The International Property Maintenance Code, 2012 Edition, as published by the International Code Council, as well as all current editions and supplements and future editions and supplements thereto, copies of which are on file with the Township code enforcement department, is hereby adopted as the Property Maintenance Code of Plymouth Township, Montgomery County, Pennsylvania, for regulating and governing the condition and maintenance of all property, buildings, and structures, and each and all of the regulations, provisions, penalties, conditions and terms of said ICC code are hereby referred to, adopted, and made a part hereof, as if fully set out in this article, with the additions, insertions, deletions and changes, if any, prescribed in § 5-49 below.

This ordinance also repealed former Art. III, Property Maintenance Code, consisting of Sec. 5-48, Adoption of the International Property Maintenance Code, and Sec. 5-49, Additions, insertions, and changes to ICC Code, both adopted 10-11-1982 by Ord. No. 880, as amended.

Section 101.1. Insert: Plymouth Township.
Section 103.5. Amend in its entirety as follows: Fees shall be as established from time to time by Plymouth Township Council.
Section 112.4. Insert: the amount specified for a summary offense as provided for in the Plymouth Township Code.
Section 202. Add the following definition in alphabetical order:
ACCESSORY STRUCTURE. A building, the use of which is incidental to that of the main building and which is located on the same lot as the main building.

PASSENGER CAR. A motor vehicle or motorcycle designed primarily for the transportation of persons and designed for carrying no more than 15 passengers, including the driver, and primarily used for the transportation of persons. The term includes motor vehicles which are designed with seats that may be readily removed and reinstalled, but does not include such vehicles if used primarily for the transportation of property.
Section 202. Delete the existing definition of "rooming house" and substitute the following:
ROOMING HOUSE. A building, not a single-family or two-family dwelling, apartment house or hotel, providing lodging with or without meals, and having lodging accommodations consisting of fewer that fifteen (15) rooms or units.
Section 301.2.1. Add a new section as follows:
301.2.1.
On an annual basis every homeowners' association, condominium association, and/or tenant association shall submit to the Township Code Enforcement Department contact information for both the owner of the property and a designated emergency contact representative, in a form as required by Plymouth Township.

301.2.2.
On an annual basis every landlord and tenant of property used for nonresidential purposes shall submit to the Township Code Enforcement Department contact information, including emergency contact information, for both the landlord and all tenants, in a form as required by Plymouth Township.
Section 301.4. Add a new section as follows:
301.4. Vacant Units Sanitation.
No person shall occupy as owner-occupant or let to another for occupancy any vacant dwelling unit unless it is clean, sanitary and suitable for human occupancy. The owner of any structure shall, whenever the same becomes vacant, remove therefrom all papers or other combustible materials which have accumulated therein or upon any part of the premises. All doors, windows, or other openings into such structure shall be kept closed and locked, or boarded up while the same remains unoccupied.
Section 302.2. Insert after the words "located thereon": Wherever possible no drainage shall be directed onto adjacent properties.
Section 302.4. Insert: 8 inches, and all yard areas must be cut, maintained and kept clear of debris.
Section 302.4.1. Add a new section to read as follows:
302.4.1.
All street trees shall be kept trimmed by the owner of the property so that the minimum clearance where they overhang any public sidewalk shall be nine (9) feet and where they overhang any public or private roads shall be twelve (12) feet.
Section 302.8.1. Add a new section to read as follows:
302.8.1. Parking in front yard.
No vehicle other than a passenger car as defined in this ordinance[2] shall be parked, stored, or otherwise maintained for a period of greater than 72 hours in the space between the street line and the principal building on any residential property. Passenger cars may be parked or stored within this area only on approved all-weather-surfaced driveways or parking areas.
For the purposes of this section the term "vehicle" shall include automobile, truck, boat, trailer, snowmobile, recreational vehicle, mobile home, all-terrain vehicle or any other item requiring annual registration and/or inspection.
Section 304.14. Insert: April 15 through October 15.
Section 305.3. Delete the existing section and substitute the following:
305.3 Interior walls, ceilings, floors and doors.
Every interior wall, ceiling, door and floor or part thereof shall be maintained in sound condition and good repair, free of any holes, cracks, loose plaster, or other defects that would provide access for insects or rodents. All interior surfaces shall be finished with wallpaper, paint or other acceptable material so as to be easily cleanable, reasonably smooth, clean and tight. Floors shall also be reasonably true and level, free of any fixed, irregular or broken surface material that would create a tripping hazard.
Section 310. Add a new section to read as follows:
SECTION 310 RENTAL UNITS
310.1.
No person shall operate for rental a single- or multiple-family dwelling, two-family dwelling, or rooming house unless that person holds a current operating license issued by the housing code enforcement official for the specific multiple dwelling, two-family or single-family dwelling or rooming house designated therein.
310.2.
An operating license for rental use for multiple dwelling, two-family dwelling, single-family dwelling or rooming house shall be valid for the calendar year of issuance or the remainder thereof, unless revoked, and such license shall be renewable for successive calendar years. Licenses shall not be transferable.
310.3.
Applications for licenses to operate for rental multiple dwellings, two-family dwellings, single-family dwellings or rooming houses, and for renewal thereof, shall be on forms provided by the housing code enforcement official. Such forms shall set forth the owner's name and address, the number of dwelling units or rooming units, the name of a person, firm or corporation located in the Township responsible for the care and maintenance of the building, and such other information as the housing code enforcement official may require.
310.4.
A license may be revoked for any violation of this ICC Code or for the failure of the owner to maintain a residence, office or agent within the Township.
310.5.
Each applicant for a license to operate a multiple dwelling or two-family dwelling for rental shall, at the time application is made, pay a license fee as established by resolution of Township Council.
310.6.
Each applicant for a license to operate a single-family dwelling for rental shall, at the time application is made, pay a license fee as established by resolution of Township Council.
310.7.
Each applicant for a license to operate a rooming house shall, at the time application is made, pay a license fee established by resolution of Township Council.
Section 602.3. Insert: October 15 through April 15.

Section 702.5. Add a new section to read as follows:
702.5. Means of egress.
There shall be at least two (2) means of egress from each floor above the second floor of every multiple dwelling and rooming house when such units are occupied for living or sleeping purposes, and from a basement used as a dwelling unit or rooming unit when such unit is occupied for living or sleeping purposes. A basement shall not count as a floor for purposes of this section.
