The Superintendent may, at any time, require the installation and/or relocation of an internal or external interceptor or separator at a commercial or industrial property, as the Superintendent may deem necessary for the proper handling of liquid wastes containing fat, oil, grease, sand or other substances harmful or hazardous to the sanitary sewer system, except that such interceptors shall not be required for private living quarters or dwelling units. All interceptors shall be of a type and capacity approved by the Superintendent and will be located as to be readily and easily accessible for cleaning and inspections. Each interceptor and separator shall meet the design and installation requirements of the New York State Uniform Building Code. The Superintendent shall have discretion to consult with the property owner to determine the capacity of the device to be installed, depending on the expected use of the premises. This discretion shall be ongoing, and the Superintendent may require additional capacity if the expected use changes or the original device is not adequate.
The size, type, and location of each interceptor and separator shall be in accordance with the New York State Uniform Building Code. All interceptors and separators shall be installed by a licensed contractor or plumber in accordance with standards and following an inspection protocol established by the Superintendent.
The property owner of the building served by the interceptor or separator shall maintain, at the property owner's expense, all devices installed on the property owner's property. At a minimum, the property owner shall be responsible for inspecting and maintaining the interceptors and separators by removing accumulated grease, scum, oil, or other floating substances and solids deposited in the devices according to the following schedules:
A. 
Indoor interceptors and separators shall be inspected weekly and cleaned monthly or more frequently if necessary.
B. 
Outdoor interceptors and separators shall be inspected monthly and cleaned quarterly or more frequently if necessary.
C. 
The Superintendent may require more frequent inspections and cleanings if the Superintendent determines, in his discretion, that said inspection and cleanings are necessary for preventing fat, oil, grease, sand and other substances harmful or hazardous to the municipality's sanitary sewer system from entering and clogging said system.
The property owner of the building served by the interceptor or separator shall maintain or cause to be maintained written logs of all inspections and maintenance/cleanings of each interceptor and separator. Property owners shall be required to submit said written logs to the Superintendent monthly and at such other times as the Superintendent requests.
Owners shall allow the Superintendent to access all interceptors and separators with prior notice, at such reasonable times as may be necessary in order for the Superintendent to determine the property owner's compliance with this article.
The Superintendent and/or the Town Code Enforcement Officer/Building Inspector shall have the authority to enforce the provisions of this article. Articles VII and VIII apply to violations and enforcement of this article.
