A certain document, one copy of which is on file in the office of the City Administrator of the City of Pittston, being marked and designated as the International Property Maintenance Code (IPMC), 2018 Edition, as published by the International Code Council, be and is hereby adopted as the Property Maintenance Code of the City of Pittston, in Luzerne County, Commonwealth of Pennsylvania, for regulating and governing the conditions and maintenance of all property, buildings and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use, and the demolition of such existing structures as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Property Maintenance Code on file in the office of the City Administrator are hereby referred to, adopted, and made a part hereof, as if fully set out in this article, with the additions, insertions, deletions and changes prescribed in Pittston City Code § 370-2, Modifications and amendments. Wherever the acronym "IPMC" shall appear in this article, it shall be construed to refer to the International Property Maintenance Code, 2018 Edition.

The following sections are hereby revised:
A. 
IPMC Section 101.1. Insert: "City of Pittston, Luzerne County, Pennsylvania."
B. 
IPMC Sections 103.1, 103.2, 103.3. Amend to read: "The IPMC shall be enforced in the City of Pittston by the duly appointed City of Pittston Property Maintenance Code Enforcement Officer, as directed by the City Administrator in accordance with Pittston City Code § 7-2C."
C. 
IPMC Section 103.5. Amend to read: "Applicable fees shall be set by resolution of the City Council of the City of Pittston."
D. 
IPMC Section 106.4. Insert: "The City Property Maintenance Code Enforcement Officer shall issue a nontraffic citation for each violation of this code. Upon conviction before the District Magisterial Judge, a fine of not less than $500 for a first offense and not more than $1,000 for each subsequent offense, plus all City-incurred court costs and legal fees, shall be imposed, and upon default of payment of fines and/or costs, a sentence of not more than 30 days in the county jail shall be imposed. Each day of violation shall be deemed a separate offense. Both the property owner and the violator shall be cited for such offense."
E. 
IPMC Section 111.2. Amend to read: "All appeals filed under this section shall be filed with and administered by the Joint Code Appeals Board of the City of Pittston as set forth in Pittston City Code Chapter 7, Administration of Government, Article II, Joint Code Appeals Board, §§ 7-4, 7-5, and 7-6.
F. 
IPMC Section 112.4. Insert: "The City Property Maintenance Code Enforcement Officer shall issue a nontraffic citation for violations of this section. Upon conviction before the District Magisterial Judge, a fine shall be imposed of not less than $500 for a first offense and not less than $1,000 for each subsequent offense plus all City-incurred court costs and legal fees. Each day the offense continues shall be deemed a separate offense."
G. 
IPMC Section 302.4. Insert: "Eight inches and in accordance with all provisions of Pittston City Code Chapter 281, Grass, Weeds and Other Vegetation."
H. 
IPMC Section 404. Insert: "Compliance is also required with all provisions of Pittston City Code Chapter 480, Zoning."

IPMC Section 602.3. Insert: "January 1 to December 31."
J. 
IPMC Section 602.4. Insert: "January 1 to December 31."
K. 
IPMC Section 701. Insert: "Compliance with Pittston City Code Chapter 260, Fire Prevention Code, is also required."
Nothing in this chapter or in the Property Maintenance Code hereby adopted shall be construed to affect any suit or proceeding pending in any court or any rights acquired or liability incurred or any cause or causes of action acquired or existing under any act or ordinance hereby repealed, nor shall any just or legal right or remedy of any character be lost, impaired or affected by this chapter.
