[HISTORY: Adopted by the Mayor and Council of the Town of Smithsburg 2-3-2004 as Ch. 3 of the 2004 Code. Amendments noted where applicable.]
Pursuant to Title 5, Subtitle 2, § 5-201 et seq., of the Local Government Article of the Annotated Code of Maryland, and other applicable Maryland law, the Mayor and Council of Smithsburg hereby adopts the County Animal Control Ordinance, as amended, revised and supplemented from time to time, subject, however, to the provisions of § 130-3 of this chapter.

The Board of County Commissioners of Washington County, Maryland, its Animal Control Authority, and its Animal Control Officers/Inspectors, Engineering Department and, if applicable, other appropriate and designated agencies thereof shall administer and enforce the provisions of the County Animal Control Ordinance, as amended, revised and supplemented from time to time, within the corporate limits of the Town, subject, however, to the provisions of § 130-3 of this chapter.
Insofar as the County Animal Control Ordinance is enforced in the corporate limits of the Town, Subsection (c) of Section 6, Article II, of the County Animal Control Ordinance is amended to read as follows:
6(c) The Authority shall conduct a hearing when a Person who has been served with a Citation or Complaint charging a violation of the provisions of this Ordinance files a written request for a hearing before the Authority within 15 days after receipt of that Citation or Complaint. Instructions for requesting a hearing before the Authority shall be printed, attached to, or served with all form Citations or Complaints.
