The purpose of this chapter is to regulate, to the greatest extent permitted under the laws of the State of New York, the public display of Fireworks to:
A. 
Protect the health, safety, and welfare of the residents of the Village.
B. 
Prevent the start or spread of fires and explosions in the Village.
C. 
Minimize disruptions to humans and animals.
D. 
Minimize interruptions to the use and enjoyment of property in the Village.
As used in this chapter, the following terms shall have the meanings indicated:
Firework Permit
A permit issued by the Mayor of the Village, or the Mayor's designee, to display Fireworks in the Village.
Fireworks
Means and includes any blank cartridge, blank cartridge pistol, launcher, or toy cannon in which explosives are used; or other combustible or explosive of like construction; or any preparation containing any explosive or inflammable compound or any tablets or other device commonly used and sold as fireworks containing nitrates, chlorates, oxalates, sulfides of lead, barium, antimony, arsenic, mercury, nitroglycerine, or phosphorus or any compound containing any of the same or other explosives or any substance or combination of substances; or article prepared for the purpose of producing a visible or an audible effect by combustion, explosion, deflagration or detonation; or other device containing any explosive substance.
Person
Any individual, partnership, company, corporation, association, firm, organization, administration, department, institutional organization, or any other group of individuals or any person or employee thereof.
Village
The Incorporated Village of Sands Point.
Village Board
The Board of Trustees of the Village.
A. 
No Person shall discharge, use, manufacture, sell, or possess, Fireworks within the Village without a written permit issued pursuant to § 88-5 of this chapter, and without complying with all other applicable laws and regulations of the State of New York, the County of Nassau, the Nassau County Police Department, the Sands Point Police Department, and the Nassau County Fire Marshal.
B. 
Any display of Fireworks shall last no more than 15 minutes and shall end no later than 10:00 p.m.
C. 
Except as authorized by the Village Board, and as permitted by § 88-3D of this chapter, no more than three Firework Permits shall be issued to an Applicant over a twelve-month period.
D. 
Notwithstanding § 88-3C of this chapter, an Applicant may be issued one additional Firework Permit on July 4 or during the weekend immediately prior to or after July 4.
E. 
A Person may apply to the Village Board for a special permit to display Fireworks in excess of the time restrictions and limitations permitted pursuant to § 88-3B. The Village Board, in its sole discretion, may grant, deny, or grant with restrictions and/or conditions, an application for a special permit.
Pursuant to § 405.00(1) of the Penal Law of the State of New York, the Village Board designates the Mayor, or the Mayor's designee, as the officer authorized to grant and issue a Firework Permit.
The Mayor, or the Mayor's designee, in his or her sole discretion, may, upon due application from any Person, issue a Firework Permit to a Person for a display of Fireworks on a specific date and time, provided that:

The Person agrees, as a condition of the issuance of a Firework Permit, that the display of Fireworks shall last no more than 15 minutes in duration and shall be finished no later than 10:00 p.m.

A fee of $100 shall be charged for each Firework Permit issued to display Fireworks. The Village reserves the right to amend the amount of all fees in this chapter from time to time by resolution of the Village Board; such amendments shall be published as an appendix to the Village code.
Police officers from the Village's Police Department, the Nassau County Police Department, the Nassau County Fire Marshal, as well as the Village's Code Enforcement Officers, are hereby authorized to issue violations to any Person in violation of this chapter.
The provisions of this chapter shall not apply to any official event at the Village Club of Sands Point that has been approved or sponsored by the Village or authorized by the Village Board.
Any person, firm, cooperation, or institutional organization violating any of the provisions of this chapter, shall, upon conviction thereof, be subject to a fine not exceeding $10,000 for each violation, regardless of any convictions for prior violations.
