, including a financial plan and an operating budget.
(b) 
Recommend to the Council the appointment of a Director of Parks and Recreation.

(c) 
Prior to October 1 in each year, make an estimate of the expenditures by said Commission during the ensuing calendar year, including all necessary incidental expenses, and also an estimate of the amount necessary for the purchase of land for parks and recreational facilities. Such estimate shall be transmitted to the Council, and such part of said estimate as the Council shall approve shall be included in the City budget. All moneys appropriated thereby or received by gift or otherwise for park and recreation facilities shall be paid over to and disbursed by order of the Clerk-Treasurer to pay accounts or bills that have been audited and allowed by said Commission. Such orders shall be paid by the Clerk-Treasurer in the manner provided by W.S.A. s. 66.042. The Commission shall not, however, contract any liability on the part of the City in excess of the budget authorized by the Council.[1]

The City-County Airport Commission shall consist of seven members especially interested in aviation. Members shall be appointed by the City and county as provided in W.S.A. § 114.14(2), with five at-large members appointed to staggered five-year terms appointed alternately by the City and county (current terms will be continued), plus the addition of one City Council member and one County Board member. All said members shall have full voting rights. The City appointments shall be made by the Mayor, subject to confirmation by the Council.

(2) 
Powers and duties. Jurisdiction for the construction, improvement, equipment, maintenance and operation of the joint City-County Airport is hereby vested in the Commission. Said airport shall in all respects be operated by the Commission in concurrence with and under the authority granted by the applicable provisions of W.S.A. Ch. 114.

(1) 
Membership. The Industrial and Commercial Development Committee shall consist of the Mayor and an Alderperson who shall be appointed by the Council and not more than nine citizen members.
(a) 
One citizen member is to be an Industrial Park representative appointed from a business in the Industrial Park.
(b) 
Citizen members shall be appointed by the Mayor, subject to confirmation by the Council, for staggered three-year terms commencing on May 1. In addition, ex officio members shall be the following: Building Inspector, Director of Public Works, Manager of the Utility and Executive Director of Shawano County Economic Progress, Inc.
(2) 
Powers and duties. The Industrial and Commercial Development Committee shall have the following powers and duties:
(a) 
Hold regular meetings, not less than monthly.
(b) 
Elect its own Chairman and Secretary.
(c) 
Fix its own rules of procedure.
(d) 
Keep full and complete records.
(e) 
Submit monthly meeting minutes to the Council subject to the withholding of names and descriptions where confidentiality has been requested.
(f) 
Collaborate with SCEPI on prospective industry and related promotion and advertising.
(g) 
Negotiate, subject to final approval of the Council, for sale, lease, purchase or option to purchase of City-owned property located within commercial or industrial zoned districts. The Committee shall consider in any such negotiation not only the offered purchase price for said property, but also the location of the proposed business, considering the overall plan and layout of the park; how the proposed business will affect the overall tax base of the City; the number of potential jobs which are to be retained or added by said business; the cost, if any, that the City is being asked to assume; avoiding, as much as possible, the subdividing of lots which would result in smaller less attractive lots in the Industrial Park; and considering the Zoning Code regulations concerning allowable uses and other such requirements applicable to the Industrial Park District, said regulations being found in § 10.05(11) of this Code.
(h) 
Incur costs within its annual budget as set by the Council. All such expenditures shall be approved by a majority of the Committee and certified by the Chairman and Secretary, together with appropriate vouchers, before presenting to the Clerk-Treasurer for payment.
(i) 
Employ experts and pay for their services and such other expenses as may be necessary and proper.
(j) 
To assess the industrial and commercial development potential within the City; determine what infrastructure is needed in order to accommodate potential industrial and commercial development; make recommendations to the Plan Committee regarding property uses and zoning changes within the growth management areas designated by the City; establish contacts with other economic development boards; seek information regarding grants and other funding for economic development within the City.
(k) 
Make recommendations to the Council on matters relating to the improvement of sound economic growth and business development; including TIF expenditures and incentives.
(l) 
Examine opportunities for fostering an attractive climate for business within the City with respect to both existing and potential new business establishments.
(m) 
Recommend additional steps and measures to promote economic growth by retaining businesses and attracting new commerce and industry.
(n) 
Cooperate with the Plan Committee and Council in efforts to realize appropriate goals and objectives to sound business practices, an increased tax base and better employment opportunities.
(o) 
Make recommendations to the Council on a commercial and industrial incentive program to attract and retain business in the City of Shawano.
(p) 
Collaborate with the Redevelopment Authority on the use of TIF resources to promote economic development within City TIF districts.
(1) 
Membership. The Senior Citizens' Commission shall consist of the Mayor, an Alderman and six citizen members. The citizen members shall be appointed by the Mayor subject to confirmation by the Council for three-year terms. The Alderman member shall be appointed on the third Tuesday in April by the Council for a one-year term.

(2) 
Powers and duties. The Commission shall:

Select its own Chairman and such other officers it deems necessary.
(b) 
Coordinate and conduct a program or programs to meet the health, recreational and social needs of senior citizens who are residents of the community.
(c) 
Submit a monthly report to the Mayor and Council stating its activities for the previous month (to be included with the monthly meeting minutes).
(d) 
Expend no funds other than those appropriated or approved by the Council.

The Board shall consist of two County Board members, two citizen appointees from the county representing the eastern and western areas of the county, one citizen appointee by the City of Shawano representing the central area of the county, a Shawano City Council representative and a Shawano-Gresham School District Representative. The City appointments shall be made by the Mayor, subject to confirmation by the Council for three-year terms. The Alderperson shall be appointed annually in April by the Council President, subject to confirmation by the Council.
(2) 
Powers and duties. The City-County Library Board shall have such powers and duties as prescribed by law and such other powers and duties as shall be vested in it from time to time by the Council and the County Board, including but not limited to the contract of May 12, 1953, executed between the City and county, which contract was revised on March 21, 2002.

Members. The Business Improvement District Board shall consist of nine persons appointed by the Mayor, subject to confirmation of the Council. The members shall serve for staggered terms of three years, with the exception of the initial term which shall be established by the Council by resolution. A majority of the Board members shall own or occupy real property in the Business Improvement District.
(2) 
Powers and duties. The Board shall have the powers and duties as provided in W.S.A. s. 66.608(3).

(1) 
Members. Five members shall be appointed by the Mayor, subject to confirmation of the Council. The Board shall consist of one representative from the Police Department and four citizen members; all members shall serve a one-year term, except for the first term which shall expire April 30, 2012. Thereafter, appointments shall be made for one-year terms commencing May 1.
(2) 
Powers and duties. The Board shall have powers and duties as set forth in § 8.03(15) of this Code.

(1) 
Purpose. The City of Shawano previously has adopted an Ordinance No. 1506 which established a Municipal Court for the City of Shawano, Wisconsin. At this time, the City of Shawano and Village of Bonduel would like to enter into an intergovernmental agreement pursuant to W.S.A. s. 66.0301 for a Joint Municipal Court to equitably share the cost of administering and operating the Court. Pursuant to W.S.A. s. 755.01(4), any agreement for a Joint Municipal Court must be effected by enactment of identical ordinances by the City and Village.
(2) 
Joint Municipal Court.
(a) 
Court established. The Joint Municipal Court for the City of Shawano and Village of Bonduel created by W.S.A. Ch. 755 is hereby established and shall become operative and functional on January 2, 2004. The City of Shawano Municipal Court which currently exists and shall continue to operate until the operation of said Joint Municipal Court.
(b) 
Jurisdiction. The Joint Municipal Court and the Municipal Judge shall have jurisdiction as provided in W.S.A. ss. 755.045 and 755.05, and as otherwise provided by Wisconsin law.
(c) 
Municipal Judge. The Joint Municipal Court shall be presided over by a Municipal Judge.
1. 
Election; term. The current Municipal Judge serving the Joint Municipal Court for the City of Shawano and Village of Bonduel is currently serving a term that expires on April 30, 2014. At the Spring election of 2014, the Municipal Judge shall be elected at large by the electors of the City and the Village at the Spring election in even-numbered years for a term of four years, commencing on May 1 succeeding the election. The mid-term vacancies in the office of Municipal Judge shall be filled by appointment, as agreed upon by the City Council and the Village Board, pursuant to W.S.A. s. 8.50(4)(fm).

Salary. The Municipal Judge shall receive a monthly salary paid by the City, which shall be in lieu of fees and costs. No salary shall be paid to the Municipal Judge for any time during the term for which the official bond and oath have not been executed and filed, as required by Subsection (2)(c)3 of this subsection.

3. 
Bond; oath. The Municipal Judge shall execute and file with the Clerk of Courts for Shawano County the oath prescribed by W.S.A. s. 757.02 and a bond. The Municipal Judge shall not be qualified to act until a certified copy of the bond is filed with the City and Village Clerks and a certified copy of the oath is filed with the Office of the State Administrator of Courts, as required by W.S.A. s. 755.03.
4. 
Sessions. The Municipal Court shall meet not more than four evenings per month with any changes to said schedule to be reviewed by the Mayor and Village President.
(d) 
Location. The Municipal Judge shall keep an office and hold court in the City Hall of the City of Shawano.
(e) 
Proceedings. The procedure in the Joint Municipal Court shall be as provided by this section and state law, including, without limitation because of enumeration, Chapters 800 and 755 and W.S.A. ss. 23.50 to 23.85, 345.11, 345.53 and 972.11(3m).
(f) 
Forfeitures. The Municipal Judge may impose punishment and forfeitures provided under Wisconsin law, and as provided in the ordinances of the City and Village. The Municipal Judge shall collect all forfeitures, penalty assessments, jail assessments, court costs, fees and taxable costs in any action or proceeding before the Municipal Court and shall pay over the amounts collected to the City Clerk within 15 days of receipt. At such time, the Municipal Judge also shall report to the City Clerk the title of the action, the offense for which forfeiture was imposed and the total amount of the forfeiture, assessment, fees and costs.
(g) 
Contempt of court. The Municipal Judge may impose a sanction authorized under W.S.A. s. 800.12(2) for contempt of court, as defined in W.S.A. s. 785.01(1), in accordance with the procedures under W.S.A. s. 785.03. The Municipal Judge may impose a forfeiture for contempt under W.S.A. s. 800.12(1) in an amount not to exceed $50 or, upon nonpayment of the forfeiture, penalty assessment under W.S.A. s. 165.87, jail assessment under W.S.A. s. 302.46, and any applicable domestic abuse assessment under W.S.A. s. 973.055(1), a jail sentence to not exceed seven days.
(h) 
Stipulation and deposits in Municipal Court.
1. 
Deposit schedule to be established. The respective City Council and Village Board shall adopt a bond schedule, which shall be effective upon approval by said governing bodies. No bond shall exceed the maximum penalty which could be imposed for the ordinance violation.
2. 
Stipulation and deposit in lieu of court appearance. Persons cited for violations of City or Village ordinances for which a deposit has been established under this section shall be permitted to make a stipulation of no contest and a deposit in lieu of court appearance as provided in W.S.A. ss. 800.03, 800.04 and 800.09.
3. 
Traffic and all-terrain vehicle deposits. The deposit schedule established by the Wisconsin Judicial Conference and the procedures set forth in Chapters 23 and 345 of the Wisconsin Statutes shall apply to stipulation and deposits for violations of traffic regulations enacted in accordance with W.S.A. s. 345.26 and all-terrain vehicle regulations enacted in accordance with W.S.A. s. 23.33.
4. 
When not permitted. Stipulations and deposits shall not be permitted after initial appearance or in cases of contempt under Subsection (2)(g).
(i) 
Court authority to impose alternative juvenile dispositions and sanctions.
1. 
For a juvenile adjudged to have violated an ordinance, the Municipal Court is authorized to impose any of the dispositions listed in W.S.A. ss. 938.343 and 938.344, in accordance with the provisions of those statutes.
2. 
For a juvenile adjudged to have violated an ordinance who violates a condition of a dispositional order of the court under W.S.A. s. 938.343 or 938.344, the Municipal Court is authorized to impose any of the sanctions listed in W.S.A. s. 938.355(6)(d), in accordance with the provisions of those statutes.
3. 
The Municipal Judge may impose community service as an alternative to a monetary forfeiture in the case of a juvenile violator if the appropriate municipality has established a community service program. In such a case, the juvenile may be required to complete a community service project as specified by the Court. Supervision of the juvenile upon whom the sentence is imposed shall be the responsibility of the parent, parents or legal guardian having custody of the juvenile.
(j) 
Effective date. This section shall take effect from and after its passage by both municipalities and publication or posting as required by law but in no event shall said ordinance take effect before January 1, 2004, with the exception that the Shawano Municipal Court which has previously been established shall continue in existence until the operation of the Joint Municipal Court as established by this Ordinance takes effect.

(1) 
Members. The Mayor shall determine the number of persons who serve on the Board. The term shall be for one year. The members shall be appointed by the Mayor subject to confirmation of the Council. Advisors for the Board shall be selected by the Mayor. The Clerk-Treasurer shall be an ex-officio member. Advisors and ex-officio members shall not have voting powers.
(2) 
Powers and duties. The Board shall have the following powers and duties:
(a) 
Elect its own Chairperson. Vice Chairperson and Secretary; fix its own rules of meeting and procedures; keep full and complete records; file a monthly report to the Council; and perform such additional duties as may be directed from time to time by the Council.
(b) 
Discuss local issues to include, but not limited to, issues which directly affect youth.
(c) 
Meet with Mayor as needed to discuss youth concerns, ideas, suggestions, etc.
(d) 
Under the direction of the Mayor, meet with the Common Council to present ideas, discuss issues, etc.
(1) 
Subject to the restrictions of W.S.A. ss. 62.09(6) and 66.196, the salaries of all officials, employees and commission or board members shall be determined from time to time by ordinance or resolution enacted by the Council upon recommendation of the Finance Committee.
(2) 
Notwithstanding Subsection (1) above, City departmental heads may provide for merit increases during the year without prior approval of the Council, consistent, however, with the provisions of the City employee personnel policy and with departmental standards and regulations.

(1) 
The purpose of this subsection is to deter the inefficient allocations of City resources by recovering those costs, including, but not limited to, publication and administrative costs, when circumstances arise during which a requester desires to expedite action by a governmental body before the next regularly scheduled meeting of said body. Special meetings of governmental bodies containing voluntary citizen membership without compensation are generally discouraged.
(2) 
That the requestor of special meetings for a City governmental body shall pay a fee before the special meeting shall be scheduled.
(3) 
Exceptions. Subsection (2) of this section shall not apply when:
(a) 
The requestor provides the extraordinary circumstances that prevented the new business from being timely submitted to a regularly scheduled meeting of the governmental body as well as the extraordinary circumstances that prevents the new business from being postponed until the governmental body's next regularly scheduled meeting and said proof is explained in writing; or
(b) 
The requestor is a City official, seeking official action on City business stemming from the normal course of the official's duties.
(4) 
Fee amount. The fee shall be as established by resolution and may be revised from time to time as the Common Council may determine. Only one fee shall be charged for the same issue even if more than one governmental body meeting is required to deal with said issue.
(5) 
Refund. The payment of a fee does not obligate the governmental body to meet. For example, a governmental body may not meet when it is unable to do so or when the special meeting is not feasible. At all times, whether a special meeting of a governmental body is held shall be in the sole and absolute discretion of the City subject to any other applicable statutes and ordinances. After a determination that a special meeting will not occur, a refund of the fee shall be repaid to the requester, except for that portion of the fee disbursed by the City in good faith reliance of the request.
(6) 
Definitions. For this subsection, the following terms shall be defined as follows:
SPECIAL MEETING
A meeting of any governmental body of the City of Shawano, requiring public notice, other than a regularly scheduled meeting.
EXTRAORDINARY CIRCUMSTANCES
Does not include a lack of planning or preparation on behalf of the requestor to timely submit the new business before the governmental body. Extraordinary circumstances shall be determined on a case-by-case basis by the City official or department head through whose office the request originated.
(7) 
Other. In the event a governmental body convenes a special meeting in accordance with this section, the governmental body is not obligated to approve the requestor's request. The governmental body retains sole and absolute discretion as provided by law when considering the request.
Eligible City personnel shall be included under the Wisconsin Retirement Fund (Ordinance No. 339, effective January 1, 1944).

(1) 
Registration required. It shall be the duty of the Clerk-Treasurer to make a registry of electors pursuant to W.S.A. ss. 6.26 to 6.57, and such registration shall be applicable to all elections.
(2) 
Registration at polls. Qualified electors may register at the polls on Election Day. "Polls" for this situation is the City Clerk-Treasurer's office in the Shawano City Hall. All polling places are located in the Shawano City Hall (City Hall front counter and entryway, River Room, Lake Room and Community Room).
(3) 
Polling hours. The polls shall be open for voting from 7:00 a.m. to 8:00 p.m.
(4) 
Appointment of election officials. It shall be the duty of the Clerk-Treasurer to select alternate officials or, when needed, two or more sets of officials to work at different times on election day. Alternate officials shall be appointed in a number sufficient to maintain adequate staffing of the polling place. Except for inspectors who are appointed under Paragraph (1)(b) of W.S.A. s. 7.30, and officials who are appointed without regard to party affiliation under W.S.A. s. 7.30, Paragraph (4)(c), additional officials shall be appointed in such manner that the total number of officials is an odd number and the predominant party under W.S.A. s. 7.30, Paragraph (2), is represented by one more official than the other party. One additional inspector may serve at each polling place without regard to party affiliation, who shall serve as a person to answer questions and to direct electors to proper locations for registration and voting and who shall be available to substitute for other election officials who must leave the room during the voting process.

The Clerk-Treasurer shall safely keep all public papers and records of the City in his or her office or under his or her control at City Hall. Pursuant to W.S.A. s. 19.21, any person may, with proper care and subject to reasonable regulations prescribed by the Clerk-Treasurer, examine or copy such records. No public records shall be removed from the Clerk-Treasurer's control at City Hall unless by order of the Council or pursuant to court order.

(1) 
Declaration of policy. The proper operation of democratic government requires that public officials and employees be independent, impartial and responsible to the people; that government decisions and policy be made in proper channels of the government structure; that public office not be used for personal gain; and that the public have confidence in the integrity of its government. In recognition of these goals, there is hereby established a Code of Ethics for all City officials and employees, whether elected or appointed, paid or unpaid, including members of boards, committees and commissions of the City. The purpose of this code is to establish guidelines for ethical standards of conduct for all such officials and employees by setting forth those acts or actions that are incompatible with the best interests of the City and by directing disclosure by such officials and employees of private, financial or other interests in matters affecting the City. The provisions and purpose of this code and such rules and regulations as may be established are hereby declared to be in the best interests of the City.
(2) 
Responsibility of public office. Public officials and employees are agents of the public and hold office for the benefit of the public. They are bound to uphold the Constitution of the United States and the Constitution of this state and carry out impartially the laws of the nation, state and City and to observe in their official acts the highest standards of morality and to discharge faithfully the duties of their office regardless of personal considerations, recognizing that the public interest must be their prime concern. Their conduct in both their official and private affairs should be above reproach so as to foster respect for all government.
(3) 
Dedicated service.
(a) 
All officials and employees of the City should be loyal to the objectives expressed by the electorate and the programs developed to attain these objectives. Appointive officials and employees should adhere to the rules of work and performance established as the standard for their positions by the appropriate authority.
(b) 
Officials and employees should not exceed their authority or breach the law or ask others to do so, and they should not work where prohibited from so doing by law or by officially recognized confidentiality of their work.

(4) 
Fair and equal treatment.
(a) 
Use of public property. No official or employee shall request or permit the unauthorized use of City-owned vehicles, equipment, materials or property for personal convenience or profit.
(b) 
Obligations to citizens. No official or employee shall grant any special consideration, treatment or advantage to any citizen beyond that which is available to every other citizen.
(5) 
Conflict of interest.
(a) 
Financial and personal interest prohibited. No official or employee, whether paid or unpaid, shall engage in any business or transaction or shall act in regard to financial or other personal interest, direct or indirect, which is incompatible with the proper discharge of his or her official duties in the public interest contrary to the provisions of this section or would tend to impair his or her independence of judgment or action in the performance of his or her official duties.
(b) 
Definitions.
ANYTHING OF VALUE
Any gift, favor, service or promise from any individual, firm or corporation on any one occasion which has a fair market value in excess of $50. The foregoing does not include reasonable fees and honorariums; actual and necessary expenses authorized under W.S.A. s. 19.56; political contributions which are reported under W.S.A. Ch. 11; or the exchange of customary gifts among relatives.

FINANCIAL INTEREST
Any interest which shall yield, directly or indirectly, a monetary or other material benefit to the officer or employee or to any person employing or retaining the services of the officer or employee.
PERSONAL INTEREST
Any interest arising from blood or marriage relationships or from close business or political associations, whether or not any financial interest is involved.
PERSON
Any person, corporation, partnership or joint venture.
(c) 
Specific conflict enumerated.
1. 
Incompatible employment. No official or employee shall engage in or accept private employment or render service, for private interests, when such employment or service is incompatible with the proper discharge of his or her official duties or would tend to impair his or her independence of judgment or action in the performance of his or her official duties, unless otherwise permitted by law and unless disclosure is made as hereinafter provided.
2. 
Disclosure of confidential information. No official or employee shall, without proper legal authorization, disclose confidential information concerning the property, government or affairs of the City, nor shall be or she use such information to advance the financial or other private interest of himself or herself or others.
3. 
Gifts and favors. No official or employee shall accept any valuable gift, whether in the form of service, loan, thing or promise, from any person, firm or corporation which, to his or her knowledge, is interested, directly or indirectly, in any manner whatsoever in business dealings with the City; nor shall any such official or employee accept any gift, favor or thing of value that may tend to influence him or her in the discharge of his or her duties or grant in the discharge of his or her duties any improper favor, service or thing of value. Gifts received under unusual circumstances should be referred to the Ethics Board within 10 days for recommended disposition.
4. 
Representing private interests before City agencies or courts. No officer or employee shall appear on behalf of any private person other than himself or herself, his or her spouse or minor children before any City agency. However, a member of the Council may appear before City agencies on behalf of his or her constituents in the course of his or her duties as a representative of the electorate or in the performance of public or civic obligations.
(d) 
Contracts with the City. No City officer or employee who, in his or her capacity as such officer or employee, participates in the making of a contract in which he or she has a private pecuniary interest, direct or indirect, or performs in regard to that contract some function requiring the exercise of discretion on his or her part shall enter into any contract with the City unless, within the confines of W.S.A. s. 946.13, the contract is awarded through a process of public notice and competitive bidding.

(e) 
Disclosure of interest in legislation. Any member of the Council who has a financial interest or personal interest in any proposed legislation before the Council shall disclose on the records of the Council the nature and extent of such interest. Any other official or employee who has a financial or personal interest in any proposed legislative action of the Council and who participates in discussion with or gives an official opinion or recommendation to the Council shall hereby disclose on the record of the Council the nature and extent of such interest.

(6) 
Disclosure of certain financial interests.

(a) 
In addition to the financial disclosure required by Subsection (5)(e) above, the Mayor, Alderperson, Clerk-Treasurer, City Attorney, Police Chief, Fire Chief, Assessor, Building Inspector, Director of Public Works, City Health Officer, City Forester, City Weed Commissioner, Director of Park and Recreation, Manager of Shawano Municipal Utilities and members of the Plan Commission, Board of Appeals, Police and Fire Commission, Park and Recreation Commission, Shawano Municipal Utilities Commission, Board of Review, Senior Citizens Commission, Industrial and Economic Development Commission, Business Improvement District Board, Shawano Housing Authority Board and City representatives of the City-County Airport Commission and City-County Library Board and such other officers and employees designated by the Council shall file an initial statement of economic interest within a time period specified by the Council.

(b) 
Within seven days after a person becomes a candidate for an elective City office enumerated in Subsection (6)(a) above, or prior to appointment to such office, such person shall file two statements of economic interests with the Clerk-Treasurer. The Clerk-Treasurer is instructed to withhold from the ballot the name of any candidate who has not complied with this subsection.
(c) 
No person required to file a statement of economic interests under this section who has not complied with Subsection (6)(b) above shall take the oath of office or receive his or her salary or compensation until he or she files such statements of economic interests.
(d) 
Each person required to file statements under Subsection (6)(a) above, except for elected officials for the year elected, shall file updated statements no later than November 30 of each year.

(e) 
Elected officers and officers appointed for a definite term shall be exempt from the provisions of this section for the terms they are serving at the effective date of this section, but shall be so subject to any subsequent term.
(7) 
Form of statement. The person filing any statement of economic interests under this section shall file the statement on a form prescribed by the Clerk-Treasurer and shall supply the following information to the Clerk-Treasurer:

(a) 
The name and address of the person, spouse and minor children and all names they use in business or any professional practice.
(b) 
The names of all corporations and other business interests in which the person, spouse or minor children hold any office or directorship or own or control, directly or indirectly, more than 2% of the outstanding stock or more than 2% of other business ownership.
(c) 
The names of the employers of the person and spouse and a brief statement of the nature of the employment.
(d) 
A description of all parcels of real estate within the City and adjoining towns in which the person, spouse or minor children own any interest, including an option to purchase.
(e) 
The names of all persons to whom the person filing, spouse or minor children owe a debt of $3,000 or more, excluding debts on a personal residence and property used primarily for personal recreation.
(f) 
Any license or permit issued by the City to the person, spouse or minor children.
(8) 
Campaign contributions. Campaign contributions shall be reported by all candidates for City office in strict conformity with the provisions of the Wisconsin statutes. Any campaign contribution tendered to or accepted by a candidate subsequent to the final statutory report shall be reported to the Clerk-Treasurer.

(10) 
Applicability of code. When an official or employee has doubt as to the applicability of a provision of this code to a particular situation or definition of terms used in the code, he or she should apply to the City Attorney for an advisory opinion and will be guided by that opinion, when given. The official or employee shall have the opportunity to present his or her interpretation of the facts at issue and of the applicable provisions of the code before such advisory decision is made. This code shall be operative in all instances covered by its provisions except when superseded by an applicable statutory provision and statutory action is mandatory.

(11) 
Penalty and sanctions. Violation of any provision of this section may constitute a cause for suspension, removal from office or employment, or other disciplinary action.

(1) 
No appointing authority or department head shall appoint or employ members of his or her family nor shall a supervisor supervise any member of his or her family. This section shall not apply to part-time employees, part-time positions or persons hired for seasonal employment.

(2) 
No collective bargaining agreement shall be entered into by the City if said agreement violates the intent of this section.
(3) 
The term "family," for purposes of this section, includes husband, wife, father, mother, son, daughter, brother, sister, father-in-law, mother-in-law, son-in-law, daughter-in-law, brother-in-law and sister-in-law.
(4) 
This section shall only apply to persons employed after February 21, 1991. This section shall not prevent or be used to prohibit a person from holding an elective office and shall not prohibit employment based on marital status, except that an individual shall be prohibited from directly supervising or being directly supervised by his or her spouse.
