A. 
This chapter is adopted pursuant to the authority granted to the Village Council under the Recreation and Playgrounds Act 156 of 1917, MCL § 123.51, et seq., to establish a Parks and Recreation Board with the powers, duties, and limitations provided by the Act and subject to the terms and conditions of this chapter and any future amendments to this chapter.
B. 
The purpose of the ordinance is to provide that the Village of New Haven shall establish a Parks and Recreation Board; to establish appointments, terms, and membership of the Board; to set a schedule of meetings and to proscribe the authority, powers and duties of the Parks and Recreation Board.
The Parks and Recreation Board shall consist of at least seven members and shall be comprised as follows:
A. 
One member of the Village Council shall serve as an ex officio member;
B. 
Six citizens of the Village of New Haven who are in good standing with the Village and who do not serve as a member of the Village Council.
A. 
The Village President, with the approval of the Village Council by a majority, shall appoint all members of the Parks and Recreation Board, in accordance with the following:
(1) 
The term of each appointed Village resident member shall be three years;
(2) 
The ex officio council member shall serve a term of one year;
(3) 
All members shall hold office until their successors are appointed;
(4) 
Vacancies that occur before the expiration of any term shall be filled in the same manner as an original appointment.
B. 
All members shall have full and equal voting rights.
C. 
All members of the Parks and Recreation Board shall serve with compensation as determined by resolution of the Village Council.
The Village Council, by majority vote, may remove a member of the Parks and Recreation Board after a public hearing. Members will be considered resigned after missing three regular meetings in a row.
A. 
The Parks and Recreation Board shall meet on the third Tuesday of each month, at 7:00 p.m. at the Village Municipal Offices. All meetings of the Parks and Recreation Board shall be conducted in compliance with the Open Meetings Act, Public Act 267 or 1976, MCL § 15.261, et seq.
B. 
The Parks and Recreation Board shall, from its members, elect a Chairperson, Co-Chair, Secretary and other officers as deemed necessary, at the first meeting of every year. Notification of these appointments shall be made to the Village Council.
The Parks and Recreation Board shall adopt by-laws for the transaction of business, and shall keep a public record of all resolutions, transactions, findings, and determinations.
The Chairperson shall preside at all meetings of the Board. In the Chairperson's absence, the Vice Chairperson shall preside.
A majority of the membership shall constitute a quorum. A simple majority of those voting shall be required for the adoption of a motion, unless otherwise required by law.
If, during a regularly scheduled meeting, it is determined that a special meeting is warranted, it shall be scheduled with a majority vote approval. Special meetings of the Board may be called upon request of the Chairperson or any two members of the Board, with twenty-four-hour notice to each member. They shall be notified of the purpose of the special meeting. Notice of the special meeting shall be posted at the municipal offices at least 24 hours in advance of the meeting.
Each member of the Board shall be responsible for regular attendance at the scheduled meetings, with familiarity of the subject matter at the meetings.
The Parks and Recreation Board shall be responsible for the promotion, coordination, and oversight of the Village park facilities and recreational programs. It shall:
A. 
Create and implement a Parks and Recreation Plan for parks and facilities; prepare a Capital Improvement Program for the Village parks and facilities;
B. 
Plan, develop, and coordinate Village recreational programs;
C. 
Identify available funding resources to implement goals; serve as advisor to the Village Council for all budgeting and funding decisions that may impact the Village facilities and programs;
D. 
Establish policies and procedures for the administration and regulation of Village parks, services and amenities. The Board shall recommend to the Village Council the adoption of rules and regulations pertaining to the use of parks, facilities and public spaces that are necessary to protect the property and ensure the health, safety and welfare of the public;
E. 
Create a program of community outreach to assist in creating park facilities and recreational programming that meets the needs and wants of the Village;
F. 
Act as a contact point of information for all community parks and recreational programs within the Village.
The Parks and Recreation Board will submit a written annual report to the Village Council at the December Council meeting, with a summary of the year's events, status of the parks and facilities in the Village, with a summary and status of any future developments in the Village's parks and facilities.
The Parks and Recreation Board is a nonadministrative board serving solely in an advisory capacity. The Board may make recommendations to the Village Council, but not may not assume any legislative or administrative authority in the operation of any Village department, park, or recreation facility except as specifically provided in this chapter.
The provisions of this chapter are hereby declared to be severable, and if any part is declared invalid for any reason by a court of competent jurisdiction, it shall not affect the remainder of the ordinance, which shall continue in full force and effect.
A. 
This chapter shall take full force and effect on the date of publication.
B. 
Any ordinance or part of any ordinance in conflict with this chapter amendment is repealed to the extent of the conflict.
