As used in this article, the following terms shall have the
meanings indicated:
ABANDONED/JUNKED VEHICLE
A.
A vehicle (other than a pedalcycle) shall be presumed to be
abandoned or junked under any of the following circumstances, but
the presumption is rebuttable by a preponderance of the evidence:
(1)
The vehicle is physically inoperable and is left unattended
on a highway or other public property for more than 48 hours.
(2)
The vehicle has remained illegally on a highway or other public
property for a period of more than 48 hours.
(3)
The vehicle is left unattended or along a highway or other public
property for more than 48 hours and does not bear all of the following:
(a)
A valid registration plate.
(b)
A current certificate of inspection.
(c)
An ascertainable vehicle identification number.
(4)
The vehicle has remained on private property without the consent
of the owner or person in control of the property for more than 48
hours.
B.
Vehicles and equipment used or to be used in construction or
in the operation or maintenance of highways or public utility facilities,
which are left in a manner which does not interfere with the normal
movement of traffic, shall not be considered to be abandoned.
C.
The term "abandoned" shall not apply to any vehicle bearing
a current license plate and/or current inspection sticker until the
Police Department has tagged the vehicle with an orange tag and/or
has, by personal service or by regular mail, given notice to the registered
owner of the vehicle stating that if the vehicle is not removed within
48 hours of the date of the notice, the vehicle shall be deemed to
be abandoned or junked.
It shall be unlawful for any person, firm or corporation to
allow or to permit to remain upon any public or private grounds in
the Borough of Port Vue any accumulation of garbage and/or rubbish,
or an abandoned or junked vehicle, which are hereby declared to be
public nuisances.
