No person or persons, partnership, voluntary associations or incorporated companies shall install, maintain, own, operate or possess in any store, building or other place where the public is invited or where the public may enter, within the Borough of Darby, any billiard or pool table, bagatelle table, pinball machine, shooting ray gun, jukebox, tenpin alley, bowling alley, shuffleboard or any other amusement or entertainment machine or similar device in which coins are inserted or for which coins are received or accepted for operation of such game, without having first obtained a license therefor as hereinafter provided.
The license for installation, maintenance or possession of a billiard or pool table, a bagatelle table, pinball machine, shooting ray gun, jukebox, tenpin alley, bowling alley, shuffleboard or any other amusement or entertainment machine or similar device mentioned aforesaid shall be issued in the name of the owner thereof and with the address of the premises where such device is to be installed and operated.
The application for said license or licenses prescribed in § 43-2 shall be accompanied by the appropriate license fee hereinafter named and shall be made to the Secretary of the Borough of Darby.
Upon the filing of the written application as provided in §§ 43-2 and 43-3 and the payment of the license fee herein prescribed and the compliance with the other regulations, the Secretary shall issue a separate license for each and every pool or billiard table or machine which the applicant desires to place, operate, maintain or use; and said license shall be displayed in a conspicuous place on said machine, and said license shall not be transferable as to pool or billiard tables or machines.
License or licenses covered by this chapter shall be issued for not more than one year and all licenses shall expire on the last day of December of each year, and all license fees shall be due and payable on the first day of January of each year to the Secretary of the Borough of Darby.
The license fees for the issuance of the said license or licenses for the above-mentioned calendar year or any part thereof shall be as follows:
A. 
For each pool or billiard table, $50 per table.
B. 
For each tenpin or bowling alley, $50 per alley.
C. 
For each shuffleboard, $50 per board.
Any person who shall use or permit to be used any of the machines or devices licensed hereunder for the purpose of gambling shall be deemed to be guilty of the violation of this chapter.
This chapter is enacted for the purpose of raising revenue and for regulation and control of pool and billiard tables, automatic amusements, games and machines more particularly described in § 43-2.
Any person who shall violate any provisions of this chapter shall, upon conviction thereof, be punishable by a fine of not more than $300 and costs of such proceedings or, upon default of payment of such fines and costs, by imprisonment in the county jail for a term of not more than 30 days. The continuation of such violation for each successive day shall constitute a separate offense, and the person or persons allowing or permitting the continuation of the violation may be punished as provided above for each separate offense.
