It shall be unlawful for any person to consume, smoke, vape
or utilize cigarettes, cigars, pipes, electronic cigarettes or use
any other form of tobacco or cannabis in, on, or within any Village
parks and buildings.
A.
Public
parks include, but are not limited to, Kennelly Park, Potter Park,
Thomas Creek Park, Park Circle Drive Park, Winding Brook Drive Park,
and Misty Pine Road Park. Restricted parks are subject to change by
motion or resolution by the Village Board. The official list of restricted
parks will be held in the Clerk-Treasurer's office.
B.
Public
buildings include, but are not limited to, Village Hall, Fairport
Police Department, Fairport Fire Department, Fairport Municipal Commission
Operations Centers, Department of Public Works Facility, and the Perinton
Historical Society and Museum. Restricted buildings are subject to
change by motion or resolution by the Village Board. The official
list of restricted parks will be held in the Clerk-Treasurer's office.
Any person who shall violate the provisions of this chapter
shall, upon conviction, be punished by a fine of not less than $25
nor more than $250 or by imprisonment not exceeding 15 days, or by
both such fine and imprisonment, for each offense, or be punished
by a sentence of not less than four hours nor more than 10 hours of
community service.
