Junk yard is defined as any premises wherein the owner or any occupant thereof operates a business involving the purchase, sale, accumulation or storage of remnants of materials or by-products of small value that do not have the quality of finished products or raw materials. Such remnants of materials or by-products shall include but be not limited to any of the following substances; ashes, scrap metal; components or parts of machinery, automobiles, or any other motor vehicles; construction debris; used structural steel; used lumber; or rubbish. Junk yard and salvage yard shall be the same for the purpose of this Section.

Any junk yard operated in the City of Herculaneum, Missouri, shall be completely enclosed by a solid fence, the top of which shall be at least ten (10) feet in height on all its sides. All commodities as described in Section 640.010 hereof shall be contained within the area enclosed by said fence. The area so enclosed by said fence shall be kept free from filth, tall weeds, excrement, or any other substance which constitutes a nuisance under any Ordinance or Statute of this City or of the State of Missouri. The burning of any of the articles described herein in Section 640.010, is hereby prohibited. If any junk yard exists at the time this Chapter is passed and approved and which is not completely enclosed by a fence meeting the requirements of this Chapter, the operator of such junk yard shall have ninety (90) days in which to erect such fence.

The operator of any junk yard within the City of Herculaneum is required to obtain a license from the City Clerk. The fee for such license shall be one thousand dollars ($1,000.00) and shall be payable at the time application for license is filed. The license herein provided for shall not be issued until the fencing requirement provided for in Section 640.020 hereof has been complied with.

There shall be no more than two (2) junk yards within the City of Herculaneum at any given time and the City Clerk is prohibited from issuing more than two (2) concurrent licenses to junk yards as defined herein.

The City of Herculaneum or its authorized agents shall be entitled to enter upon such junk yard at all reasonable times to inspect the operation thereof.

The violation of any of the provisions of this Chapter shall, upon conviction, be a misdemeanor and punishable by a fine of not more than five hundred dollars ($500.00). Each day after a violation is cited, will constitute a new violation and may be punishable by fine of up to one hundred dollars ($100.00) per day.
