A. A. For
the purpose of the protection of the public health, safety and welfare
with respect to establishing minimum standards for buildings used
for dwelling purposes, there is hereby adopted the BOCA National Property
Maintenance Code, 1996 Edition, as recommended by the Building Officials
Conference of America. One (1) copy of the Property Maintenance Code
adopted in this Section shall be on file in the office of the City
Clerk of the City for public inspection.
B. Penalty. Any person violating any of the provisions of the
Code adopted in this Section shall be deemed guilty of an ordinance
violation and upon conviction thereof shall be fined in an amount
not exceeding five hundred dollars ($500.00) or be imprisoned in the
City or County Jail for a period of not exceeding ninety (90) days,
or both such fine and imprisonment. Each day such violation is committed
or permitted to continue shall constitute a separate offense and shall
be punishable as such hereunder.

A. Adoption Of The Fire Code. A certain document, one (1) copy of which is on file in the office of the City Engineer of the City of Union, being marked and designated as the International Fire Code 2009 Edition, as published by the International Code Council Inc., be it hereby adopted as the Fire Code of the City of Union, Missouri, for the control of building and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said Building Code are hereby referred to, adopted and made a part hereof, as if fully set out in this Section, with the additions, insertions, deletions and changes, if any, prescribed in Subsection
(B) of this Section.

F-103.2.2 Inspections Authorized: Delete in its entirety.
F-105.1.2 Type of Permits: Delete
#1. Operational Permits.
F-105.1.3 Permits for the same location: Delete in its entirety.
F-105.3.1 Expiration: Change
180 days to 365 days.
F-105.6 Thru F-105.46 Required Operational Permits: Delete in its entirety.
F-108.1 Board of Appeals: The Board of Appeals shall consist of the Board of Adjustment as prescribed in Article
II, Sections
400.050 through
400.130 of the Municipal Code of the City of Union.
F-109.3 Violation Penalties: Any

F-111.4 Stop Work Orders: Upon
notice from the Code Official, any work that is being done contrary
to the provisions of this code or in a dangerous or unsafe manner
shall immediately cease. Such notice shall be in writing and shall
be given to the owner of the property, or to the owner's agent, or
to the person doing the work. The notice shall state the conditions
under which work is authorized to resume. Where an emergency exists,
the Code Official shall not be required to give a written notice prior
to stopping the work. Any person who shall continue any work in or
about the structure after having been served with a stop work order,
except such work as the person is directed to perform to remove a
violation or unsafe condition, shall be guilty of an ordinance violation
punishable by a fine of not more than five hundred dollars ($500.00).
F-307.1 Thru F-307.5 Open Burning: Delete in its entirety. Add the following: Open burning shall be
conducted in accordance with 10CSR10-6.045.
F-309.7 Forklifts: Add new Section:
Forklifts powered by a liquid fuel or LP gas are not allowed to be
used within a strip center that is occupied by more than one (1) tenant
unless approved by the Code Official.
F-505.1 Address Identification: Change to read as follows: Letters and numbers shall be a minimum
of three (4) inches in height for residential, and six (6) inches
in height for commercial, and a minimum stroke of one-half (½)
inches wide.
F-903.3.8 Inspector's Test Outlet: New Section: An inspector's test outlet, equivalent to the flow
from a single sprinkler of the smallest orifice size installed in
the system, shall be installed on each floor where a water flow alarm
device is required in Section 903.4.2.

Adoption of the Fire Prevention Code as set out in Section
500.080 will therefore join the City with the Union Fire Protection District to allow their inspection of buildings within the City as needed for compliance with the BOCA Codes.

The City does not issue building permits in relation to the
Fire Prevention Code; however, the City does hereby encourage all
its citizenry to comply with all Codes required by the Fire Protection
District.

It shall be the policy of the City to work with the appropriate
Fire Protection District for the purpose of fire prevention.

The City shall not charge the Fire Protection District for any
water usage or cost of maintenance of City-owned fire hydrants in
its duties, excluding domestic water at the various stations, which
shall be charged at the normal rate as provided for by this Code,
and, in return, the Fire Protection District shall not charge the
City for any fire permits that may be needed within the City-owned
buildings or future buildings.
