[CC 1985 §62.010]
In conformance with Section 88.703, RSMo., the Public Works
Director shall report to the Board of Aldermen from time to time concerning
any street, curbing, guttering, sidewalk or part thereof that shall
be in need of repair.

If the Board of Aldermen shall determine that it is necessary
for public health, welfare or safety that such repair be made, the
Board of Aldermen shall notify the owner or owners of all abutting
property, in writing, of the necessity of such repairs and the nature
of the repairs required to be made.

The owner or owners of the abutting property shall have thirty
(30) days to complete the repairs as specified or to enter into an
agreement with the City of Canton, Missouri, through the Public Works
Director to have the City of Canton, Missouri, complete the repairs.

If the owner or owners of the abutting property shall, within
said thirty (30) days, fail to complete the repairs as specified or
to enter into an agreement with the City of Canton, Missouri, the
Public Works Director shall cause the repairs to be made and upon
completion of such repairs report the same to the Board of Aldermen
for assessment.

The Board of Aldermen shall assess the costs of such repair
to each lot or piece of ground abutting on such street, curbing, guttering,
sidewalk or part thereof along the distance repaired in proportion
to the front footage of said lot or piece of ground abutting the repair.

All such special assessments shall be levied against the abutting
lot or piece of ground by special tax bill; such special tax bill
shall constitute a lien upon such abutting property until paid and
shall bear interest at the rate of eight percent (8%) per annum until
paid.
