The Borough Council of the Borough of West Homestead officially adopts the 2009 International Property Maintenance Code, in its entirety, as the official property maintenance code of the Borough of West Homestead.

The effective date of this Part shall be June 1, 2015.

The Council of the Borough of West Homestead hereby establishes a Property Maintenance Appeals Board pursuant to Section 111 of the 2009 International Property Maintenance Code, to be known as the "West Homestead Borough Property Maintenance Appeals Board," to hear and rule on appeals from decisions of West Homestead Code Enforcement Official(s) as to decisions pursuant to the Borough Property Maintenance Code.

Any person directly affected by a Borough Property Maintenance Code decision by a Borough Code Enforcement Official, or a notice or order issued under the Borough Property Maintenance Code, shall have the right to appeal to the West Homestead Borough Property Maintenance Appeals Board, provided that a written application or appeal is filed within 20 days after the day the decision, notice or order was served. An application for appeal shall be based on a claim that the true intent of the Borough Property Maintenance Code or the rules legally adopted thereunder has been incorrectly interpreted, the provisions of the Borough Property Maintenance Code do not fully apply, or the requirements of the Borough Property Maintenance Code are adequately satisfied by other means.

Fees. To cover the costs of administration, the minimum appeal fee shall be $200. Any additional costs will be paid by the applicant.

Membership. The West Homestead Property Maintenance Appeals Board shall consist of three members, appointed by the West Homestead Borough Council, who are qualified by experience and training to pass on matters pertaining to property maintenance and who are not employees of the Borough. The Code Official shall be an ex officio member but shall have no vote on any matter before the West Homestead Property Maintenance Appeals Board. The members of the West Homestead Property Maintenance Appeals Board shall serve staggered and overlapping terms.
A. 
The West Homestead Borough Council shall appoint two or more alternate members, who shall be called by the Board Chairman to hear appeals during the absence or disqualification of a member. Alternate members shall possess the qualifications required for Board membership.
7. 
Regulations and Procedures. The West Homestead Borough Council hereby adopts regulations and procedures for the West Homestead Property Maintenance Appeals Board and those appearing before it. Said regulations and procedures, including but not limited to notice, hearings, decisions and administration, can be found in Section 111 of the International Property Maintenance Code. These regulations and procedures may be modified by resolution of the West Homestead Borough Council.
