The following charges will be made for natural gas services:
A. 
There shall be a cost of service availability charge of $7 per month for meters less than one inch, and $48.25 per month for meters one inch or larger. The cost of service availability charge shall be in addition to and shall not include any charge for actual usage of natural gas.

B. 
The charge for usage of natural gas shall be in units of 100 cubic feet (CCF).
C. 
Residential and nonresidential users. The cost of the first unit and every unit (CCF) thereafter, up to 430,000 units per fiscal year (July 1 to June 30), shall be at the City's cost of gas plus $0.3952. Any nonresidential customer whose usage exceeds 430,000 units per year (43,000 MCF per year) may be billed at a rate that is to be determined through negotiations with the City Administration. All negotiated rates are to be adopted by the Socorro City Council through resolution.

D. 
Any customer expected to use in excess of 50,000 units per month shall be subject to partial or complete interruption of service during the City's peak demand, the specifics of which are to be determined through negotiations and adopted by City Council resolution.
E. 
The charges set forth for usage of natural gas are based upon a current cost to the City of Socorro from its supplier plus a fixed markup cost. Future charges in the purchase price to the City from the City's supplier shall be directly passed on to the consumer. The charge implemented for the use of natural gas is intended to be a "cost plus" method.
F. 
An annual inflationary increase of $2 per base charge will be enacted by the City Council with adoption of the annual budget resolution. This increase will continue for five years or until rescinded by the City Council, whichever occurs first.

The following charges shall be made for water service:

Water Department customer classification by meter size will be effective for all types of service (e.g., residential, multiple-family residential, commercial, multiple commercial, industrial, institutional).

The following charges shall be made for sewer service:
A. 
Service connection charges. The fees for connection of individual buildings to the municipal sewer shall be as follows:

(1) 
Additional charges in an amount equal to the City's cost will be applied in situations where dewatering or manhole installation is required to provide a service connection and in accordance with the Sewer Use Ordinance of the City of Socorro.
(2) 
The fees for connection to the municipal sewer include permit, inspection, connection and pavement repairs. No person shall connect with or tap into the municipal sewer system without the written consent of the Wastewater Superintendent and in accordance with the Sewer Use Ordinance of the City of Socorro.
(3) 
Separate and independent sewer connections must be provided to every building in accordance with the Sewer Use Ordinance of the City of Socorro. No two (or more) buildings shall share the same sewer service line.
B. 
Wastewater system expansion (WWSE) fee. A charge (impact fee) as per the following schedule and in accordance with the Sewer Use Ordinance shall be paid to the City when any building, structure, premises or development is connected to the municipal sewer system:

(1) 
Developers and builders will pay the WWSE fee at the time of payment of the utility connection fee. Subdivision developers will pay a fee for every lot in the subdivision in accordance with the fee schedule above and as determined by the Wastewater Superintendent.
(2) 
Individual lot owners who intend to use the property for their own use may pay the WWSE fee in one lump sum or, at their option, pay the WWSE fee in six equal payments. This fixed monthly charge shall be in addition to the monthly utility charges and the optional financing shall be the responsibility of any subsequent owner of that property until the appropriate WWSE fee is paid in full.
(3) 
All connections to City-provided services for water, wherein the water is dedicated only to landscaping needs or other such activities, wherein the water is not returned to the municipal sewer system, shall be exempt from the fee imposed above.
C. 
Basis for usage charge. The charge for usage of the sewer system shall be based upon water usage in units of 100 gallons.
D. 
Billing procedures and delinquent accounts. Billing procedures and delinquent accounts shall be handled in a manner consistent with the City's overall policies and procedures for the Utility Department.
E. 
Winter water average.
(1) 
For all residential users whose summer usage of water includes lawn and landscape watering, the sewer usage charge shall be based upon the average monthly water consumption by the user during the three winter months (December, January, and February). Winter water averages shall be calculated automatically for each residential customer on a yearly basis.
(2) 
Commercial, industrial and tax-exempt users whose summer usage of water includes lawn and landscape watering shall request from the Wastewater Superintendent to have their sewer usage charges be based upon the winter water average. The Wastewater Superintendent will accept or deny the user's request based on site inspections and available consumption history.
(3) 
For commercial or industrial users whose business depends upon the use of water as a finished product (ice plant, water bottlers, etc.), the sewer service charge shall be determined by the Wastewater Superintendent based on actual measurements of the liquid waste discharge and in accordance with the Sewer Use Ordinance of the City of Socorro.
(4) 
The charge for usage of the sewer system shall be based upon actual water consumption by the user for all users not included above.
(5) 
In circumstances when users entitled to sewer usage charges based upon an average monthly water consumption rate, who have not established a consumption rate, the charge for usage of the sewer system shall be based upon actual water consumption by such user until such time as an average for the winter months is established by the user.
(6) 
Any customer subject to winter water averaging whose monthly water usage falls below the established winter water average will be billed based on actual water usage for that month.
F. 
User's classification.
(1) 
The Wastewater Superintendent shall classify users according to the Sewer Use Ordinance of the City of Socorro and according to the type of sewer effluent produced by such user. Any user producing effluent creating special sewage treatment problems (e.g., petroleum products, animal or vegetable grease, toxic wastes, concentration of heavy metals and the like) shall be classified as an industrial user in accordance with the Sewer Use Ordinance of the City of Socorro.
(2) 
Additionally, the Wastewater Superintendent may require any user of the sewer system to adopt procedures for pretreatment of sewer effluent if such user exceeds the design capability of the City sewage treatment facility, constitutes a danger to the public health, or where such effluent is not permitted by law or regulating agency of the State of New Mexico or of the United States.
G. 
Appeals. Any decision by the Wastewater Superintendent with respect to user classification, sewer use charges, pretreatment requirement, or denial of access to the sewer system may be appealed to the City Council by filing a notice of appeal of decision with the City Clerk. The decision of the Wastewater Superintendent is not stayed during the pendency of such an appeal; the user shall pay the charges, if any, according to the decision of the Wastewater Superintendent during the pendency of such appeal, and, if the decision of the Wastewater Superintendent is reversed, adjustment shall be made upon the next succeeding statement of charges.
H. 
The following classification will be determined by the water meter size effective for all types of service as described in § 238-2B above (e.g., residential, multiple-family residential, commercial, multiple commercial, industrial, institutional).
