The parcel of land described below is added to and henceforth
shall be a part of that certain existing planned development district
located on State Route 43 east of the Hamlet of West Sand Lake, which
said existing planned development district was duly created by the
Town Board on August 9, 1978, and is so designated on the Official
Zoning Map of the Town.
All that tract, piece or parcel of land situate on the northerly
R.O.W. of N.Y.S. Route 43 in the Town of Sand Lake, Rensselaer County,
and being further bounded and described as follows: Beginning at a
point in the northerly R.O.W. of N.Y.S. Route 43, said point being
the southeast corner of lands N/F of Robert Middleton, liber 1121
page 147, and the southwest corner of lands being described herein;
thence northerly and westerly along the aforesaid lands N/F of Middleton
N 12-05-30 W 222.91' to a point; thence westerly on a curve to the
right with a central angle of 12-43-44, a radius of 749.70' and arc
length of 166.65' to a point; thence N 79-00-50 W 168.70' to a point;
thence along lands N/F of Lancaster Development Inc. liber 1368 page
1050 and lands N/F of Troy Sand and Gravel Co., Inc. liber 1368 page
1040 the following courses and distances: N 10-59-10 E 66.00'; S 79-00-50
E 168.70' to a point; thence easterly on a curve to the left with
a central angle of 11-43-26, a radius of 683.70' and arc length of
139.90' to a point; thence N 12-05-30 W 214.88'; N 76-13-00 E 425.04';
S 12-05-25 E 248.39' to a point; thence easterly on a curve to the
left with a central angle of 12-49-06, a radius of 749.70' and arc
length of 167.72' to a point; thence N 42-19-00 E 114.55'; S 34-54-30
E 70.00'; S 26-05-30 W 148.00'; S 45-05-30 W 380.00' to a point on
the aforementioned R.O.W. of NYS 43; thence southwesterly along said
R.O.W. S 71-40-20 W 282.09' to the point or place of beginning containing
within said bounds 5.87 acres of land more or less.
The 5.87-acre parcel hereby added by this article to the existing 43 Mall Planned Development District may be used for automobile repair and sales and self-service storage or such other uses as shall be approved by the Town Board upon application thereto in accordance with the provisions for amending a PDD as set forth in Article
X of this chapter. Any uses lawfully occurring elsewhere in such district may be continued, provided that any change of use shall be subject to the approval of the Town Board in accordance with Article
X of this chapter. Any and all building plans within any portion of such planned development district are subject to approval in accordance with the procedures set forth in such article.
A survey map of the parcel hereby added to the existing 43 Mall
Planned Development District shall be filed with and maintained by
the Town Clerk.
