The Honey Brook Borough Council finds and declares that stray cats within the Borough may pose a danger to the health, safety, and welfare of the public and may constitute a public nuisance. Accordingly, it is the intent of this Part a) to ensure that owners shall exercise proper care and control of their cats to prevent them from straying and becoming a public nuisance, and b) to provide for penalties as set forth herein.

The following words and phrases, when used in this Part, shall have the meanings ascribed to them in this section, except where the context or language clearly indicates or requires a different meaning. When not inconsistent with the context, words used in the present tense include the future and the past, words in the plural number include the singular, and words in the singular number include the plural.
CAT
An animal that is a member of the species Felis domesticus.
OWNER
Every person having a right of property in any cat, every person who keeps or harbors such cat or has such cat in his or her care, and every person who permits such animal to remain on or about any premises occupied by him or her.

1. 
It shall be unlawful for any owner of any cat to permit such cat to run free outside the residence and on the real property of its owner or keeper unless said cat has been:
A. 
Neutered or spayed to prevent it from procreating;
B. 
Immunized against rabies in compliance with Pennsylvania law; and
C. 
Fitted with a breakaway collar and identification tag.
2. 
It shall be unlawful for any person to release into the wild or otherwise abandon any cat upon that person's property or the property of another.

An owner shall exercise proper care and control of his or her cat to prevent it from becoming a public nuisance. It shall be unlawful for the owner of any cat to permit it to cause annoyance to persons, including habitually or continually howling or making loud noises, or damage to persons or property, to trespass upon and litter or defecate on any premises other than the owner's, or upon any of the sidewalks, roadways or public grounds in the Borough.

It shall be the duty of any police officer of the Borough of Honey Brook or any agent designated by the Borough Council to enforce and administer the provisions of this Part upon a determination that a violation of this Chapter 2 has occurred.
2. 
Any police officer of the Borough of Honey Brook or agent designated by the Council shall have the authority to seize and detain any cat causing annoyance or damage by running at large and to transport such animal for impoundment in an animal shelter as selected by the Borough. Any police officer of the Borough of Honey Brook or agent designated by the Council is hereby authorized to go upon any premises to seize, detain or impound any cat that poses an imminent risk to the public health, safety or general welfare. If such cat bears an identifying tag with its owner's name, address and phone number, notice of the seizure and impounding of the cat shall be promptly sent to the owner in the manner prescribed by law, and the cat shall be released to the owner upon payment of the charges incurred by reason of such detention.

Any person who shall violate any provision of this Part shall, upon summary conviction before a District Justice, be subject to a fine for each offense of not less than $100 and not more than $500 and the costs of prosecution and, in default of payment of such fine and costs of prosecution, shall be sentenced to imprisonment of not more than 30 days. Each day a violation shall remain shall constitute a separate violation, and a violation of each section of this Part shall be considered a separate offense.
