When a public sewerage disposal system is not available, the
applicant for either subdivision approval or a building permit for
a previously existing lot or one not required by law to be approved
by the Approving Board shall conform to the requirements of the latest
revision of Standards for Individual Subsurface Sewerage Disposal
Systems, N.J.A.C. 7:9A-1 et seq., for each lot (including the remaining
lands, provided that the same do not exceed 10 acres) in the approximate
location where the proposed septic disposal bed will be located. This
conformance shall be the minimum required, and more stringent requirements
may be imposed if the Approving Board, the Township Engineer or the
Board of Health deem such are needed.
No proposed lot shall be approved for subdivision nor shall
any building permit be issued therefor unless and until there is compliance
with the requirements and standards of this Article or other applicable
ordinances or with the standards for the construction of sewerage
facilities for realty improvements adopted by the state agency having
jurisdiction of such matters.
Neither shall any subdivision nor part thereof be approved,
nor shall any building permit be issued, where other physical characteristics
of the land would cause septic conditions unsanitary to the public
or contrary to the requirements of this Article or other applicable
ordinances or statutes or regulations.
The tests shall be performed at the applicant's expense.
