A.
A completed trucked waste hauler's license application must be submitted
by each hauling firm prior to the issuance of a license. At a minimum,
the license application shall include the following:
(1)
Company name and address.
(2)
Company contact information.
(3)
Name and title of authorized representative.
(4)
Vehicle make, model, year, license plate number, gross vehicle weight,
tank volume and waste management authority license number.
(5)
Description of waste to be hauled.
(6)
Proof of insurance.
(7)
Certification statement.
(8)
Signature of authorized representative.
B.
A trucked waste hauler's license must be obtained by each hauling
firm before discharging any trucked waste to the sewage treatment
plant. Licenses shall be issued to those haulers who meet all of the
following conditions:
C.
License stickers will be issued for all vehicles. License stickers
shall be firmly affixed in a prominent location on the left side of
each truck so that the license sticker is readily visible.
D.
The trucked waste hauler's license will be issued for a period of
two (2) years. Renewal applications must be received 60 days prior
to expiration.
(1)
Renewals are issued to those haulers who have satisfactorily met
all conditions of their license and who have submitted a renewal application,
including a nonrefundable check for the total required fee.
A.
Discharges normally will be accepted between the hours of 7:00 a.m.
and 10:30 p.m., Monday through Friday. Discharges on the weekends
are limited to the hours of 7:00 a.m. to 10:30 a.m. Hours are subject
to change. Under emergency conditions, as determined by the Executive
Director or his/her designee, hauled waste may be discharged outside
of normal operating hours. Haulers must enter through the gate using
the provided gate entry card.
B.
The hoses provided by the Authority at the discharge station must
be attached to the outlet or discharge from the tank truck and the
waste conveyed to the discharge point.
C.
Care shall be taken in discharging waste so as to not cause spillage
on the surface around the designated unloading location. It is the
responsibility of the licensee and his or her employees to leave the
dump station in an acceptable condition. Specifically there shall
be no waste material left in the immediate vicinity. If necessary,
the area shall be washed down by the licensee or his or her employee,
before leaving the premises. Reimbursement of costs associated with
spills and cleanup activities will be borne by the licensee.
D.
The discharge of any material which would damage or cause obstruction
of the sewage treatment plant is prohibited. Specifically prohibited
are flammables, explosives, corrosives, sand, grit, grease and oil.
E.
The original license shall be kept by the licensee at his/her place
of business, and copies shall be carried on each licensed tank truck
at all times. An Authority representative may request to see a license
at any time.
F.
All straight-body trucks and/or trailers used to discharge waste
at the sewage treatment plant shall have a current waste hauler license
sticker, issued by the Lancaster County Solid Waste Management Authority
(LCSWMA) or other applicable county waste management authority, affixed
in the appropriate position as designated by LCSWMA or the applicable
county waste management authority.
G.
The Authority or its representative may request information concerning
the nature or origin of the contents of any licensed vehicle. The
licensee is required to comply with all requests, including information
concerning waste pickup points, volumes and waste characteristics.
H.
Upon request, the licensee shall allow the Authority to immediately
sample waste from any licensed truck.
I.
The license shall be valid only as long as the licensee has all appropriate
hauling licenses or permits from other federal, state, county and
local jurisdictions for the duration of this license.
J.
Wastes collected by the licensee from any customers as defined in § 165-13 shall not be discharged at the sewage treatment plant without prior written approval in the form of a trucked waste generator permit.
K.
The Authority reserves the right to refuse acceptance of any load.
Dischargers may be required to cease unloading operations at any time.
L.
Use of the licensed vehicle to transport or store hazardous materials,
hazardous waste, fuel, wastes other than acceptable wastes, oil, greasy
wastewater or corrosives is specifically prohibited.
M.
Violation on the part of the holder of this license or his representatives
to comply with the above conditions or any Authority Rules and Regulations
shall be cause for suspension or revocation of all licenses and permits
assigned to the licensee upon written notice of such violation.
A.
Generator permit required.
(1)
Certain wastes, due to their character and potential impact on the
sewage treatment plant, will require prior approval before discharge.
This approval is formally granted through the issuance of a trucked
waste generator permit. Wastes from the following facilities shall
not be accepted without an approved permit:
(2)
Wastes consisting of septage from individual or community on-lot
sewer systems, and residential and commercial holding tank wastes,
do not require a generator permit.
B.
Generator permit application requirements. Permits are issued for
a specific waste from a specific generator. A completed trucked waste
generator permit application must be submitted by each firm prior
to the issuance of a permit. At a minimum, the permit application
shall include the following:
(1)
Generator name, address, contact information and name of authorized
representative.
(2)
Hauler name, address, contact information and name of authorized
representative.
(3)
Recent laboratory results for the parameters requested.
(4)
Indication of chemical compounds known or suspected to be present.
(5)
Requested discharge volume and number of loads expected per week
or month.
(6)
Waste generator site plan.
(7)
Description of generator activities and processes.
(8)
Certification statements, including a certification that the waste
is not a listed or characteristic hazardous waste or toxic to the
treatment plant processes.
(9)
Signature of authorized representative.
C.
A trucked waste generator permit must be obtained by each generating
entity before discharging any trucked waste to the sewage treatment
plant. Permits may be issued to those generators that meet all of
the following conditions:
D.
The trucked waste generator permit must be renewed on an annual basis.
(1)
Renewals are issued to those generators who have satisfactorily met
all conditions of their permit and who have submitted a renewal application,
including a nonrefundable check for the total required fee.
E.
Transportation. Any wastes approved by the Authority through the
issuance of a trucked waste generator permit must be transported and
discharged by a hauler who has a valid trucked waste hauler's license
issued by the Authority.
F.
Permitted trucked waste generator conditions:
(1)
Self-monitoring requirements. A permitted trucked waste generator
may be required to submit reports to the Lancaster Area Sewer Authority
on a semiannual basis. Notification of whether a report is due will
be included in the generator permit. The first semiannual report shall
cover the months of January through June and shall be submitted to
the Authority by July 30. The second semiannual report shall cover
the months of July through December and shall be submitted to the
Authority by January 30. At a minimum, the report shall contain the
following information:
(a)
Name, address and phone number of the generator.
(b)
Responsible individual representing the generator.
(c)
Name, address and phone number of the licensed waste hauler(s).
(d)
Responsible individual representing the waste hauler(s).
(e)
Volume of waste hauled to the sewage treatment plant during
the reporting period.
(f)
Analytical testing as required. This testing must be performed
by a qualified laboratory.
(g)
Certification as to the following is required:
[1]
That the waste generator is not subject to categorical pretreatment
standards.
[2]
That the waste transported and discharged at the sewage treatment
plant is not a listed or characteristic hazardous waste as defined
under the Resource Conservation and Recovery Act (RCRA).
[3]
That no significant changes in the process used to generate
the waste, or an alteration of the waste characteristics themselves,
have taken place since the last semiannual report was submitted.
The trucked waste hauler must submit with a new application
for a trucked waste license, or with a license renewal application,
current certificates of the following insurances:
A.
Vehicle liability: the minimum insurance required under the Motor
Vehicle Financial Responsibility Law (75 Pa.C.S.A. § 1701
et seq.).
B.
General liability: bodily injury, $100,000 per occurrence, and property
damage liability, $100,000 per occurrence.
C.
Workers' compensation: as required by law.
A.
Hauled waste.
(1)
Any hauled waste which is acceptable to the Authority may be discharged
only at the Lancaster Area Sewer Authority Blue Rock Water Resource
Recovery Facility located at:

(2)
Hauled waste may be discharged at this location only during the hours indicated in § 165-12. The discharge of hauled waste into any Authority facility, sewer, manhole or other location not approved for such discharge shall be considered unlawful, and the person responsible for such discharge will be subject to civil and criminal penalties.
B.
A representative sample shall be collected from each load discharged.
This sample must be identified by writing the discharge receipt number
on the sample bottle and placing the sample in the appropriate refrigerator
for later analysis by Authority personnel.
C.
A Trucked Waste Program-Receipt/Manifest Form must be submitted for
each load that is discharged.
D.
The Trucked Waste Program-Receipt/Manifest Form must include the
following information:
(1)
Date of discharge.
(2)
Time of discharge.
(3)
Name of transporter.
(4)
Truck capacity (gallons).
(5)
Trucked waste license number.
(6)
Source of waste (classification). If the waste is from a permitted
hauled waste generator, the identifying information for that generator
(7)
Itemized list of waste sources, including county, municipality, waste
type, gallons delivered, residential phone number (if applicable)
and LASA generator permit number (if applicable).
(8)
Printed name of driver.
(9)
Signature of driver.

F.
The driver must leave the original top (white) copy of the completed
Trucked Waste Program-Receipt/Manifest Form. The Trucked Waste Program-Receipt/Manifest
Form shall be placed in the appropriate area designated by the Authority.
G.
The driver must comply with all license conditions regarding discharge.
