The Police Pension Fund, as created by Section 335 of Chapter 755 of the Laws of 1907, as last amended, and the Fire Pension Fund, as created by Section 336 of Chapter 755 of the Laws of 1907, as last amended, are hereby continued.

Any person who shall have been appointed to membership in the police or fire service of the City of Rochester prior to September 1, 1932, and who shall have retired from such service after at least 15 years' active duty or who in the scope of his or her employment shall have been permanently disabled so as to be unfit to perform such service or who in the scope of his or her employment shall have been killed, or his or her surviving spouse if such person is deceased, shall be a member of the pension system set forth in this article.

All eligible members of this pension system shall be paid at intervals determined by the Director of Human Resource Management from the Police Pension Fund or the Fire Pension Fund, as may be applicable, a pension in an annual amount not to exceed the amount set forth next to the name of each eligible member on Appendix A attached hereto and made a part hereof[1] unless otherwise provided herein. These amounts may be adjusted from time to time as required by validly enacted and signed state legislation and/or validly enacted legislation of the City Council. In no event shall these amounts be less than $4,200 per annum during the fiscal year ending June 30, 1978, or $4,400 per annum during the fiscal year ending June 30, 1979, or $4,600 per annum during the fiscal year ending June 30, 1980, or $4,800 per annum during the fiscal year ending June 30, 1981, or $5,000 per annum during the fiscal year ending June 30, 1982, or $5,000 per annum thereafter; $2,500 per annum for the surviving spouse of an eligible member.

Payment of a pension to a former member of such service shall terminate upon his or her death, and payment to a surviving spouse shall terminate upon her remarriage or death.

The Director of Human Resource Management shall have the authority and responsibility for administering the provisions of this article.
