This Policy establishes procedures for the evaluation and implementation
of partnering opportunities with the County in order to assess public
benefit, achieve favorable terms, and determine citizen access to
any proposed cooperative endeavor.
A. Whenever an individual, business, corporation, non-profit organization,
State agency, or similar organization desires to enter into a partnership
or cooperative agreement with the County, the request shall be reviewed
by a special committee composed of the Chairman of the Administration
Committee, County Administrator, Finance Director, Public Works Director,
and Community Services Director, hereafter known as the "Partnership/Cooperation
Committee," to review the proposal and make a recommendation to the
Levy Court.
B. At a minimum, the Partnership/Cooperation Committee shall evaluate
each request to determine the potential short-term and long-term benefits
of the proposal to the citizens of Kent County, including possible
budgetary impact(s). In addition, the Committee shall assess the level
of access which will be afforded to County citizens by participating
in the proposal, including but not limited to any potential fees or
direct cost to citizens.
C. If the Partnership/Cooperation Committee preliminarily determines
that such request will be beneficial to the community and the citizens
of Kent County, it shall explore potential agreement with favorable
terms and develop a draft partnership or cooperative agreement.
D. The Partnership/Cooperation Committee shall submit a Report of Findings
including a recommendation and a draft agreement to Levy Court for
consideration no later than 90 days after receipt, unless a longer
period is mutually agreed by both parties.
E. The Partnership/Cooperation Committee shall develop appropriate forms
and guidelines for the efficient administration of this Policy.
F. The Personnel Office shall provide administrative support and risk
management assessments to the Committee.
G. This Policy shall become effective immediately upon adoption by Levy
Court.
