The Village of New Haven hereby adopts by reference the rules and design standards of the Macomb County Public Works Office and the Macomb County Public Works Commissioner.
A. 
The Macomb County Public Works Office shall be utilized and contracted as the Village enforcing agency in regard to Part 91, Soil Erosion and Sedimentation Control, of the Natural Resources and Environmental Protection Act, Public Act No. 451 of the Public Acts of 1994, as amended (Part 91) being MCLA § 324.9101 et seq., and administrative rules promulgated by the state Department of Environmental Quality as amended, within the municipal limits of the Village.
B. 
All permit and inspection fees relating to soil and erosion as prescribed by the Acts per this article shall be handled by the enforcing agency, the Macomb County Public Works Office per that office's normal and customary procedures and regulations.
Fees for plan examination, permits and inspections and required bond amounts which may become due and payable under this article shall be determined by resolution of the Village Council.
Appeals shall be handled through the Macomb County Public Works Office pursuant to its procedures for such actions.
Whoever violates any provision of this article is responsible for a civil infraction and shall be subject to the provisions of a civil fine as provided for in Part 91, Soil Erosion and Sedimentation Control, of the Natural Resources and Environmental Protection Act, Public Act No. 451 of the Public Acts of 1994, as amended, being MCLA § 324.9121 et seq.
The provisions of this article shall be liberally interpreted in order to promote and accomplish the purposes of this article. Any limitations set forth in this article shall be construed as the minimum requirements in their interpretation and application. Wherever the requirements of any other lawfully adopted rules, regulations or ordinances are more or less restrictive than the provisions of this article, the more restrictive or that imposing the higher standards shall govern.

This article shall take effect 30 days following publication of a notice of adoption hereof as provided by state law. This article was adopted by the Village Council on December 13, 2016.

A notice of adoption was published in The Bay Voice on December 14, 2016.
C. 
The effective date of the Village of New Haven Soil and Erosion Control Ordinance is January 14, 2017.
