It shall be unlawful for the owner, custodian or keeper of any dog or cat to permit such dog or cat to run at large at any time on any property, either public or private, within the Borough of Port Vue, excluding, however, the private property of the owner, custodian or keeper of such dog or cat in accordance with prior regulations contained within this chapter.
A. 
Any police officer or animal control officer may seize any dog, cat or other animal found at large in the Borough in violation of § 109-6 above. Such dogs, cats or animals shall be impounded in a facility provided by the Borough.
B. 
Owners, custodians or keepers of licensed dogs and cats are to be notified by certified mail or registered mail, return receipt requested, that their dog or cat is impounded and will be disposed of within five days of receipt of the return receipt card if not claimed. Five days following receipt of the return receipt card indicating delivery and notice to the owner, custodian or keeper of record, the dog or cat may be sold or destroyed in a humane fashion by the Borough or its authorized agents.
C. 
After the impounding of any licensed or otherwise identified animal, the owner, custodian or keeper of record of any such impounded animal may reclaim such animal within the five day claim period upon the payment of all costs and fees incurred by the Borough or its agents for the impounding and maintenance of such animal. The owner, custodian or keeper of record remains liable for any additional penalties established and imposed under § 109-9 below.
A. 
All owners, custodians or keepers of any licensable dog who are residents of the Borough of Port Vue shall, upon issuance of a license from the Allegheny County Treasurer, register such dog with the Borough of Port Vue by providing a true and correct copy of such license to the Borough, which shall contain the breed, sex, age, color and markings of such dog, and the name address and telephone number of the owner, custodian or keeper.
B. 
All owners, custodians or keepers of any cat who are residents of the Borough of Port Vue shall be required to register their cat with the Borough on a form to be provided by the Borough that contains similar information as provided in Subsection A above.
C. 
No single person or household may own, possess or be in control of more than four dogs or cats over the age of six months within the Borough of Port Vue; provided, however, that this section shall not apply to any premises for which a kennel license has been obtained pursuant to the Pennsylvania Dog Law.[1]

D. 
Failure to register one's dog or cat pursuant to this section shall be considered a violation of this article and the respective owner, custodian or keeper shall be subject to the penalties expressed in § 109-9 below.
Any person, firm or corporation who shall violate any provision of this article, upon conviction thereof, will be sentenced to pay a fine of not more than $100, plus costs of prosecution, for a first offense. The penalty for a second offense shall be punishable by a fine not to exceed $300, plus costs. Each subsequent offense shall be punishable by a fine not to exceed $600, plus costs and/or a term of imprisonment not to exceed 60 days.
