A. 
Except as otherwise permitted by the Maryland Vehicle Law,[1] no person shall operate upon any of the streets of the Town any vehicle so constructed or equipped as to cause any unusual damage to such streets. No wagon, traction engine or other vehicle having metal tires, movable tracks or treads shall be operated over or upon any such streets having upon the wheels any clamp, spikes, ribs or other devices which may cut into or injure the road surface of said streets without having obtained a special permit from the Town. Nor shall any wagon or other vehicle of any kind be operated with a rough lock or similar device on one or more of the wheels thereof in such manner as to cut into or injure the surface of any streets.

B. 
Any person violating the provisions of this section shall, upon conviction thereof, be subject to the same penalties specified in § 27-101 (Fines and penalties for motor vehicle violations) of the Transportation Article of the Annotated Code of Maryland for a violation of § 22-405.2 (Metal tires or tires with protuberance of material) of the Transportation Article of the Annotated Code of Maryland.
A. 
No vehicle having a gross weight exceeding 20,000 pounds or 10 tons shall be operated on the public streets of the Town.
B. 
Any person violating the provisions of this section shall, upon conviction thereof, be subject to the same penalties established in Title 27 of the Transportation Article of the Annotated Code of Maryland for a violation of the vehicle weight restrictions contained within the Maryland Vehicle Law.
A. 
No motor vehicle shall be operated upon any street, lane, alley or highway of the Town at a rate of speed exceeding 30 miles per hour.
B. 
No motor vehicle shall be operated upon any street, lane, alley or highway in the Town within the limits of the school zone at a speed greater than 20 miles per hour.
C. 
Any person violating the provisions of this section shall, upon conviction thereof, be subject to the same penalties established in § 27-101 (Fines and penalties for motor vehicle violations) of the Transportation Article of the Annotated Code of Maryland for a violation of the speed restrictions contained with the Maryland Vehicle Law.

A. 
The Town of Smithsburg, pursuant to § 21-803.1(a)(2)(ii) of the Transportation Article of the Annotated Code of Maryland, may establish school zones for the purpose of regulating maximum speed limits in such areas.
B. 
The Town of Smithsburg does hereby designate the following school zones within the Town:
(1) 
North Main Street, within 200 yards of Smithsburg Elementary (67 North Main Street), and Smithsburg Senior High School (66 North Main Street), 200 yards each direction. The school zone will have a boundary on the east by East School Lane and West School Lane, as well as on the west by Geiser Way and Grove Creek Circle.
C. 
All distances which name schools would be measured from the property line of the school property.
D. 
All distances involving streets would be measured from the center line of the street.
E. 
To the extent that the State Highway Administration/Washington County Roads and the Town of Smithsburg, Maryland, have already established school zones or establish them in the future with respect to the above-mentioned schools which are different from those designated above, such State Highway Administration/Washington County Roads and Town designations shall control.[1]

F. 
Appropriate signage designating the school zones shall be erected pursuant to the Transportation Article of the Annotated Code of Maryland and the guidelines for school zones as established by the State Highway Administration.

A. 
The Town is authorized to operate an automated speed monitoring system to enforce the speed limit in conformance with § 21-809 of the Transportation Article of the Annotated Code of Maryland, as amended.
B. 
Before activating an unmanned stationary speed monitoring system, the Town shall:
(1) 
Publish notice of the location of the speed monitoring system on its website and in a newspaper of general circulation in the Town.
(2) 
Ensure that each sign that designates a school zone indicates that a speed monitoring system is in use in the school zone.
C. 
A speed monitoring system in a school zone may operate only Monday through Friday between 6:00 a.m. and 8:00 p.m.

D. 
For a period of at least 30 days after the first speed monitoring system is placed in the Town, a violation recorded by any speed monitoring system may be enforced only by issuance of a warning.
E. 
The Town Council is hereby authorized to designate school speed enforcement zones consistent with this section by resolution.
F. 
Failure to pay an automated speed enforcement citation by the due date, or failure to elect to stand trial as stated on the citation, shall result in a late fee of $40.
G. 
Any person who pays any penalty assessed under this section shall further pay a returned check fee of $35 to the Town should the check be returned unpaid by the payor's bank.
H. 
The Town shall, in accordance with the procedures prescribed by the State Motor Vehicle Administration (MVA) and state law, give or cause to be given notice to the MVA of all vehicles registered by the state and the subject of any outstanding and past due automated speed enforcement citations and request that the MVA refuse registration or transfer of registration of the subject vehicle until notified by the Town that the violation penalty has been satisfied. In such cases, the Town shall impose an additional cost of $45 for each registration withheld, and the owner of the vehicle shall be subject to payment of such costs and all other fines, penalties, fees and charges applicable before notice is given to the MVA that the subject citation has been satisfied and the registration is released.
A. 
The Mayor and Council is hereby authorized to place stop signs or signals at street intersections or corners where, in its judgment, the same are necessary, thus establishing boulevards or through streets.
B. 
The Mayor and Council is also authorized to station police, or any other person authorized by it, and to erect traffic signaling devices upon such portions of the streets, highways and alleys as it shall deem proper for the purpose of directing and facilitating the operation of traffic.
