When earth, debris or other matter shall be deposited upon the sidewalks in front of any lot in the Borough it shall be the duty of the Chief of Police to give notice to the owner of such lot, or if the owner is not resident in the Borough, then to the tenant thereof and if such real estate is vacant, then by notice posted upon the premises to remove such earth, debris or other material, and if the owner shall not remove such obstruction on the sidewalk within five days from such notice it shall be the duty of the Borough Engineer to remove the same, charging the cost thereof to the owner of such lot and to report the same to the Borough Clerk for collection.

The Borough shall, upon removing the obstruction as provided in Subsection 1 give notice by mail to the last known address of the owner of such property, of the amount charged against him and, if the same is not paid within 30 days from date of mailing such notices, the amount charged against such owner shall be collected in the same manner as penalties are by law collected.

The owner, occupant, or tenant of every property fronting upon or alongside any street in the Borough is hereby required to remove or cause to be removed from all of the sidewalks in front of or alongside such property all snow and ice fallen, formed or accumulated thereon within 24 hours after the same has ceased to fall, form or accumulate, provided that the owner of a property shall be responsible for complying with this section where such property is occupied by such owner or is unoccupied; that the tenant or occupant thereof shall be responsible where such property is occupied by such tenant or occupant only; and that the owner thereof shall be responsible where the property is a multiple-business or multiple-dwelling property occupied by more than one tenant or occupant.

In any case where the owner, occupant or tenant fails, neglects, or refuses to comply with any of the provisions of § 21-322 within the time limit prescribed therein, the Borough authorities may proceed immediately to clear all snow and/or ice from the sidewalk of such delinquents and to collect the expenses thereof, along with any additional amount allowed by law, from such owner, occupant or tenant. Such remedy shall be in addition to the penalty provided in § 21-324.

Any person, firm or corporation who violates § 21-322 shall, upon conviction, be subject to a fine not to exceed $300 per occurrence, and in default of payment thereof, to undergo imprisonment not exceeding 30 days. Each day that a violation of § 21-322 continues shall constitute a separate offense.
