The title of this chapter shall be the "Games of Chance.”
A. 
The State of New York has enacted General Municipal Law Article 9-A, granting to every municipality the right, power and authority to authorize the conduct of games of chance by authorized organizations within the territorial limits of such municipality. If a local law or ordinance authorized by General Municipal Law Article 9-A is adopted by a town, such a law shall be operative in any village within the town only if the Board of Trustees of said village adopts a local law or resolution, subject to permissive referendum as provided in Village Law Article 9, authorizing the issuance of licenses by the New York State Gaming Commission and authorizing the issuance of permits by the town for games of chance within such village.
B. 
The Town of Cortlandt, within which the Village of Buchanan is wholly located, duly adopted an ordinance by Resolution 283-76 of the year 1976 authorizing Games of Chance, pursuant to the aforementioned authority contained in General Municipal Law Article 9-A, which ordinance provides that it shall be lawful for any authorized organization, upon obtaining a license therefor as required, to conduct games of chance within the territorial limits of the Town of Cortlandt, subject to the provisions of the local law, General Municipal Law Article 9-A, and the rules and regulations of the New York State Racing and Wagering Board, now known as the New York State Gaming Commission.
C. 
This chapter is enacted by the Village of Buchanan for the purpose of authorizing the issuance of licenses and/or permits by the Town of Cortlandt for games of chance to be conducted within the Village of Buchanan.
As used in this chapter, the following terms shall have the meanings indicated:
AUTHORIZED ORGANIZATION
An authorized organization as defined in General Municipal Law § 186, Subdivision 4.
GAMES OF CHANCE
A game of chance as defined in General Municipal Law § 186, Subdivision 3.
VILLAGE
The Village of Buchanan, New York.
A. 
The Town of Cortlandt is authorized to provide to authorized organizations applications for licenses to the New York State Gaming Commission and, thereafter, when a license is obtained from the New York State Gaming Commission, to issue permits to authorized organizations to conduct games of chance within the Village of Buchanan, subject to the provisions of the Town of Cortlandt’s Ordinance, General Municipal Law Article 9-A, and the rules and regulations of the New York State Gaming Commission.
B. 
Authorized organizations may conduct games of chance within the Village of Buchanan, Westchester County, New York, upon obtaining a license issued by the New York State Gaming Commission and a permit issued by the Clerk of the Town of Cortlandt, or other designated officers of the Town in which the games are proposed to be conducted. All such games of chance shall be conducted in accordance with Article 9-A of the General Municipal Law, the local laws of the town wherein the games are conducted, and the rules and regulations of the New York State Gaming Commission.
This chapter shall take effect immediately upon filing with the Office of the Secretary of State following either the last day to file a petition (March 1) or its approval by the majority of qualified voters voting thereon at the General Village of Buchanan election to be held on March 15, 2022.
