The establishment of a Police Department in and for the Borough of Port Vue and the appointment of policemen by the Borough Council, subject to any applicable civil service provisions in the law, is hereby approved.
The Police Department shall be composed of a Chief of Police and any other officers and patrolmen as have been or may be appointed by the Borough Council from time to time, subject to applicable civil service provisions in the law.

A. 
The Chief of Police, in conjunction with the Mayor, shall control, plan and direct the Police Department personnel. The Mayor, however, shall have the right to schedule Police Department work on a daily basis.
B. 
The Chief of Police shall have the following duties and responsibilities:
(1) 
The Chief, in conjunction with the Mayor, shall be responsible for Police Department personnel and equipment.
(2) 
The Chief shall maintain control and use of all Police Department equipment distributed to Police Department personnel.
(3) 
The Chief, in conjunction with the Mayor, shall be responsible for the harmonious relationships with other police agencies and cooperate with them for the good of the community.
(4) 
The Chief shall have primary responsibility for the observance of high ethical standards in the operation of the Police Department activities and of the conduct of Police Department personnel. The Chief shall issue periodic reports to the Mayor, at such times and intervals as deemed necessary by either the Chief or the Mayor, relative to the operation of Police Department activities and the conduct of Police Department personnel.
(5) 
The Chief shall regularly inspect Police Department personnel, equipment and records to insure efficiency and effectiveness of operation, quality of supervision and conformity with regulations and orders. The Chief shall issue periodic reports to the Mayor, at such times and intervals as deemed necessary by either the Chief or the Mayor, relative to the Chief's inspections.
(6) 
The Chief shall set an example for all Police Department personnel in sobriety, deportment, dignity, courtesy, discretion, skill, diligence, neatness and observance of proper discipline.
(7) 
The Chief shall exercise authority consistent with the obligations imposed by his oath of office.
(8) 
The Chief shall report to the Mayor and to the President of Council on matters pertaining to police operations and personnel.
(9) 
The Chief shall be responsible for training the Police Department personnel in accordance with the mandatory training requirements established by state law.
(10) 
The Chief shall be responsible for reviewing complaints against Police Department personnel which are filed pursuant to the complaint procedure established in the police contract.
(11) 
The Chief alone, among Police Department personnel, shall be responsible for news media releases.
(12) 
The Chief shall be responsible for maintaining effective employee relations within the Police Department.
(13) 
The Chief shall be responsible to see that internal discipline complaints are properly adjudicated in accordance with the rules and regulations established by contract, as amended by Council, until such complaint is resolved or no longer within Borough Council's jurisdiction.
(14) 
The Chief shall have direct supervision of all Police Department records, including all personnel records, subject to the Mayor's right of inspecting same as established and defined by statutory and case law.
(15) 
The Chief shall recommend to the Mayor and Council the type of firearms to be carried and ammunition to be used by Police Department personnel. The Chief, subject to review by Council, shall establish the course of training for Police Department personnel in accordance with state directives or guidelines.
(16) 
The Chief shall be responsible for the policies and procedures regarding the use of all police communication equipment.
(17) 
The Chief and Mayor shall be responsible for the day-to-day operations of the Police Department and its personnel. Both the Chief and the Mayor shall be responsible to keep the President of Council and the Police Committee informed of any problems in the Borough which, in either the Chief's or Mayor's judgment, should be brought before either Council or the Police Committee, including news media releases.
(18) 
The Chief, in conjunction with the Mayor, shall establish standard operating procedures that Department Personnel shall follow in their daily operations.
C. 
All ordinances or parts of ordinances which are inconsistent herewith are repealed.

A. 
The position and rank of Sergeant shall be a first line supervisor under the general direction of superior officers, namely the Lieutenant Chief of Police and the Mayor.
B. 
The Sergeant shall supervise field and station activities of any assigned subordinate officers and patrolmen.
C. 
The Sergeant shall inspect and train subordinates to ensure conformance with departmental standards and policies and initiates disciplinary action when necessary to exact compliance to those standards.
D. 
The appointment of any individual to the position of Sergeant shall be made by the Council of the Borough of Port Vue, subject to civil service requirements.
