The purposes of this district are to provide for a wide range of highway-oriented retail, service and automobile-related business activities which ordinarily require main highway locations and serve regional as well as local customers and to provide sufficient space for automobile-related merchandising, including the provision of off-street parking facilities. Provisions are also included to allow and regulate office uses and special uses such as day-care centers.
Land, buildings or premises shall be used by right for only one or more of the following uses:
A. 
All uses permitted by right or by special exception in the CBD Central Business District.
B. 
Convenience store.
C. 
Grocery store or supermarket.
D. 
Shopping center.
E. 
Beverage distributor.
F. 
Catering establishment.
G. 
Laundry and dry-cleaning establishment or laundromat.
H. 
Medical or dental clinic or office.
I. 
Dance studio, martial arts school or other private instructional studio or school.
J. 
Movie theater or other indoor amusement or recreational use such as a bowling alley, children and family fun center, or other similar use; provided, however, that said facility is supervised by at least one employee during all hours that the facility is open for business.
K. 
Veterinarian, animal hospital, animal grooming establishment, or animal boarding house.
L. 
Tradesman's shops such as those for electricians, carpenters, plumbers, cabinetry makers or similar establishments including a retail outlet or showroom.
M. 
Automobile sales, leasing, and repair and service establishments, excluding auto body repair and painting businesses.
N. 
Private, commercial educational institution or establishment such as a business or trade school.
O. 
Religious use, including accessory dwelling, subject to the provisions of § 153-131.
P. 
Lodge halls, clubhouses and associated facilities, including auditoriums for private or public use, subject to the provisions of § 153-134.
Q. 
Drive-through restaurant or bank or similar drive-through use.
R. 
Municipally owned public surface parking lot.
S. 
Public utility.
T. 
Any use of the same general character as any of the above permitted uses, as determined by the Zoning Hearing Board, subject to the compatibility standards in § 153-123.
The following uses shall be permitted by special exception only, subject to the applicable provisions of Articles XVII and XXI:
A. 
Wholesale establishments including retail showroom and display space.
B. 
Gasoline service station, including self-service station, subject to § 153-137.
C. 
Car wash, subject to § 153-138.
D. 
Funeral home or mortuary, subject to § 153-140.
E. 
Hotel or motel, subject to § 153-133.
F. 
Public parking lot or deck as principal use on a lot.
G. 
Standard collection facility for recycling.
H. 
Multiple drive-through facilities for restaurants and banks, provided that there is room for four automobiles for each stacking lane and that access for vehicular storage and stacking is maintained in such a manner so as not to interfere with the safe movement of on- and off-site vehicular and pedestrian traffic.
Daycare center or group daycare home, subject to § 153-146B.
A. 
All accessory uses permitted in the CBD Central Business District.
B. 
Wireless communications antenna attached to an existing structure, subject to the provisions of § 153-146A.
C. 
Outdoor storage, provided that the area is located in the rear or side yard and is completely screened by a solid fence not less than six feet in height.
D. 
Any accessory use on the same lot with and customarily incidental to any of the uses permitted above and not detrimental to the neighborhood.
Unless specifically stated otherwise, the following shall be minimum requirements:
A. 
Individual establishments.
(1) 
Lot area: 5,000 square feet.
(2) 
Lot width: 50 feet.
(3) 
Front yard.
(a) 
In built-up block: not less than prevailing front yard setback on block.
(b) 
In other areas: 20 feet.
(4) 
Side yard: 10 feet on each side.
(5) 
Rear yard: 20 feet.
(6) 
Impervious surface: 80% maximum.
(7) 
Height: three stories or 40 feet maximum.
B. 
Shopping centers. Developments in shopping centers may consist of attached establishments or detached, individual establishments. The following shall be minimum requirements unless specifically stated otherwise:
(1) 
Tract area: two acres.
(2) 
Tract width: 200 feet.
(3) 
Front setback: 75 feet.
(4) 
Distance from property line: 75 feet.
(5) 
Distance between buildings: 40 feet.
(6) 
Impervious surface: 80% maximum.
(7) 
Height: 40 feet maximum.
A. 
All parking areas, driveways and loading areas shall be provided with a lighting system to adequately meet the needs of the area. All lighting shall be shielded from traffic on any public right-of-way and from any residential district.
B. 
Screening and landscaping shall be provided in accordance with all applicable provisions of §§ 153-117 and 153-118.
C. 
All applicable provisions of Article XIV, Parking, and Article XV, Signs, shall be followed.
