A temporary regulation pursuant § 190-26 shall include the purchase and use of temporary no-parking signs (or "TNP" signs) for vehicles needing temporary reserved curbside access and to clear public rights-of-way of parked vehicles in the interest of public safety, health, and welfare.
Any other purpose which implicates public safety, health, or
welfare as determined by the Director of Transportation and Parking
or his or her designee.
TNP signs may be purchased for reserved curbside access for commercial
vehicles (a vehicle which has up-to-date registration as a commercial
vehicle with the New Jersey Motor Vehicle Commission and has license
plates which indicate same) or for personal vehicles. For personal
vehicles, the vehicle must be registered with the Parking Utility
by providing vehicle information, including make, model, and license
plate number at the time of the sign purchase.
Residents, businesses, institutions, or agencies can purchase TNP
signs to reserve temporary curbside access for four-, eight-, twelve-,
and twenty-four-hour increments according to the following pricing,
noting that a minimum of two TNP signs must be purchased at a time:
For residential moving, moving storage containers, dumpsters,
block parties, television and film, street fairs, parades, marathons,
and other circumstances as deemed necessary by the Director of Transportation
and Parking (nonmetered locations and metered locations wherein residential
parking is also permitted): must be purchased 10 days in advance and
will be posted by the Hoboken Parking Utility seven days in advance
of the scheduled no-parking designation.
A maximum of two temporary no-parking signs may be active per
account, per day, by residential contractors, unless otherwise approved
by the Director of Transportation and Parking or his or her designee.
A maximum of three temporary no-parking signs may be active
per account, per day, for dumpsters and storage containers, unless
otherwise approved by the Director of Transportation and Parking or
his or her designee.
For emergencies, public safety, construction activity, and official
City business, (nonmetered locations and metered locations where residential
parking is also permitted): must be purchased a minimum of three days
in advance and will be posted by the Hoboken Parking Utility three
days in advance of the scheduled no-parking designation.
For all metered locations where only meter parking is permitted:
must be purchased 24 hours in advance and will be posted by the Hoboken
Parking Utility four hours in advance of the scheduled no-parking
designations.
TNP sign fees shall be waived by the Department Director, or his
or her designee, for registered nonprofit organizations or approved
special community events organized by noncorporate entities, such
as block parties, festivals, and 5K races. However, each nonprofit
organization shall only be entitled to have the fee waived for signs
for no more than 10 cumulative days per calendar year.
It shall be the responsibility of the individual, business, institution,
or agency who purchases temporary no-parking signs to remove the sign
within two hours of expiration of the posted date and time on the
temporary no-parking signs or upon completion of the purpose of the
purchase, whichever is sooner. Any individual, business, institution,
or agency found to be in violation of this section shall be subject
to a penalty in the amount of $45 per sign.
With the exception of construction vehicles, TNP signs excuse vehicles from observing street cleaning regulations in accordance with § 190-28 (Alternate parking locations). Construction vehicles must abide by street cleaning regulations. Authorized vehicles (commercial vehicles or personal vehicles that have been registered with the Parking Utility) will be exempt from residential parking requirements if parked in a residential spot during the times and dates listed on the TNP signs.
The Director of Transportation and Parking for the Hoboken Parking
Utility or his or her designee may enact such reasonable regulations,
not inconsistent with this article, as necessary for the establishment
and enforcement of the purchase and use of TNP signs.
The Hoboken Parking Utility and the Hoboken Police Department shall
have the authority to tow unauthorized vehicles parked within active
temporary no-parking sign zones at the vehicle owner's sole expense.
No individual shall tamper with, manipulate, move, or otherwise alter a posted temporary no-parking sign, except for the purchaser removing the sign as required in Subsection H above. Any individual found to be in violation of this section shall be subject to penalties as follows: imprisonment in the county jail or in any place provided by the municipality for the detention of prisoners, for any term not exceeding 90 days; or by a fine of not less than $100 and not exceeding $2,000; or by a period of community service not exceeding 90 days.
