Fountain Hill Volunteer Fire Co., Inc., organized and existing in the Borough of Fountain Hill, Lehigh County, Pennsylvania, is hereby designated and recognized as the official fire protection unit for the Borough of Fountain Hill and its residents. For so long as it is so designated and recognized, it may be called or referred to as the "Fountain Hill Fire Department" or the "Fountain Hill Fire Company."

1. 
In addition to actually fighting fires or while engaged in going to or returning from any fire, the members of the Borough’s official fire protection unit are authorized to do the following activities:
A. 
Answer any type of fire alarm or call, whether general alarm, private call or investigation of fire report or emergency call of any type, inside or outside the Borough.
B. 
Provide nonemergency and public services, such as removing water from property after storms and assisting in the removal, abatement and prevention of damage or injury to persons or property, whether through natural causes or man-made situations.
C. 
Engage in any type of drill, training, ceremony, practice test or parade when duly called or authorized by a proper officer or officers of the official fire protection unit of the Borough.
D. 
Provide to the Borough an annual, itemized listing of all expenditures of funds received from the Borough before the Borough may consider budgeting additional funding for the official fire protection unit.
E. 
Provide to the Borough an annual itemized listing of all Borough assets, such as fire apparatus and equipment, which are in its the possession or control.

All fire apparatus and equipment, whether purchased for, or donated or provided to, the Borough’s official fire protection unit, shall constitute assets of the Borough and remain solely owned by the Borough unless and until the Borough transfers title to any such fire apparatus or equipment to the official fire protection unit or a third party. The Borough’s official fire protection unit may not sell, transfer, or otherwise dispose of any assets of the Borough. In the event that any assets of the Borough need to be repaired or replaced, the official fire protection unit shall notify the Borough Manager. The Borough’s official fire protection unit may, at any time, purchase, using its own funds, fire apparatus and equipment for its own use, and such apparatus and equipment will be solely owned by the official fire protection unit.
