The Environmental Commission of the Township of Eastampton shall be continued, and the provisions of the ordinances pertaining thereto as set forth in Chapter 28 of the Code of the Township of Eastampton are adopted herein by reference.

The Planning Board of the Township of Eastampton shall be continued, and the provisions of any and all ordinances pertaining thereto as set forth in any chapter of the Code of the Township of Eastampton are adopted hereby by reference thereto, and shall be known as the "Land Use Planning Board." The powers of the Planning Board shall be exercised by the Land Use Planning Board as permitted by law.[1]

A. 
Emergency Management Council.
(1) 
There is hereby established an Emergency Management Council pursuant to N.J.S.A. App. A:9-41 et seq., the head of which shall be the Emergency Management Coordinator, who shall be appointed by the Mayor. The Emergency Management Council shall be composed of up to 15 members, who shall be appointed by the Manager and shall serve at his/her will and pleasure. The Emergency Management Council and the Coordinator thereof shall have all the functions, powers, and duties prescribed by N.J.S.A. App. A:9-40.1, App. A:9-41 et seq.
(2) 
It is the intent and purpose of this section to establish an Emergency Management Council that will ensure the complete and efficient utilization of all of the Township's facilities to combat disaster resulting from major emergencies; natural, man-made or nuclear disasters; or enemy attack.
(3) 
The Emergency Management Council will be the coordinating agency for all activity in connection with emergency management. It will be the instrument through which the Coordinator may exercise the authority and discharge the responsibilities vested in him/her in accordance with the New Jersey Civilian Defense and Disaster Control Act of 1942, P.L. 1942, c. 251, as amended and as supplemented by this chapter (the "Act.")[1]

(4) 
This chapter will not relieve any Township department of the responsibilities or authority given to it by ordinance, nor will it adversely affect the work of any volunteer agency authorized for relief in disaster emergencies.
(5) 
The purpose of this section is to provide for the health, safety, and welfare of the people of the Township of Eastampton and to aid in the prevention of damage to and the destruction of property during any emergency as herein defined by prescribing a course of conduct for the civilian population of this Township during such emergency and by centralizing control of all civilian activities having to do with such emergency.
B. 
Definitions. The following definitions shall apply in the interpretation of this chapter:
COORDINATOR
The Emergency Management Coordinator of the Township of Eastampton Emergency Management Council, appointed by the Mayor as prescribed in this chapter.
DISASTER
An unusual incident resulting from natural or unnatural causes which endangers the health, safety, or resources of the residents of this Township, and which is or may become too large in scope or unusual in type to be handled in its entirety by regular Township operating services.
EMERGENCY
Includes "disaster" and "war emergency" as defined in this section.
EMERGENCY MANAGEMENT FORCES
The employees, equipment, and Township facilities of all departments, boards, institutions, and commissions; and, in addition, it shall include all volunteer personnel, equipment, and facilities contributed by or obtained from volunteer persons or agencies.
EMERGENCY MANAGEMENT VOLUNTEER
Any person duly registered, identified and appointed by the Coordinator of the Office of Emergency Management and assigned to participate in the emergency management activity.
LOCAL DISASTER EMERGENCY
Includes any disaster or the immediate imminence thereof resulting from natural or unnatural causes other than enemy attack and limited to the extent that action by the Governor under the New Jersey Civilian Defense and Disaster Control Act[2] is not required.
REGULATIONS
Includes plans, programs, and other emergency procedures deemed essential to civil defense.
VOLUNTEER
Contributing a service, equipment, or facilities to the emergency management organization without remuneration.
WAR EMERGENCY
Includes any disaster occurring anywhere within the Township as the result of enemy attack or the imminent danger thereof.

C. 
Coordinator.
(1) 
The Mayor shall appoint an Emergency Management Coordinator from among the residents of this municipality, who shall be a person well versed and trained in planning operations involving the activities of many different agencies which will operate to protect the public health, safety, and welfare in the event of danger from emergencies as defined in this chapter.
(2) 
The Emergency Management Coordinator shall, subject to fulfilling the requirements of this section, serve for a term of three years. As a condition of his/her appointment and his/her right to continue for the full term of his appointment, said Coordinator of Emergency Management shall have successfully completed at the time of his/her appointment or within one year immediately following his/her appointment or the effective date of the Civilian Defense and Disaster Control Act (N.J.S.A. App.A:9-33 et seq.), whichever is later, the current approved home study course and the basic emergency management workshop. The failure of any Coordinator of Emergency Management to fulfill such requirements within the period prescribed shall disqualify the Coordinator from continuing in the office of Coordinator, and thereupon a vacancy in said office shall be deemed to have been created.
(3) 
Removal of Emergency Management Coordinator. The Governor may remove any Coordinator of Emergency Management at any time for cause. In such event, the Mayor of the municipality shall appoint a new Coordinator of Emergency Management with the approval of the Governor. If the Mayor shall not appoint a Coordinator of Emergency Management within 10 days after such office shall become vacant, the Governor may appoint a Temporary Coordinator of Emergency Management, who shall serve and perform all of the duties of that office until such time as a new Coordinator of Emergency Management shall be appointed by the Mayor with the approval of the Governor.
(4) 
The Coordinator shall designate and appoint, with the approval of the Mayor, a Deputy Coordinator, to assume the emergency duties of the Coordinator in the event of his/her absence or inability to act, the intent being that there shall always be at all times a Coordinator in charge of emergency management operations. Whenever possible, such deputy shall be appointed from among the salaried officers or employees of the municipality.
(5) 
The Emergency Management Coordinator shall be responsible for the planning, activating, coordinating, and the conduct of emergency management operations within the Township of Eastampton.
(6) 
Wherever, in his/her opinion, a disaster has occurred or is imminent in any municipality, the Coordinator of Emergency Management of that municipality shall proclaim a state of local disaster emergency within the municipality. The Coordinator of Emergency Management, in accordance with regulations promulgated by the State Civilian Defense Director, shall be empowered to issue and enforce such orders as may be necessary to implement and carry out disaster-control operations and to protect the health, safety, and resources of the residents of the municipality.
D. 
Emergency Operations Plan. In accordance with N.J.S.A. App. A:9-43.2 et seq., the Township shall prepare a written Emergency Operations Plan with all appropriate annexes necessary to implement the plan. The development of all plans shall be coordinated with the Emergency Operations Plans of the state, county, and neighboring municipalities to ensure a regional coordinated response and the efficient use of resources.

A. 
Establishment; appointment; terms; compensation; organization.
(1) 
There shall be a Recreation Advisory Committee comprised of no more than nine members, appointed by the Township Council. All members shall be residents of the Township during their entire term. One member shall be a member of the Township Council.
(2) 
The members of the Committee shall be appointed by the Township Council to three-year terms, except for the Council member who shall be appointed to a one-year term. Terms of the members shall be staggered such that no more than three members' terms shall expire in any one year, excluding the Council membership term. All terms shall expire on the last day of December.
(3) 
All members shall serve without compensation. Vacancies shall be filled for the unexpired term.
(4) 
The Recreation Advisory Committee shall select a Chairperson and Vice Chairperson from among the appointed members of the Committee.

(5) 
The Chairperson shall designate a Secretary to the Committee subject to majority vote. The Secretary shall take minutes of all meetings of the Committee and provide them to the Chairperson for submission to the Township Council.
(6) 
The Chairperson may organize the Committee membership into subcommittees, each responsible for a specific event.

(7) 
The Chairperson shall call and preside over Committee meetings. The Vice Chairperson may call and preside over meetings in the Chairperson's absence.

B. 
Powers and duties. The Committee shall hold an annual reorganization meeting and meet as required thereafter. The Committee shall plan, coordinate, promote, and staff public events designated annually by the Township Council. The Township Manager or his/her designee shall be responsible for supervising events and performing administrative tasks, including, but not limited to, agreements, contracts and purchasing.

C. 
Background checks. All Committee members and event volunteers are required to undergo a background check through the Eastampton Township Police Department on an annual basis.

A. 
Membership; terms; Chairperson.
(1) 
There shall be an Economic Development Advisory Committee (EDAC) consisting of seven members to be appointed by the Township Council. Membership shall include the following:
(a) 
Class A: a person who is knowledgeable in economic development, regional planning, the local real estate market and/or needs of the local business community and who may reside outside the Township. Class A members shall be nonvoting members.
(b) 
Class B: one member of the Township Council.
(c) 
Class C: Township Manager.
(d) 
Class D: one member of the Land Use Planning Board.
(2) 
Class E: two members who shall hold no other municipal office, position or employment. The terms of the initial appointments for these members shall not exceed two years and shall be staggered; thereafter, Class E members shall be appointed for a two-year term.
(3) 
Members shall be appointed annually with the exception of Class E members, who shall be appointed for a two-year term.
(4) 
The Township Council shall annually appoint one of the Class E members as Chairperson of the Committee.
B. 
The EDAC shall be responsible for the following:
(1) 
Make recommendations to the Land Use Planning Board on the economic development plan element of the Eastampton Township Municipal Master Plan, which shall be developed and approved pursuant to N.J.S.A. 40:55D-28b(8).
(2) 
Upon the request of the Township Council or Township Manager, and in advance of the submission of any formal development applications, meet with prospective developers to provide an orientation to the goals and objectives of the economic development plan element and other related official planning documents.
(3) 
Provide to the Land Use Planning Board, Township Council and Township Manager information regarding any preliminary meetings and, upon request, provide advisement regarding the consistency of formal development applications with respect to the goals and objectives of the economic development plan element and other planning documents.
(4) 
Upon the recommendation and approval of Township Council, coordinate and promote events and functions which will enhance the economic vitality and sustainability of Eastampton Township. The Township Manager or his/her designee shall be responsible for supervising events and performing administrative tasks, including, but not limited to, agreements, contracts and purchasing.
C. 
Background checks. All Committee members and volunteers are required to undergo a background check through the Eastampton Township Police Department on an annual basis.
D.

The Historic Preservation Commission of the Township of Eastampton shall be continued, and the provisions of the ordinances pertaining thereto as set forth in § 540-37 of Chapter 540, Zoning, are adopted herein by reference.

A. 
Establishment; appointment; terms; compensation; organization
(1) 
There shall be a Veteran and Military Affairs Advisory Committee comprised of no more than nine members, appointed by the Township Council. All members shall be residents of the Township during their entire term. One member shall be a member of the Township Council. Membership is open to active duty military members including National Guard and Reserve components and their spouses, retired military members and their spouses, widows of active duty or retired members, and those individuals with an honorable or general discharge. Individuals with a general discharge must be under honorable conditions. The membership will be open to one student liaison from either the Rancocas Valley Regional High School JROTC program or an eighth-grade student from the Eastampton Community School.
(2) 
The members of the Committee shall be appointed by the Township Council to three-year terms, except for the Council member who shall be appointed to a one-year term. Terms of the members shall be staggered such that no more than three members' terms shall expire in any one year, excluding the Council membership term. All terms shall expire on the last day of December.
(3) 
All members shall serve without compensation. Vacancies shall be filled for the unexpired term.
(4) 
The Committee shall select a Chairperson and Vice Chairperson from among the appointed members of the Committee by majority vote.
(5) 
The Chairperson shall designate a Secretary to the Committee subject to majority vote. The Secretary shall take minutes of all meetings of the Committee and provide them to the Chairperson for submission to the Township Council.
(6) 
The Chairperson shall designate Committee members to oversee specific events and to appoint subcommittees to assist with the planning, development and coordination of such events.
(7) 
The Chairperson shall preside over Committee meetings.
B. 
Powers and duties. The Committee shall propose a calendar of Committee meeting dates to Township Council at a Township Council meeting in January of each year. The Committee shall recommend events to Township Council centered on partnering with our community and Joint Base McGuire-Dix-Lakehurst (JBMDL) to recognize, support, and celebrate our active and veteran military citizens and, upon Township Council approval, organize events under the guidance of the Township Manager and other Township staff designated by the Township Manager. Each event proposed by the Committee shall include a budget estimate. The Committee shall be responsible for the recruitment and staffing of volunteers to assist with the organization and of celebratory events. The Township Manager or his/her designee shall be responsible for supervising events and performing administrative tasks, including but not limited to, agreements, contracts and purchasing.
C. 
Background checks. All Committee members and volunteers are required to undergo a background check through the Eastampton Township Police Department on an annual basis.
D. 
Removal of members. Township Council may remove any member of the Committee with or without cause.
E. 
Fees. Veteran and Military Affairs Advisory Committee program fees shall be established by ordinance and revised as needed. The ordinance shall be on file in the office of the Municipal Clerk and available for public inspection during regular business hours.
F. 
Employees. The Township Manager may hire part-time and seasonal employees to effectively organize, manage and supervise recreation programs.
G. 
Township Council has established a recreation trust fund pursuant to N.J.S.A. 40:48-2.56 providing for all fees collected for recreation and celebration programs to be deposited in such trust fund to be used solely for the purpose of operation such programs. The Committee shall have its own trust fund which will exist as a subaccount within the recreation trust fund. The trust fund shall be administered in accordance with financial guidelines pertaining to all public funds and in accordance with the Township budgetary system.

APPOINTED OFFICIAL
An individual, appointed either by the Mayor and/or Township Council, to any "local government agency" as that term is defined within N.J.S.A. 40A:9-22.3(e) and includes, but is not limited to, appointees to any agency or board within the Township of Eastampton, as well as any other independent local authority or entity created by the Township of Eastampton, which performs functions other than of a purely advisory nature and/or one in which the members receive compensation.
ELECTED OFFICIAL
The elected members of Township Council, including but not limited to the Mayor.
FAMILY MEMBER or RELATIVE
Wherever and whenever this chapter mentions or references "family member" or "relative," same refers to a spouse; child; parent; sibling; grandparent; grandchild; father-in-law; mother-in-law; brother-in-law; sister-in-law; stepfather; stepmother; stepsibling; half-brother; half-sister; nephew; niece; first cousin; aunt; uncle; foster child; domestic partner or cohabitants as defined by the New Jersey Civil Union Act; a person with whom there is a relationship as a legal guardian or in loco parentis.
B. 
Hiring and supervision of employees.
(1) 
No person who is a relative or family member of any elected official or the Township Manager of the Township shall be considered for employment as an employee of the Township. This applies to full-time, part-time, temporary and seasonal employment. This shall not restrict nor prohibit the continued employment of individuals to a position or positions with the Township where a relative of a permanent employee is elected after the date of the permanent employee's start date of employment with the Township.
(2) 
No municipal employee shall be in a position that provides supervision or is in the line of authority over any family member or relative of that employee. This precludes the acceptance of applications for full-time, part-time or seasonal employment from relatives for positions in the same department where supervision conflicts exist or, through promotion, potential conflict could exist. This policy does not apply to employees of the Township as of September 23, 2019.
(3) 
One of the purposes of this policy is to assure that the hiring, promotion, responsibilities, oath, obligations to the public, salary, work assignments, performance, appraisals, evaluations or career progress of a person is not affected by that individual's status as a family member or relative of an elected or appointed official or employee of the Township. These policies are not for the purpose of depriving any citizen of an equal chance for a government job, but solely to eliminate the potential for preferential treatment of the relatives of government personnel or elected officials. These policies will not deprive any permanent employee as of September 23, 2019 of any promotional right in the normal career development nor change the existing status of any permanent employee. Nothing within this policy shall interfere with a person's right to marry.
(4) 
The Township Manager reserves the right to exercise its judgment, in its sole discretion, with respect to placement, employment, transfer, reassignment or continued employment, where either an actual or perceived conflict of interest exists or will reasonably arise as well as to avoid or decrease the likelihood of sexual or other unlawful harassment in the workplace.
C. 
Promotion of existing employees.
(1) 
No elected official or supervisor may participate in the promotion process, or any other personnel decision, of any existing municipal employee who is a relative or family member of such elected official or supervisor.
D. 
Appointments.
(1) 
No relative or family member of an elected official shall be appointed to the position of any municipal professional who receives compensation, or to any "local government agency" as that term is defined within N.J.S.A. 40A:9-22.3(e) and includes, but is not limited to, any agency or board within the Township of Eastampton, as well as any other independent local authority or entity created by the Township of Eastampton, which performs functions other than of a advisory nature and/or one in which the members receive compensation.
(2) 
No relative or family member of an appointed official shall be appointed to the position of any municipal professional who receives compensation, and includes professionals who provide services to the Township or to any "local government agency" within the Township, as that term is defined within N.J.S.A. 40A:9-22.3(e), and includes, but is not limited to, any agency or board within the Township of Eastampton, as well as any other independent local authority or entity created by the Township of Eastampton.
