1. Although not a requirement of this chapter, prior to proceeding with
SWM site plan preparation and submission, the applicant is encouraged
to request a pre-application meeting with the Township's Engineer
and a staff member of the York County Conservation District to discuss
the plan concept and responsibility for submission of required documents
and information. The SWM site plan shall contain the following and
be signed and scaled by a qualified professional:
A. A general description of the project and a detailed narrative of
the stormwater management concept and conclusions describing the management
techniques, types of storage and conveyance facilities, and a comparison
between the pre-development and post-development discharge rates and
at all affected points of discharge from the property.
B. The effect of the project (in terms of runoff volumes, water quality,
and peak flows) on surrounding properties and adjacent aquatic features
and on any existing stormwater conveyance system that may be affected
by the project.
C. Complete hydrologic and hydraulic computations for all stormwater
management facilities. Structural computations can be requested at
the discretion of the Township and its Engineer.
D. Runoff calculations and related design computations of the total
drainage area necessary to substantiate the proposed temporary and
permanent stormwater management facilities.
E. A soil erosion and sediment control plan, where applicable, as prepared
for and submitted to the York County Conservation District.
F. Map(s) of the project area shall be submitted on twenty-four-inch
by twenty-six-inch sheets and shall be prepared in a form that meets
requirements for recording at the offices of the Recorder of Deeds
of York County. The contents of the maps(s) shall include, but not
be limited to:
(1)
The location of the proposed regulated activity relative to
highways, municipal boundaries and any other prominent landmarks.
(2)
Existing and proposed land uses.
(3)
The one-hundred-year floodplain as determined by the Federal
Emergency Management Agency (FEMA).
(4)
Existing contours at intervals of two feet. In areas of steep
slopes (greater than 15%), five-foot contour intervals may be used.
(5)
Existing streams, lakes, ponds or other bodies of water and
wetlands within the project area.
(6)
A map showing the extent of the entire watershed contributing
runoff to the site including off-site watersheds, if any.
(7)
A map, and/or detailed narrative description, of the downstream
area including existing features and facilities that will receive
runoff from the proposed regulated activity.
(8)
Other physical features including sinkholes, streams, existing
drainage courses and areas of natural vegetation.
(9)
An overlay showing soil names and boundaries.
(10)
A note specifying the type and amount of existing impervious
coverage on the property and the type and amount of impervious coverage
that would be added.
(11)
Existing and proposed structures, roads, paved areas and buildings.
These features shall be shown within 50 feet of the property lines.
(12)
The locations of all existing and proposed utilities, sanitary
sewers and water lines on the property being developed and within
50 feet of the subject property lines.
(13)
The locations of all existing and proposed septic tank infiltration
areas and wells on the property being developed and within 50 feet
of the subject property lines.
(14)
Final contours at intervals of two feet. In areas of steep slopes
(greater than 15%), five-foot contour intervals may be used.
(15)
Construction details, calculations and specifications for stormwater
facilities with sufficient information and dimensions for construction
interpretation that will provide the developer and constructor with
sufficient information to meet the requirements of this.
(16)
Plan view and profiles of all proposed storm sewers and other
stormwater management structures.
(17)
The name of the development, the name and address of the owner
of the property and the name of the individual or firm preparing the
plan.
(18)
A note on the plan cover sheet, specifying the status of the
property and existing improvements as follows: "The property on which
the regulated activity is proposed (was/was not) created by a subdivision
of land that occurred after the effective date of the Hopewell Township
Stormwater Management Ordinance, Ordinance No. 8-2011. Existing improvements
on the property (were/were not) constructed as part of a SWM site
plan approved by Hopewell Township after the effective date of the
Hopewell Township Stormwater Management Ordinance, Ordinance No. 8-2011."

The date of submission and all subsequent revisions.
(20)
A graphic and written scale of one inch equals no more than
50 feet; for tracts of 20 acres or more, the scale shall be one inch
equals no more than 100 feet.
(22)
Easements and plan notes as specified in §
23-502.
(23)
Staging and implementation schedule for constructing the proposed
stormwater management facilities.
(24)
The name, address and contact information of the property owner,
equitable owner and developer, as applicable, and a reference to the
recorded title to the property.
(25)
A statement, signed by the landowner, acknowledging the stormwater
management system to be a permanent fixture that can be altered or
removed only after approval of a revised plan by the Township.
(26)
Ownership, operation and maintenance provisions in accordance
with Part 5.
(27)
A note which states that all disturbed areas that will be permanently
vegetated shall be surfaced with a minimum six inches of topsoil,
unless design requirements specify additional topsoil, or other surface
material that will sustain vegetation and soil permeability.
(28)
A list of any requests for modifications of the requirements
of this chapter and details of action(s) by the Board of Supervisors
to approve or deny the request.
(29)
The following signature block for the qualified professional

1. Three copies of the SWM site plan shall be submitted as follows:
A. Two copies to the Township.
B. One copy to the York County Planning Commission when a SWM site plan
accompanies a subdivision/land development plan application.
2. Additional copies shall be submitted as requested by the Township.

1. SWM site plans shall be reviewed by the Township for consistency
with the provisions of this chapter. Approval of a SWM site plan and
modification requests submitted with an application for approval of
a subdivision or land development shall be granted or denied by the
Board of Supervisors following the recommendation of the Township
Engineer. Approval of SWM site plans and waiver requests submitted
where an application for approval of a subdivision or land development
is not required shall be granted or denied by the Township's Codes
Enforcement Officer with the recommendation of the Township Engineer
where deemed necessary.
2. Modification Requests.
A. When reviewing a SWM site plan, whether or not the SWM site plan is included in a subdivision and/or land development plan application, the Township's Board of Supervisors may, after consulting with DEP as noted in §
23-301, Subsection
2, of this chapter with respect to any modification of the requirements in §
23-301, "General Requirements," §
23-303, "Volume Controls," or §
23-304, "Rate Controls," of this chapter, grant a modification of the requirements of one or more provisions of this chapter if the literal enforcement will enact undue hardship because of peculiar conditions pertaining to the land in question, provided that such modification will not be contrary to the public interest and that the purpose and intent of the chapter is observed.
B. All requests for modifications from an applicant shall be in writing
and shall accompany and be a part of the application for approval
of a SWM site plan and/or a subdivision or land development plan as
applicable. The request shall state in full the grounds and facts
of unreasonableness or hardship on which the request is based, the
provision or provisions of the chapter involved and the minimum modification
necessary.
C. The Board of Supervisors of the Township shall keep a written record
of all action on requests for modifications including any record of
consultation and/or review by DEP.
3. SWM Site Plan Review and Approval Procedure.
A. If a SWM site plan does not involve a subdivision and/or land development,
the review of the SWM Site, recommendations, approval, approval with
conditions or disapproval, i.e., the review and decision period, shall
occur within 45 days of submission to the Township. However, the Township,
in its sole discretion, may extend the review and decision period
another 45 days due to the nature of the application and/or site conditions.
If an extension of another 45 days is imposed or granted by the Township
beyond the first forty-five-day review and decision period designated
by this paragraph, the Township shall notify the applicant in writing
and deliver such notice to said applicant within 15 days of the decision
to extend the review and decision period by the Township.
B. If a SWM site plan involves a subdivision and/or land development
plan, the period of time from the submission to the Township of the
subdivision and/or land development plan application which includes
SWM Plan and the approval, approval with conditions or disapproval,
i.e., review and decision period, shall be in accordance with the
procedure for approval of plats in § 508 of the Pennsylvania
Municipalities Planning Code, 53 P.S. § 10508.
C. From the time an application for approval of a plat involving a subdivision
or land development plan, whether preliminary or final, which includes
a SWM site plan, is duly filed with the Township, no change or amendment
of this chapter or other governing ordinance or plan shall affect
the decision on such application in accordance with the provisions
of the governing ordinances or plans as they stood at the time the
application was duly filed, as specified in § 508(4)(I)
of the Pennsylvania Municipalities Planning Code, 53 P.S. § 10508(4)(I).
D. For minor subdivisions, the Township may complete an in-house review
of the SWM site plan in lieu of a review by the Township Engineer.
For such subdivisions, the Township shall have full discretion in
determining if an in-house review is appropriate based on the scope
of the proposed improvements and the potential for impacts to the
health safety, welfare and property of the public.
E. When a SWM site plan is required, no application for a building,
occupancy or other permit for any regulated activity shall be administratively
complete for purposes of calculating approval times until the SWM
site plan has been approved. In the case of a conditional approval,
the permits may be issued by the Township at its discretion upon acceptance
in writing by the applicant of the conditions to approval.
4. Decision Notification Procedure. In all cases, the decision of the Township to approve or disapprove the SWM site plan shall be in writing and shall be delivered to the applicant no later than 15 business days following the decision. If the SWM site plan is disapproved, the written decision by the Township shall specify the defects in the application, describe the requirements which were not met, and shall cite the provisions of the chapter relied upon. If the SWM site plan is approved with conditions, the applicant shall accept or reject the conditions personally or in writing within five days following the receipt of the decision. Failure by an applicant to accept or reject the conditions of approval within five days shall be considered a rejection of the conditions and the approval shall be revoked. The time limit for satisfying conditions of approval shall be the time limit prescribed for conditional approval of subdivision and land development plans as stated in the Township's Subdivision and Land Development Ordinance [Chapter
22].

A revision to a previously submitted SWM site plan that involves
a change in SWM BMPs, stormwater management facilities, or changes
in analytical techniques, or that involves the relocation or redesign
of SWM BMPs, or that is necessary because soil or other conditions
are not as stated on the SWM site plan, as determined by the Township,
shall require a re-submission of the revised SWM site plan in accordance
with this Part, including applicable fees. For NPDES permitted sites,
any revised SWM site plan shall also be re-submitted to the York County
Conservation District for review. In the case of a SWM site plan which
contains minor deficiencies, such as a missing label, omission of
a required note or minor construction detail, as determined by the
Township, the Township may accept a re-submission of such SWM site
plan without the requirement of a review fee, or for a lesser fee
as provided for in the Township's fee schedule.

A disapproved SWM site plan may be re-submitted, with revisions to correct all aspects of the plan that do not comply with this chapter. The applicable review fee must accompany the submission of a revised SWM site plan, unless such fee is waived by the Township. (See §
23-404).

1. SWM Site Plans Independent of Subdivision and Land Development Plans. The Township's approval of a SWM site plan, when such plan is submitted independent of a Subdivision and/or land development plan, authorizes the regulated activities contained in the SWM site plan for a maximum term of validity of five years following the date of approval. Terms of validity shall commence on the date the Township signs the approval for an SWM site plan. If approved regulated activities are not completed according to §
23-407 within the term of validity, then the Township may consider the SWM site plan disapproved and may revoke any and all permits. If approved regulated activities are under construction but not completed within the term of validity, then the owner or developer shall be granted an additional 12 months beyond the original term of validity to complete the regulated activities. SWM site plans that are considered disapproved by the Township may be re-submitted in accordance with §
23-405 of this chapter.
2. SWM Site Plans Included in a Subdivision and/or Land Development
Plan. The Township's approval of a SWM site plan, which is a part
of a Subdivision and/or Land Development Plan, authorizes that plan
and the regulated activities therein so that no subsequent change
or amendment in this chapter or other governing ordinances or plans
shall be applied to affect adversely the right of the applicant to
commence and to complete any aspect of the approved development in
accordance with the terms of such approval within five years from
such approval, as specified in § 508(4)(ii) — (vii)
of the Pennsylvania Municipalities Planning Code, 53 P.S. § 10508(4)(ii)
— (vii).

1. The developer shall be responsible for providing as-built plans of
all SWM BMPs included in the approved SWM site plan. The as-built
plans and an explanation of any discrepancies with the approved SWM
site plan shall be submitted to the Township.
2. The as-built submission shall include a certification signed by a
qualified professional verifying that all permanent SWM BMPs have
been constructed according to the approved plans and specifications.
3. After receipt of the completion certification by the Township, the
Township may conduct a final inspection to verify compliance with,
and accuracy of, the as-built plans.

Modifications to an approved SWM site plan shall require prior
approval by the Township. The nature and scope of any proposed modifications
shall be submitted to the Township in writing, including engineering
drawing, as appropriate, for approval prior to commencing work to
implement modifications. All modifications shall be in compliance
with this chapter.

The applicant shall provide financial security to the Township prior to approval of a SWM site plan to guarantee installation and construction of all stormwater management facilities depicted on the approved SWM site plan (including associated erosion and sedimentation facilities) in the amount of 110% of the total estimated construction cost. Financial security shall be provided in a form that is acceptable to the Township's legal counsel. The financial security shall comply with the requirements of § 509 of the Pennsylvania Municipalities Planning Code, 53 P.S. § 10509, except that the financial security shall only be released upon submittal and approval of an as-built plan and professional certification as required by §
23-407. All remedies available to the Township pursuant to §§ 509, 510 and 511 of the Pennsylvania Municipalities Planning Code, 53 P.S. §§ 10509, 10510, 10511, shall be available pursuant to this chapter.
