A certain document, a copy of which is on file in the office of the Code Enforcement Officer of Perkiomen Township, being marked and designated as "The International Property Maintenance Code, 2012 Edition," as published by the International Code Council, including Appendix A, be and is hereby adopted as the Property Maintenance Code of Perkiomen Township for regulating and governing the conditions and maintenance of all property, buildings and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use; and the demolition of such existing structures as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Property Maintenance Code on file in the office of Perkiomen Township are hereby referred to, adopted and made a part hereof as if fully set out in this article, with the additions, insertions, deletions and changes set forth below in §
219-2 of this article.
The following sections of the Code are hereby modified:
A. Section
101.1. Insert: "Perkiomen Township."
B. Section
102.3. Add: "Pennsylvania Uniform Construction Code, Act 45
of 1999." Delete reference to International Zoning Code and replace
with "Perkiomen Township Zoning Ordinance."
C. Section
103.3. Delete this section in its entirety.
D. Section
103.5. Change to: "As indicated in the applicable/current fee
schedule as adopted from time to time by resolution of the Board of
Supervisors of Perkiomen Township."
E. Section
106.3. Replace "civil infraction" with "nontraffic summary
citation."
F. Section
302.2. This provision is deleted in its entirety.
G. Section
302.3. At the end of this section, add the following: "Any
tree, branch, limb, leaves, bush, hedge or other plant life that encroaches
upon any sidewalk or Township right-of-way shall be trimmed, cut,
cut back, cleared or otherwise maintained by the property owner so
as to allow free and unobstructed passage by pedestrians lawfully
thereon. Said trimming shall be for the full width of the sidewalk
and/or right-of-way and shall be for a height of 80 inches."
H. Section
302.4. Delete this provision in its entirety.
I. Section
302.8. Delete the word "unlicensed" and replace with "not validly
registered" and delete the word "premises" and replace with the words
"public way."
J. Section
304.1.1.

Change "International Building Code" and "International Existing
Building Code" to "Pennsylvania Uniform Construction Code (PAUCC)."

Add Subsection 14, which will provide that "roof drains, yard
drains and sump pumps shall not be discharged so as to create any
public or private water, icing or other safety hazard."

K. Section
304.7. Delete last sentence.
L. Section
304.14. Add the dates "April 1 through October 31." Delete
the word "door" in line 2, and add "the provisions of this section
shall apply only to rental properties."
M. Section
304.20. Add section:

Tarps, Canvas, Plastic or Products of Similar Nature
Tarps, canvas, plastic or products of similar nature used to
repair or protect the premises from the effects of nature shall only
be used as a temporary fix and shall not be used permanently. The
maximum time frame that these products may be used for a temporary
fix is 90 days. Within this time frame, the premises shall be repaired
with products approved for such covering(s) on the exterior of the
premises.

N. Section
401.1. At the end of this section, add the following: "The
provisions of this section shall not apply to buildings or structures
that were built before the enactment of this ordinance and which were
constructed in accordance with the Building Code in place at the time
of construction."
O. Section
502.5. At the end of this section, add the following: "The
provisions of this section do not apply to Township- or County-owned
property or facilities."
P. Section
507.1. Delete the words "public nuisance" and replace with
the words "public or private safety hazard."
Q. Section
602.3. Insert dates: "September 15 through May 15."
R. Section
602.4. Insert dates: "September 15 through May 15."
S. Section
704.2. Add new subsection (4), which reads as follows: "(4)
Any smoke detector that is not functioning as designed or was manufactured
more than 10 years ago must be replaced with a new smoke detector
that uses power source(s) equal to or greater than the one being replaced."
Appendix A is hereby amended as follows:
A. A101.1. This provision is deleted in its entirety and is replaced with the
following: "All windows and doors shall be boarded in an approved
manner to prevent entry by unauthorized persons, and if the structure
remains in a boarded condition for more than 60 days, shall be painted
to correspond to the color of the existing structure."
B. A102. This section is deleted in its entirety.
Any and all ordinances that conflict herewith are repealed.
Nothing in this article hereby adopted shall be construed to affect any lawsuit or proceeding impending in any court or any rights acquired or liability incurred or any cause or causes of action acquired or existing under any act or ordinance hereby repealed as cited in §
219-2 of this article, nor shall any just or legal right or remedy of any character be lost, impaired or affected by this article.
By December 31 of the year of the issuance of a new triennial
ICC International Property Maintenance Code, or its successor property
maintenance code, the new International Property Maintenance Code,
or its successor property maintenance code, shall be automatically
adopted as the Perkiomen Township Property Maintenance Code, including
appendixes as determined by the Pennsylvania Department of Labor and
Industry.
