A. 
The Department of Public Safety shall be headed by the Director of Public Safety who shall combine the administrative offices of the police, fire and emergency medical services and shall be responsible for:
1. 
All of the traditional duties, responsibilities and functions conferred by law, Statute or ordinance upon the Chief of Police, Fire Chief or Director of Emergency Medical Services;
2. 
Promulgation and administration such rules and regulations as are necessary for the operation of the department;
3. 
Keeping the Mayor and Board of Aldermen advised at all times on matters relating to the provision of the public safety services of the City. When requested to do so, to submit reports on the performance of the department;
4. 
Attending all meetings of the Public Safety Department. If the Director is unable to attend any such meeting, he/she shall designate a ranking officer of the department to attend such meeting; and
5. 
Such other powers, duties and responsibilities as shall from time to time be conferred upon the Director by the Mayor and/or Board of Aldermen.
The Mayor with the approval of a majority of the members of the Board of Aldermen shall appoint a Chief of Police who shall perform all duties required of the Marshal by law and any other Police Officers found by the Board of Aldermen to be necessary for the good government of the City. The Chief of Police shall be twenty-one (21) years of age or older.
The Police of the City may be appointed in such numbers, for such times and in such manner as may be prescribed by ordinance. They shall have power to serve and execute all warrants, subpoenas, writs or other process and to make arrests in the same manner as the Marshal. They may exercise such powers in areas leased or owned by the municipality outside of the boundaries of such municipality. The Marshal and Policemen shall be conservators of the peace and shall be active and vigilant in the preservation of good order within the City.

The officers of the City of Rock Hill Police Department who have completed the Basic Police Training Program as promulgated by Chapter 590, RSMo., are authorized to respond to any emergency situation outside the boundaries of the City of Rock Hill, pursuant to Section 70.820, RSMo. The officers responding will be so designated by the Chief of Police and when acting outside of the City of Rock Hill in an emergency situation will be considered as on active duty, the same as they would be when acting on their regular duties within the City of Rock Hill.
As used in this Article, "emergency situation" means any situation in which the Law Enforcement Officer has a reasonable belief that a crime is about to be committed, is being committed, or has been committed involving injury or threat of injury to any person, property, or governmental interest and his/her response is reasonably necessary to prevent or end such emergency situation or mitigate the likelihood of injury involved in such emergency situation. The determination of the existence of any emergency situation shall be in the discretion of the Law Enforcement Officer making the response or in the discretion of a Law Enforcement Officer or governmental officer of the political subdivision in which the emergency situation is alleged to be occurring.

Any City of Rock Hill Police Officer responding to an emergency situation, pursuant to the provisions of this Article, has the same immunities and liabilities as if acting within the jurisdictional boundaries of the City of Rock Hill.
