The civic and institutional buildings of the Borough of East
Greenville form recognizable icons in the Borough and are part of
the essential fabric of the Borough's built environment. These
highly valued buildings are landmarks in the community and the preservation
of their physical character is important to the history and culture
of the Borough of East Greenville and to civic pride in the Borough.
This Article XIIA is intended to further the following goals:
A. Recognize and preserve the distinctive architecture of civic and
institutional buildings in the Borough of East Greenville.
B. To maintain and preserve civic and institutional buildings in the
Borough of East Greenville.
C. To preserve and enhance the essential fabric of existing neighborhoods.
D. To safeguard the Borough of East Greenville's heritage by preserving
landmark buildings.
E. To provide for appropriate adaptive reuse of civic and institutional
buildings to ensure economic viability of preservation.
F. To preserve the scale, streetscape, and overall "feel" of the community.
G. To discourage unnecessary demolition of landmark buildings.
H. To acknowledge and recognize important stories, groups, and places
in the community.
There is hereby created a zoning overlay on the buildings identified
in this section. The overlay is intended to apply to civic or institutional
buildings that have been in existence in their location in the Borough
for at least 50 years and have architecture that is distinctive or
recognizable to most residents of the Borough. Although this list
may be amended from time to time by Borough Council upon identification
of additional civic or institutional buildings that meet the criteria
in the foregoing sentence, the overlay shall only apply to civic or
institutional buildings identified below, as the same may be amended:

The following use shall be permitted by conditional use, in accordance with the general requirements for conditional use set forth in §
95-163, the Pennsylvania Municipalities Planning Code, 53 P.S. § 10101 et seq., with the appropriate zoning permit, and subject to the additional requirements set forth in this section.
A. Use B-6: multifamily development.
B. For properties located on Main Street (SR 29) the following uses:
(2) Use C-3: day-care facility.
(4) Use D-6: microbrewery/microdistillery/microwinery.
(5) Use D-7: mixed use, when containing one or more residential units
and one of the other uses listed in this section.
(6) Use D-8: overnight lodging.
(7) Use D-9: indoor recreation.
(8) Use D-11: restaurant, dine-in.
(9) Use D-12: restaurant, take-out.

Use D-13: retail establishment.

Use D-14: service/personal care.

Use E-1: coworking space.
(14)
Use E-2: office, business/professional.
C. If this overlay permits a use that is also permitted by the underlying
zoning, the conditions of the underlying zoning shall suffice to allow
the use.
D. Accessory uses that are determined by the Zoning Officer to be subordinate
and customarily incidental to any of the above permitted uses shall
be permitted.
Any applicant for a conditional use permitted in §
95-117 shall demonstrate compliance with the following conditions:
A. Uses permitted by §
95-117B shall comply with applicable dimensional standards of the Borough Commercial District (§
95-72).
B. The building shall be a civic or institutional building as defined by this chapter, and shall be identified in §
95-116.
C. The proposed use(s) shall maintain, protect, and preserve the civic
or institutional building, including, but not limited to, retaining
and preserving the appearance and character of the civic or institutional
building.
D. All new buildings proposed on the same lot shall:
(1) Comply with all requirements of the underlying zoning district and
shall not be eligible for the uses permitted only by this overlay;
(2) Be compatible with the civic or institutional building in appearance,
size, scale, and materials; and
(3) Shall not block views of the civic or institutional building from
the public way.
E. Additions to civic or institutional buildings.
(1) Building additions shall be located on the rear or side facade of
the building.
(2) Building additions shall be compatible with the existing building
in appearance, size, scale, and materials.
(3) Building additions may also be used for the uses listed in §
95-117 provided other requirements of this chapter are met and the additions are equal to 75% or less of the floor area of the civic or institutional building.
(4) Building additions for multifamily uses shall also comply with all of the requirements of §§
95-62 and
95-64.
F. By conditional use, in compliance with all other requirements of
this overlay, the following dimensional requirements may be adjusted
on any parcel or lot with a civic or institutional building that is
part of this overlay. These adjustments shall apply only to the civic
or institutional building and any additions to that building.
(1) Maximum building footprint: increased by 35%.
(2) Maximum building coverage: increased by 35%.
(3) Maximum impervious coverage: increased by 25% impervious coverage.
The additional increase in impervious coverage shall comply with all
other Borough ordinances and should incorporate stormwater best management
practices.
(4) Minimum required setback. The minimum required setback shall remain the same as the underlying zoning district but may be relieved by the amount necessary so that a property can achieve reliefs in Subsections
A through
D above as long as the relief does not exceed a 50% reduction of the setback required by the underlying zoning district.
G. The applicant shall guarantee the permanent protection of the architectural
features and design integrity of all civic or institutional buildings
on the lot. This guarantee shall be made by means of a deed restriction,
conservation easement, facade easement, or other means acceptable
to the Borough Solicitor and Borough Council. At minimum, this shall
include:
(1) Surface materials shall be maintained or replaced with like/in-kind
materials.
(2) Window or door openings shall not be altered, other than for maintenance
or replacement with like/in-kind materials.
(3) There shall be no further additions or structural alterations to
any part of the building visible from any public sidewalk or right-of-way,
except for replacement of existing features, such as porches, patios,
etc., with like/in-kind materials and assemblies.
(4) Utilities located on the exterior of existing buildings, such as
heat pumps, central air conditioning units, etc., shall not be relocated
except to areas that are equally or less visible from any public sidewalk
or right-of-way.
