Every owner of property in the Borough of Saxonburg whose property abuts upon any public street right-of-way in which a public water distribution line is installed, or upon any public water distribution lines proposed to be constructed shortly by or to be constructed in the future by a public water supplier, as defined by the Department of Environmental Protection (DEP), or whose property abuts upon any existing public water distribution lines shall connect, at its own costs, the house, building or other structures located on said property with the aforementioned public water distribution lines in accordance with the provisions of this Part and the rules and regulations of the public water supplier.

No person, firm or corporation shall make or cause to be made any connection with the aforementioned public water distribution line until he has fulfilled all the following conditions:

The property owner shall make application to the public water supplier and comply with all rules and regulations of the public water supplier, including all rules and regulations associated with the connection of the water service line.

The construction and number and size of all building water service lines shall be done in accordance with the rules and regulations of the public water supplier.

Every owner of property in the Borough of Saxonburg whose property presently abuts any public street right-of-way in which a public water distribution line is installed and is serviced by an operating well is exempt from the mandatory connection requirement.
2. 
Any property in existence for more than one year at the time of any public water supply line extension causing new connection availability to the property will be exempt from any required immediate connection.
3. 
Such properties must connect to the public water supplier distribution line upon failure of the operating well. Permits to drill a new well or extend the depth of an existing well will not be issued by the Borough of Saxonburg where the property is serviceable by a public water supplier.

Where there exists any house, building or structure in the Borough accessible to public water service (as stated in § 26-101), it shall be the duty of the Borough to notify the owner of such structure in writing, either by personal service, certified mail or registered mail, to make proper connection of such house, building or structure to the aforementioned public water distribution lines as herein provided within 60 days after receipt of said notice.

If the owner or owners of any occupied house, building or structure in the Borough accessible to public water service (as stated in § 26-101) shall neglect or refuse to connect to said public water distribution lines or otherwise refuse to comply with the provisions of this Part, after written notice as prescribed in § 26-105 hereof, the public water supplier or the Borough may perform or cause to be performed such work and labor and furnish or cause to be furnished such material as may be necessary to comply with the provisions of this Part at the cost and expense of such owner or owners, together with 10% additional thereof, and all charges and expenses incidental thereto, which sums shall be collected from the owner or owners for the use of the public water supplier or Borough as debts are by law collectible, or the public water supplier or Borough may, by its proper officers, file a municipal claim or lien therefor against said premises as provided by law.

Any person who shall be convicted of violating any of the provisions of this Part before a District Magistrate shall be sentenced to pay a fine or penalty not exceeding $1,000, together with the costs of prosecution, including reasonable attorneys' fees and costs for each subsequent offense. A continuation of such violation for each successive day or days shall constitute a separate offense and, in default of payment of either thereof, be sentenced to undergo imprisonment of not less than five nor more than 30 days in the county jail. Each day that a violation continues shall be considered a separate offense.

Every owner of property in the Borough of Saxonburg whose property is accessible to public water service (as stated in § 26-101) shall be prohibited from drilling water wells within said Borough.

It is hereby declared as the legislative intent of the Borough that the invalidity of any section, clause, sentence or provision of this Part shall not affect the validity of any other part of this Part which can be given affect without such invalid part or parts.

The Borough Council of the Borough of Saxonburg is hereby authorized and directed to execute any and all documents necessary to effectuate the purposes of this Part.
